The central legal issue is: Is the supermarket liable in delict for negligence, and can Mary recover damages for her injury? To succeed, Mary (the pursuer) must prove that the supermarket (the defender) owed her a duty of care, breached that duty, and caused her loss.

In law, your neighbour is anyone who is so closely and directly affected by your act that you ought reasonably to have them in contemplation.

Regarding breach, a reasonable supermarket employee, having just mopped a floor, would place a warning sign to alert customers to the slip hazard. The employee forgot to do so. This omission clearly falls below the standard of the reasonable occupier. The presence of a visibly wet floor without any warning makes the breach straightforward to establish.

Causation requires both factual and legal causation. Factually, ‘but for’ the supermarket’s failure to warn, Mary would not have slipped and fallen. There is no break in the chain of causation. Legally, a wrist fracture is a reasonably foreseeable consequence of slipping on a wet floor, so the damage is not too remote.
