Also remember that consent is a defence to assault and battery but generally not to ABH or higher unless the case falls within a recognised exception such as surgery, sport, or body adornment (R v Brown).

Voluntary manslaughter arises when a defendant satisfies both actus reus and mens rea for murder but has a partial defence – diminished responsibility (s.2 Homicide Act 1957 as amended) or loss of control (s.54–55 Coroners and Justice Act 2009). The shift from the old common law defence of provocation to the statutory loss of control is a favourite exam topic. For loss of control, the three-stage test is: (1) the defendant lost self-control at the time of the killing; (2) the loss of control had a qualifying trigger – fear of serious violence and/or things said or done which constituted circumstances of an extremely grave character and caused a justifiable sense of being seriously wronged; (3) a person of the defendant’s age and sex with a normal degree of tolerance might have reacted similarly.

Unlawful act manslaughter requires: (1) an unlawful act; (2) the act must be dangerous in that a sober and reasonable person would recognise the risk of some harm (R v Church); (3) the act must cause death. Note the mens rea is the mens rea of the base unlawful act, not the killing. For gross negligence manslaughter, the breach of a duty of care must be so gross that it can be described as criminal (R v Adomako). The risk of death must also be reasonably foreseeable (R v Misra). A common error is to talk about ‘recklessness’ as part of the test – gross negligence is a separate concept.

The current test has been updated by Ivey v Genting Casinos in civil law, and many examiners now apply a partly objective standard, but for CCEA purposes the Ghosh test (was the action dishonest by the standards of ordinary reasonable people, and did the defendant realise it?) remains relevant. Robbery adds the immediate use or threat of force to theft. For burglary under s.9(1)(a) and (b), it is essential to identify whether the defendant enters as a trespasser with intent to commit one of the ulterior offences before the entry (s.9(1)(a)) or having entered as a trespasser actually commits or attempts to commit theft or GBH (s.9(1)(b)). A classic error is to forget that the entry must be as a trespasser and that the building does not have to be a dwelling; a caravan or shed can suffice.

Second, many write about ‘assault and battery’ as if they are the same offence – remember that an assault can be committed by words or silence alone (R v Ireland) while a battery requires physical contact. Third, in problem questions, students jump to conclusions without methodically applying the law to each element. Use IRAC (Issue, Rule, Application, Conclusion) or a similar structure, and always cite a relevant authority for each legal principle. Fourth, when discussing sentencing or the aims of punishment, link your answer to the specific case rather than using a ‘one size fits all’ approach.
