This article consolidates the core topics you need to understand for your studies, including the nature of law, sources of law, criminal and civil liability, and the role of juries.

Year 10 OCR

1. The Nature and Purpose of Law |

Law can be defined as a system of rules created and enforced by the state to regulate behaviour. Unlike moral rules or social customs, legal rules carry official sanctions, such as fines, imprisonment or injunctions, which are applied by courts and the police.

The main purposes of law include maintaining public order, protecting individuals and their property, promoting justice and fairness, resolving disputes peacefully, and setting standards of acceptable conduct. Without law, arbitrary power and chaos could prevail.

2. Sources of Law: Statute, Common Law, and Equity |

English law comes from several key sources. Statute law is legislation passed by Parliament. Common law is developed by judges through decisions in cases, also known as case law or precedent. Equity is a body of rules that supplements common law, providing remedies where strict application of the law would be unfair.

Statutes override common law where they conflict, due to parliamentary sovereignty. Equity operates on principles such as ‘he who comes to equity must come with clean hands’ and offers remedies like injunctions and specific performance.

3. How Parliament Makes Law |

Before a bill becomes an Act of Parliament, it goes through several stages in the House of Commons and the House of Lords. It typically starts as a Green Paper (consultation document) and then a White Paper (firm proposal), before being drafted into a bill.

In each House there is a First Reading (formal introduction), Second Reading (main debate on principles), Committee Stage (detailed examination), Report Stage (further amendment), and Third Reading (final approval). Once both Houses agree, it receives Royal Assent and becomes law.

4. Statutory Interpretation |

Judges often need to interpret words in statutes when the meaning is unclear. They use specific rules of interpretation. The literal rule gives words their ordinary dictionary meaning, even if the result seems harsh.

The golden rule allows judges to avoid an absurd result by choosing an alternative meaning. The mischief rule looks at what ‘mischief’ the statute was intended to remedy, examining the common law before the Act. Additionally, the purposive approach considers the overall purpose of the legislation, which is increasingly used in line with European influences.

Aids to interpretation include intrinsic aids (within the Act itself, like the long title) and extrinsic aids (outside the Act, such as Hansard and dictionaries).

5. Judicial Precedent and Court Hierarchy |

Judicial precedent is based on the doctrine of stare decisis, which means ‘to stand by things decided’. Lower courts must follow the legal principles laid down in previous decisions of higher courts, providing consistency and predictability in the law.

The ratio decidendi is the binding part of a judgment, the legal reason for the decision. Obiter dicta are comments made ‘by the way’, which are persuasive but not binding. The UK court hierarchy starts with the Supreme Court (formerly House of Lords) at the top, followed by the Court of Appeal, High Court, Crown Court/Magistrates’ Courts and County Courts.

Since 1966, the Supreme Court can depart from its own previous decisions when it appears right to do so, using the Practice Statement.

6. Criminal Law: Actus Reus and Mens Rea |

Most crimes require proof of two elements: actus reus (the guilty act) and mens rea (the guilty mind). Actus reus can be an act, an omission (where there is a duty to act), or a state of affairs. Mens rea refers to the defendant’s mental state, such as intention or recklessness.

For example, in murder, the actus reus is the unlawful killing of a human being, and the mens rea is intention to kill or cause grievous bodily harm. Some offences are strict liability, meaning no mens rea is required for at least part of the actus reus, often for regulatory matters like selling alcohol to minors.

7. Non-Fatal Offences Overview |

The main non-fatal offences against the person include assault, battery, actual bodily harm (ABH) under section 47 of the Offences Against the Person Act 1861, and grievous bodily harm (GBH) under sections 18 and 20 of the same Act.

Assault is causing the victim to apprehend immediate unlawful force, and battery is the actual infliction of that force. ABH requires proof of ‘some harm’ that is more than trivial, with intention or recklessness as to assault or battery. Section 20 GBH (malicious wounding) requires intention or recklessness as to some harm, while section 18 GBH requires specific intent to cause serious harm.

8. Civil Law: Tort of Negligence |

In civil law, a tort is a civil wrong giving the injured party the right to claim compensation. The tort of negligence requires the claimant to prove three elements: a duty of care owed by the defendant, a breach of that duty, and damage caused by the breach (causation).

The neighbour principle from Donoghue v Stevenson (1932) established that a person must take reasonable care to avoid acts or omissions that can reasonably be foreseen as likely to injure a ‘neighbour’ – someone closely affected by your actions. Breach is measured against the standard of the reasonable person. Causation uses the ‘but for’ test and the requirement that the damage is not too remote.

9. Contract Law: Formation Essentials |

A valid contract generally requires an offer, acceptance, consideration, and an intention to create legal relations. An offer is a clear expression of willingness to contract on certain terms, distinct from an invitation to treat (e.g., goods on a shop shelf – Pharmaceutical Society v Boots).

Acceptance must be unconditional and communicated to the offeror. Consideration is the exchange of something of value; each party must give something. The rule is that consideration must be sufficient but need not be adequate. Social and domestic agreements are presumed not to have an intention to create legal relations, while commercial agreements are presumed to have it.

10. Juries and Their Role |

Trial by jury is a fundamental part of the English legal system, used in the Crown Court for serious criminal cases. The jury consists of 12 randomly selected members of the public aged 18-75, whose role is to decide the facts and return a verdict of guilty or not guilty based on the evidence.

Juries decide questions of fact, while the judge decides questions of law. Their deliberations are secret, and historically they provided a safeguard against unfair state prosecutions. However, eligibility rules have been reformed by legislation such as the Criminal Justice Act 2003, and there are debates about their competence in complex fraud cases.
