At the heart of criminal law lies a simple equation: Actus Reus + Mens Rea + No Defence = Criminal Liability. This means that for a defendant to be guilty, the prosecution must prove beyond reasonable doubt that they committed the guilty act (actus reus) with the guilty mind (mens rea), and that no valid legal defence applies.

The actus reus can be broken down into its own sub-formula: Actus Reus = Voluntary Conduct (Act or Omission) + Causation. The conduct must be voluntary; an involuntary act, such as being pushed into someone, does not satisfy actus reus. An omission can only form the actus reus if there is a legal duty to act, for example a parent’s duty to a child or a contractual duty.

Break this into five elements: Appropriation (s.3) + Property (s.4) + Belonging to another (s.5) + Dishonesty (s.2, as interpreted in R v Ghosh/Ivey) + Intention to permanently deprive (s.6). All five must be proved.

Acceptance must be unconditional and communicated (postal rule exception: Adams v Lindsell). Consideration is something of value exchanged between parties, though it need not be adequate (Thomas v Thomas).

(2) Is there proximity between claimant and defendant? (3) Is it fair, just and reasonable to impose a duty? (Caparo Industries plc v Dickman).

Seriousness of Offence + Aggravating Factors – Mitigating Factors = Sentence. When judges pass sentence, they start by assessing the culpability (blameworthiness) of the offender and the harm caused. They then adjust the sentence upwards for aggravating factors (e.g. previous convictions, offence committed on bail, vulnerable victim) and downwards for mitigating factors (e.g. early guilty plea, remorse, lack of previous convictions).

9. Burden and Standard of Proof | 举证责任与证明标准

Civil cases: Claimant bears the burden on the balance of probabilities — more likely than not. The evidential burden may shift during trial; for example, if the defendant raises a defence, they may need to adduce some evidence to make it a live issue, but the legal burden usually remains on the prosecution (except for insanity or statutory reversals).

10. Statutory Interpretation Rules | 法律解释规则
Judges use several ‘rules’ or approaches to interpret statutes:

Defences operate to negate liability even where the actus reus and mens rea are present. They can be memorised as a checklist:
