Do not assume every criminal law topic is about guilt; strict liability is a frequent OCR exam topic and students must be able to identify it and explain its justification (public protection, efficiency, and deterrence).

The key test has two limbs: (1) did the defendant genuinely believe force was necessary? This is subjective. (2) Was the amount of force used reasonable in the circumstances as the defendant believed them to be? This is objective.

Save for ‘householder cases’ where a slightly higher level of force may be considered reasonable, the general rule is that the force must not be excessive. Stress that the law does not license revenge.

It requires no physical contact—a threatening gesture, such as shaking a fist within reach, can be an assault if the victim expects to be hit.

To secure high marks, always state the precise actus reus and mens rea for each offence: assault requires intention or recklessness as to causing apprehension; battery requires intention or recklessness as to applying unlawful force.

This is a fundamental misunderstanding. The modern law of negligence was famously established in Donoghue v Stevenson, where the claimant had no contractual relationship with the manufacturer of a ginger beer bottle containing a decomposed snail. The House of Lords held that a manufacturer owes a duty of care to the ultimate consumer, introducing the ‘neighbour principle’: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour.

Contract is not a prerequisite. In an exam problem on negligence, spotting that the parties are strangers but still owed a duty is an excellent way to demonstrate understanding.

Under the rule in Rylands v Fletcher, a person who brings onto their land something likely to do mischief if it escapes is strictly liable for the damage caused, provided the use was non-natural. The claimant does not need to prove negligence. This is a tricky topic for Year 11, but a classic OCR area.

Nevertheless, the starting point is that fault is irrelevant.

Punitive (exemplary) damages are extremely rare in English law and are not the norm. An injunction is an order to stop doing something or to compel a positive act, not a punishment.

Understanding this distinction sharpens essays across the whole syllabus.
