The fact he pushed hard to escape indicates recklessness. Dan could raise no valid defence such as self-defence because Chloe was lawfully detaining him under citizen’s arrest powers. However, the proportionality of the push would be examined by the court. Overall, Dan is likely to be found guilty of both theft and ABH.
