1. Nature and Purpose of Law | 法律的性质与目的

Law can be defined as a set of rules created by the state which governs the behaviour of individuals and organisations. These rules are enforced by the courts, and penalties or remedies are imposed for breaking them.

One key purpose of law is to maintain public order and protect citizens from harm. Another is to provide a framework for resolving disputes peacefully, whether between individuals, businesses, or the state itself. Criminal Law 刑法

2. The UK Court Structure | 英国法院结构

The English court system is hierarchical. Criminal and civil cases are usually heard in separate courts, and the route of appeal follows the court hierarchy. At the bottom of the structure are the Magistrates’ Court and County Court, with the Supreme Court at the apex.

For civil disputes, the County Court handles the majority of small and intermediate claims, while the High Court deals with more complex or high-value cases. The Court of Appeal (Civil Division) hears civil appeals, and the Supreme Court is the final court of appeal for the most important cases.

Delegated legislation is law made by other bodies under powers given to them by an Act of Parliament. Delegated legislation allows for quicker, more detailed regulation, but it is subject to control by Parliament and the courts.

Judicial precedent, or stare decisis, means that courts must follow the decisions of higher courts in previous similar cases. The binding part of a judgment is called the ratio decidendi (the legal reason for the decision), while comments that are not essential to the decision are known as obiter dicta and are not binding but may be persuasive.

The court hierarchy determines which precedents are binding. The doctrine promotes certainty, fairness and predictability, though it can be rigid. The Practice Statement 1966 allows the Supreme Court to depart from its own previous decisions when it appears right to do so.

Most criminal offences require two key elements: the actus reus (the guilty act) and the mens rea (the guilty mind). The prosecution must prove both beyond reasonable doubt. The actus reus can be a positive act, an omission (where a duty to act exists), or a state of affairs.

Some offences, known as strict liability offences, require no mens rea for at least part of the actus reus.

The most serious, s.18 GBH with intent, requires specific intent to cause grievous bodily harm or to resist arrest.

7. Contract Law: Formation Essentials | 合同法:成立要件

A valid contract requires offer, acceptance, consideration, intention to create legal relations and capacity. An offer is a definite promise to be bound on specific terms, distinguished from an invitation to treat, which is merely an invitation to negotiate (e.g. goods displayed in a shop: Pharmaceutical Society of Great Britain v Boots).

8. Negligence in Tort | 侵权法中的过失

The tort of negligence allows a claimant to claim compensation for injury or damage caused by another’s failure to take reasonable care. To succeed, the claimant must prove that the defendant owed a duty of care, breached that duty, and caused loss or damage that was not too remote.

The duty of care is established using the ‘neighbour principle’ from Donoghue v Stevenson: you must take reasonable care to avoid acts or omissions that you can reasonably foresee would be likely to injure your neighbour. The current test for duty includes foreseeability, proximity, and whether it is fair, just and reasonable to impose a duty (Caparo Industries plc v Dickman). Breach is judged against the standard of the reasonable person; a lower standard is expected of learners but a higher standard of professionals.

Juries are used in criminal trials in the Crown Court and occasionally in civil cases such as defamation or false imprisonment. A jury of 12 randomly selected lay people decides questions of fact based on the evidence and reaches a verdict, while the judge directs on the law. The jury must try to reach a unanimous or at least a majority verdict (10-2) after sufficient deliberation.

They deal with over 95% of criminal cases, including all summary offences and many either-way offences. They also handle some civil work such as family proceedings and licensing. They can impose sentences of up to 12 months’ imprisonment.

Civil litigation begins with the claimant issuing a claim form, which the defendant must acknowledge or defend. Pre-trial procedures include disclosure of documents and exchange of witness statements. Most civil cases are settled before they reach trial; if they do go to trial, the judge decides both law and fact and awards an appropriate remedy.

The most common remedy in civil law is damages, a monetary sum intended to compensate the claimant for the loss suffered. The principle is to put the claimant back into the position they would have been in had the tort or breach not occurred. Other equitable remedies include injunctions (an order to stop doing something) and specific performance (ordering a party to perform their contractual obligations).
