1. Actus Reus and Mens Rea: The Guilty Act and Guilty Mind | 犯罪行为与犯罪意图:有罪的行为与有罪的心理

In criminal law, every offence generally requires two fundamental elements to be proven beyond reasonable doubt. Actus reus refers to the physical element of the crime – the guilty act, omission, or state of affairs. It can be a positive action (striking someone) or a failure to act where a duty exists (failing to provide food for a child).

2. Causation: The Link Between Act and Consequence | 因果关系:行为与后果之间的链接

Causation is part of the actus reus in result crimes such as murder. The prosecution must prove that the defendant’s act was both the factual and legal cause of the consequence. Factual causation is often established by the ‘but for’ test: but for the defendant’s conduct, would the harm have occurred?

Legal causation ensures the defendant’s act was a substantial and operating cause of the harm, and there was no novus actus interveniens (new intervening act) which broke the chain of causation. An intervening act, such as a third party’s unforeseeable action or a victim’s own free and informed act, may relieve the defendant of liability.

3. Fatal Offences: Murder and Voluntary Manslaughter | 致命罪行:谋杀与自愿过失杀人

Murder is defined as the unlawful killing of a reasonable person in being under the Queen’s (or King’s) Peace with malice aforethought. Malice aforethought means intention to kill or intention to cause grievous bodily harm (GBH). Note that you do not need to intend death; intending really serious injury is enough.

4. Non-Fatal Offences: The Ladder of Harm | 非致命伤害罪:伤害阶梯

Non-fatal offences against the person are structured as a ladder, increasing in seriousness based on the harm caused and the mens rea. The lowest is assault, which requires no physical contact – merely causing the victim to apprehend immediate unlawful personal violence. Battery follows, which is the actual infliction of unlawful force, however slight.

Grievous bodily harm (GBH) under s.20 is a more serious wounding or infliction of GBH with intent or recklessness; s.18 GBH with intent is the most serious, requiring proof of specific intent to cause GBH.

5. Property Offences: Theft, Robbery and Burglary | 财产犯罪:盗窃、抢劫与入室盗窃

Theft is defined in s.1 Theft Act 1968 as ‘dishonestly appropriating property belonging to another with the intention of permanently depriving the other of it’. The five key elements are appropriation, property, belonging to another, dishonesty, and intention to permanently deprive. All must be present simultaneously.

Robbery is theft aggravated by the use or threat of force immediately before or at the time of stealing, and in order to steal. If the force occurs after the theft is complete, it is not robbery but separate offences. Burglary under s.9 involves entering a building or part of a building as a trespasser with intent to commit theft, GBH, or unlawful damage, or actually committing such an offence.

6. Strict Liability: Crimes Without Mens Rea | 严格责任:无需犯罪意图的罪行

Strict liability offences are exceptions to the general rule that mens rea is required. For these regulatory or public welfare offences, the prosecution only needs to prove the actus reus – the prohibited act – and does not need to show any fault element such as intention, recklessness, or even negligence. Common examples include selling alcohol to minors, food safety breaches, or speeding.

7. Civil Law: The Tort of Negligence | 民事法:侵权之过失

Civil law deals with disputes between individuals or organisations, and the main tort you study is negligence. To establish a claim in negligence, a claimant must prove three things: a duty of care was owed by the defendant, that duty was breached, and the breach caused foreseeable damage which is not too remote.

The ‘neighbour principle’ from Donoghue v Stevenson is the foundation: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. Today, the Caparo three-part test is often used: foreseeability of harm, proximity between the parties, and whether it is fair, just and reasonable to impose a duty.

8. Defences in Criminal Law: Escaping Liability | 刑事辩护理由:免除责任

Defences can fully exonerate a defendant or reduce liability. Key complete defences include self-defence (reasonable force in defence of oneself or another), insanity (a defect of reason from disease of the mind causing the defendant not to know the nature or wrongness of the act), and automatism (an external factor causing involuntary loss of control).

Consent may be a defence to non-fatal offences where freely given and informed.

9. Court Hierarchy and Appeals | 法院等级与上诉

The criminal court hierarchy in Northern Ireland starts with the Magistrates’ Court for summary offences (less serious) and some triable either-way offences. Magistrates hear cases without a jury. Indictable offences (more serious) go to the Crown Court before a judge and jury. From there, appeals on points of law or sentence go to the Court of Appeal, and ultimately to the UK Supreme Court.

10. Legal Personnel: Key Roles in the System | 法律人员:体系中的关键角色

Judges in the Crown Court and above preside over trials, decide on points of law, sum up evidence for the jury, and pass sentence. They must be independent and impartial. Magistrates are trained volunteers who sit in the Magistrates’ Court, usually in panels of three, handling the vast majority of criminal cases.

Several Latin phrases reappear throughout your CCEA Law course. ‘Actus non facit reum nisi mens sit rea’ means ‘the act does not make a person guilty unless the mind is also guilty’. This underscores the necessity of coinciding actus reus and mens rea for most crimes.
