There was no lawful excuse. Therefore, the push constitutes the offence of battery. For unlawful act manslaughter, the base crime must be an offence requiring proof of intention or recklessness; battery is such a crime. Thus, the first element is satisfied.

The test for ‘dangerousness’ comes from R v Church [1966] 1 QB 59: ‘the unlawful act must be such as all sober and reasonable people would inevitably recognise must subject the other person to, at least, the risk of some harm resulting therefrom, albeit not serious harm.’ A push to the chest, even a firm one, does not typically risk fracture unless special circumstances exist. However, the test is objective, based on what a reasonable observer would know at the time. Alex did not know about Ben’s fragile ribs, but a reasonable person would not foresee broken bones from a push that did not cause a fall. Yet, ‘some harm’ is a low threshold. A reasonable person might foresee that a hard push could cause bruising or minor injury. Thus, it might be argued the act was dangerous in the required sense.

If Alex had not pushed Ben, Ben would not have suffered the rib fractures. Without the fractures, he would not have been taken to hospital. Without admission to hospital, the negligent infection would not have occurred. Even though the infection was the immediate medical cause, the push is a factual cause of death. The ‘but for’ test is easily satisfied here. As Lord Judge put it metaphorically, the accused’s act need not be the sole or even the major cause; it is sufficient that it ‘contributed significantly’ to the result.

In R v Cheshire [1991] 1 WLR 844, it was held that only in the most extraordinary and unusual case would medical negligence break the chain. Here, the infection arose from a failure to sterilise, a typical hospital risk. The push remained an operating cause.

Similarly, Alex cannot argue that a healthy person would not have suffered fractures. The rule applies to physical vulnerabilities as well as beliefs. Therefore, Ben’s condition does not provide a defence.

Factually, but for the push Ben would not have died (rule 3). Legally, the nurse’s negligence was not so overwhelming as to eclipse Alex’s act (rule 4). Finally, the thin skull rule means Alex takes Ben as he finds him (rule 5).’ Conclude with a reasoned opinion.
