1. The Nature of Law | 法律的性质

Law can be defined as a set of rules created by the state that are enforceable through the courts. These rules are backed by sanctions, such as fines, imprisonment or compensation orders, which distinguish legal rules from social rules and moral norms. Social rules, like queuing or table manners, are not enforceable by the state, whereas a breach of a legal rule leads to state-imposed consequences.

Law and morality often overlap but are not identical. Theories of justice include corrective justice, which focuses on restoring balance, and distributive justice, which concerns the fair allocation of resources.

2. Sources of Law | 法律的渊源

Statute law, or legislation, is the most important source of law today. It is made by Parliament, which consists of the House of Commons, the House of Lords and the Monarch. Acts of Parliament are supreme and can override any other source. For example, the Offences Against the Person Act 1861 is a key statute in criminal law.

Delegated legislation, made by bodies to which Parliament has delegated power (e.g. government ministers, local authorities), allows detailed rules to be created efficiently, though it is subject to judicial review.

The English legal system distinguishes between criminal courts and civil courts. Criminal courts deal with offences against the state. Magistrates’ Court tries summary offences (e.g. minor assaults, driving offences) and some either-way offences, with appeals going to the Crown Court. The Crown Court hears serious indictable offences (e.g. murder, rape) before a judge and jury. Appeals from the Crown Court go to the Court of Appeal (Criminal Division).

Appeals typically go to the Court of Appeal (Civil Division) and ultimately to the Supreme Court, which is the final court of appeal for all UK cases.

Magistrates are unpaid lay members of the community who sit in the Magistrates’ Court, advised on law by a legal adviser. Solicitors provide initial advice and can represent clients in lower courts, while barristers are specialist advocates who present cases in higher courts.

5. Criminal Law: General Principles | 刑法:基本原则

To establish a criminal offence, the prosecution must usually prove both the actus reus (guilty act) and the mens rea (guilty mind). Actus reus includes all elements of the crime other than the defendant’s state of mind, such as conduct, circumstances and consequences. It must be voluntary; an act done while sleepwalking or under a reflex is not an actus reus.

Mens rea is the mental element. The main types are intention (direct and oblique), recklessness (knowing there is a risk and taking it unjustifiably) and, for some crimes, negligence or knowledge. Strict liability offences require no mens rea for at least one element; they are typically regulatory offences where protecting the public is paramount, such as selling food beyond its use-by date.

Causation links the defendant’s conduct to the result. In consequence crimes (e.g. murder, ABH), the prosecution must establish factual causation (the ‘but for’ test) and legal causation, where the defendant’s act must be a substantial and operating cause of the harm, and there must be no intervening act (novus actus interveniens) that breaks the chain of causation.

6. Non-fatal Offences against the Person | 非致命人身犯罪

The main non-fatal offences are assault, battery, assault occasioning actual bodily harm (ABH), malicious wounding or inflicting grievous bodily harm (GBH under s.20) and wounding or causing GBH with intent (s.18 OAPA 1861). Assault is any act that causes the victim to apprehend immediate unlawful personal violence; no touching is required. Battery is the actual application of unlawful force on another person.

ABH (s.47) requires assault or battery that causes actual bodily harm, meaning any hurt or injury calculated to interfere with the health or comfort of the victim, such as cuts, bruises or psychiatric harm. The mens rea for s.47 is the same as for the original assault or battery. GBH under s.20 requires a wound (breaking of both layers of the skin) or really serious bodily harm; the mens rea is ‘malice’, meaning intention or recklessness as to some harm. The more serious s.18 requires proof of intent to cause GBH or to resist lawful arrest; it carries a maximum of life imprisonment.

7. Criminal Defences | 刑事辩护

Self-defence is a complete defence if the defendant used force that was genuinely believed to be necessary and the degree of force was reasonable in the circumstances. The law recognises that a person in danger cannot weigh the exact measure of force. Intoxication can be a defence to crimes of specific intent (e.g. s.18 GBH) if the intoxication was involuntary. Voluntary intoxication is no defence unless it negates the mens rea for a specific intent crime; it does not assist where the intoxication itself provides the recklessness (e.g. in s.20 GBH).

Consent may be a defence to minor offences like battery in sports or surgery, provided the consent is informed and the act falls within the boundaries of public policy. Duress arises when the defendant is forced to commit a crime under threat of death or serious violence. It is not available for murder or certain treason offences. Automatism negates the actus reus and is a complete defence if the defendant’s act was involuntary due to an external factor, such as being hit by a stone.

8. Tort Law: Negligence | 侵权法:过失

The tort of negligence imposes a duty not to cause foreseeable harm to others. To succeed in a negligence claim, the claimant must prove three elements: the defendant owed a duty of care, the defendant breached that duty, and the breach caused damage that is not too remote.

过失侵权行为规定了不对他人造成可预见损害的义务。要成功主张过失索赔,原告须证明三个要素:被告负有注意义务、被告违反了该义务,且该违反应行为导致了并非过于遥远的损害。

The existence of a duty of care is assessed using the Caparo test (from Caparo Industries plc v Dickman): (1) harm was reasonably foreseeable, (2) there was sufficient proximity between the parties, and (3) it is fair, just and reasonable to impose a duty. The classic example is the neighbour principle from Donoghue v Stevenson, where the manufacturer owed a duty to the consumer. Breach is judged by the standard of the reasonable person, with special standards for professionals and children.

Causation in negligence follows the ‘but for’ test, and the damage must not be too remote; the rule from The Wagon Mound states that only damage of a kind that was reasonably foreseeable is recoverable. The claimant must also prove that damage was suffered, such as personal injury, property damage or psychiatric harm (with additional control mechanisms for psychiatric injury).

9. Other Torts | 其他侵权行为

Occupiers’ liability concerns the duty owed by those who control premises to entrants who are injured due to the state of the premises. Under the Occupiers’ Liability Act 1957, a common duty of care is owed to lawful visitors: to see that the visitor is reasonably safe in using the premises for the permitted purpose. Under the Occupiers’ Liability Act 1984, a limited duty is owed even to trespassers if the occupier is aware of a danger and the risk is one they may reasonably protect against.

Private nuisance is an unlawful interference with a person’s use or enjoyment of land. It typically involves noise, smells, smoke or vibrations. The court balances the competing interests of neighbours, considering factors such as the locality (a rural area tolerates more farming smells), duration and sensitivity of the claimant. An actionable nuisance must be substantial and unreasonable. The main remedy is damages or an injunction.

10. Contract Formation | 合同成立

A valid contract requires offer, acceptance, consideration, intention to create legal relations and capacity. An offer is a definite promise to be bound on specific terms, which is distinguished from an invitation to treat (e.g. goods on a shelf are not offers but invitations for customers to make an offer: Pharmaceutical Society v Boots). Acceptance must be an unconditional agreement to all the terms of the offer and must be communicated; the postal rule is an exception, where acceptance by post takes effect when the letter is posted.

Consideration is the price of the promise, something of value given by each party. It must be sufficient but need not be adequate (courts do not generally assess the economic adequacy of consideration). Past consideration is not valid, except for certain circumstances under the doctrine of promissory estoppel. Intention to create legal relations is presumed in commercial agreements but not in social or domestic arrangements, though the presumption can be rebutted.

11. Contractual Terms and Discharge | 合同条款与解除

Contractual terms may be express (stated by the parties) or implied by statute, custom or the courts. The Sale of Goods Act 1979 implies terms about satisfactory quality and fitness for purpose. Terms are classified as conditions, warranties or innominate terms. Breach of a condition allows the innocent party to terminate the contract and claim damages; breach of a warranty only entitles them to damages. Innominate terms are assessed by the consequences of breach.

Contracts can be discharged by performance, breach, agreement or frustration. Discharge by performance occurs when both parties have fulfilled all their obligations. Frustration applies when an unforeseeable event makes performance impossible, illegal or radically different from what was agreed, and neither party is at fault. Remedies for breach of contract include damages (aimed at putting the claimant in the position they would have been in had the contract been performed), specific performance and injunctions in equity.

12. Human Rights Law | 人权法

The Human Rights Act 1998 incorporated the European Convention on Human Rights (ECHR) into UK law. It allows individuals to bring claims in UK courts for breaches of Convention rights, rather than having to go to the European Court of Human Rights in Strasbourg. Key rights include the right to life (Article 2), the prohibition of torture (Article 3), the right to a fair trial (Article 6) and the right to respect for private and family life (Article 8).

This preserves the sovereignty of Parliament while protecting fundamental rights in everyday legal disputes.
