1. Doctrine of Precedent: Ratio Decidendi vs Obiter Dicta |

One of the most examined areas in the English legal system is the doctrine of stare decisis. Students frequently lose marks by failing to distinguish between the binding ratio decidendi (the legal principle necessary for the decision) and persuasive obiter dicta (statements made ‘by the way’). In CCEA exam questions, you must not only define these terms but also identify which part of a judgment a later court is bound to follow.

A classic trap is to assume that everything said by a higher court binds lower courts. Only the ratio is binding, and even then only if the material facts of the later case are sufficiently similar. Furthermore, when the Court of Appeal gives multiple rationes, it is vital to identify the majority ratio. The Practice Statement 1966 allows the Supreme Court (formerly the House of Lords) to depart from its own previous decisions ‘when it appears right to do so’, but this power is used sparingly — another favourite exam nuance.

2. Statutory Interpretation: The Literal Rule vs The Purposive Approach |

CCEA candidates must be able to apply the three traditional rules — the literal rule, the golden rule and the mischief rule — and contrast them with the modern purposive approach. A high-frequency exam scenario asks you to interpret a fictitious statute using two different approaches and discuss which yields a fairer result. The common mistake is to apply the literal rule without recognising that it can lead to an absurdity, and then failing to explain how the golden rule (narrow or wide) would correct it.

The purposive approach, heavily influenced by EU law and now embedded in domestic interpretation via cases like Pepper v Hart, directs courts to look at the overall objective of the Act. Students should remember that Hansard may be consulted only in limited circumstances. In exam essays, avoid merely describing the rules; you must show their practical effect by referencing key cases — Whitely v Chappell (literal rule absurdity), R v Allen (golden rule) and Smith v Hughes (mischief rule) are indispensable.

3. The Hierarchy of Courts and Appeal Routes |

Questions on the civil and criminal court structure appear regularly on CCEA Unit 1. A common pitfall is mixing up the routes of appeal: for instance, forgetting that appeals from the Magistrates’ Court go to the Crown Court (if against conviction/sentence) or to the High Court (by way of case stated on a point of law). Similarly, in civil cases, students often misstate the leapfrog appeal procedure from the High Court to the Supreme Court under the Administration of Justice Act 1969.

The following table summarises the key civil appeal routes that examiners expect you to know without hesitation.

Court of first instance | 初审法院 Normal appeal route | 常规上诉路径 Further appeal | 进一步上诉
Magistrates’ Court (civil) High Court (Family Division) Court of Appeal (Civil Division) → Supreme Court
County Court High Court or Court of Appeal (depending on the type of order) Supreme Court
High Court Court of Appeal (Civil Division) Supreme Court (leapfrog possible under AJA 1969)

In addition, always mention the requirement for leave to appeal in most instances. Failure to state that permission is needed is a mark-losing oversight.

4. Duty of Care in Negligence: The Caparo Test | 过失侵权中的注意义务:Caparo 三要素检验

The Caparo three-stage test is arguably the most examined principle in CCEA tort law. Students must articulate the requirements of (1) reasonable foreseeability of harm, (2) sufficient proximity between claimant and defendant, and (3) that it is fair, just and reasonable to impose a duty. The critical error is treating Caparo as a rigid checklist. The courts adopt an incremental approach, and in problem questions you should acknowledge that established duty situations (e.g., driver to road user, manufacturer to consumer) typically apply without a full Caparo analysis.

Another common pitfall is confusing Donoghue v Stevenson’s neighbour principle with the Caparo test. While the neighbour principle established the foundation, modern law requires the three-stage refinement. In a novel duty situation, apply Caparo step by step, always citing Robinson v Chief Constable of West Yorkshire Police to show that where there is an established duty, courts do not re-run Caparo.

5. Breach of Duty: The Reasonable Person Standard |

Once a duty is established, the next step is to assess the standard of care and whether it has been breached. The law applies an objective test — the reasonable person. Yet CCEA examiners regularly see students apply this too simplistically. The standard may be adjusted for certain defendants: learners are judged against the reasonably competent qualified driver (Nettleship v Weston) and children against a reasonable child of the same age (Mullin v Richards). Professionals must meet the standard of a reasonably competent member of that profession (Bolam test), not the highest possible standard.

When determining breach, the court weighs risk factors: likelihood of harm, seriousness of potential harm, cost of taking precautions and social utility of the defendant’s conduct. Under the Compensation Act 2006, courts must also consider whether imposing a duty might prevent a desirable activity. A classic exam mistake is to discuss these factors only in isolation without linking them to the specific facts of the problem scenario.

6. Causation in Negligence: Factual and Legal Causation |

Even if breach is proved, the claimant must establish both factual causation (the ‘but for’ test) and legal causation (the damage must not be too remote). Many CCEA scripts lose marks on the subtlety of the multiple-cause scenario. Where there are several concurrent causes, the but for test is relaxed: if the defendant’s breach materially contributed to the damage, causation is established (Bonnington Castings v Wardlaw). The material increase in risk test from McGhee v National Coal Board and later refined in Fairchild v Glenhaven Funeral Services is frequently examined in industrial disease claims.

Legal causation requires that the damage be of a type that was reasonably foreseeable (The Wagon Mound). But you must also handle the thin skull rule: take your victim as you find them. If a pre-existing condition makes the harm worse, the defendant is still liable for the full extent of the injury. The most common error in this area is mixing up factual and legal causation in an essay question, treating them as a single test.

7. Formation of Contract: Offer vs Invitation to Treat |

Distinguishing between an offer and an invitation to treat remains a staple of CCEA contract law questions. An offer is a definite promise to be bound on stated terms, whereas an invitation to treat is merely an invitation to commence negotiations. In exams, students commonly mislabel advertisements and displays of goods. The general rule from Fisher v Bell and Pharmaceutical Society v Boots is that a display of goods is an invitation to treat; the customer makes an offer at the till, which the shop may accept.

However, there are exceptions that regularly form the basis of problem questions: a unilateral offer made to the world at large, such as in Carlill v Carbolic Smoke Ball Co., can be accepted by performing the required act. Similarly, an auction is generally an invitation to treat, with each bid constituting an offer. The table below provides a quick reference for high-frequency classification questions.

Goods on display in a shop Invitation to treat Pharmaceutical Society v Boots
Advertisement in a newspaper (bilateral context) Generally invitation to treat Partridge v Crittenden
Unilateral advertisement with clear promise Offer Carlill v Carbolic Smoke Ball Co.
Auction sale Invitation to treat (bid is offer) Payne v Cave; s.57(2) Sale of Goods Act 1979

8. Consideration: Rules and Exceptions |

In CCEA contract law, consideration is defined as something of value given by both parties, and the rules governing it are fertile ground for tricky multiple-choice and essay questions. The most tested rules include: consideration must be sufficient but need not be adequate; past consideration is not good consideration (Re McArdle); and performance of an existing public duty or an existing contractual duty owed to the promisor generally does not amount to valid consideration (Collins v Godefroy; Stilk v Myrick).

However, examiners love the exceptions. Performance of an existing contractual duty can amount to good consideration if it confers a practical benefit on the promisor (Williams v Roffey Bros). Another high-frequency point is the equitable doctrine of promissory estoppel, which can allow a promise to be enforced despite the lack of consideration, provided there is a pre-existing legal relationship, a clear and unequivocal promise and reliance. Remember the shield vs sword limitation from Combe v Combe — promissory estoppel can only be used as a defence, not to create a new cause of action.

9. Contractual Terms: Conditions, Warranties and Innominate Terms |

The classification of terms is an area where CCEA students frequently confuse the remedial consequences. A condition is a major term, breach of which entitles the innocent party to terminate the contract and claim damages. A warranty is a minor term, breach of which only allows damages. The modern innominate term approach, established in Hong Kong Fir Shipping Co v Kawasaki Kisen Kaisha, looks at the effect of the breach rather than the label — if the breach deprives the innocent party of substantially the whole benefit of the contract, it is treated as a condition; otherwise, it is a warranty.

Additionally, statutes may imply terms into contracts, such as the Consumer Rights Act 2015, which implies that goods must be of satisfactory quality, fit for purpose and as described. A common exam error is to discuss common law implied terms but fail to cite the relevant statutory provision when a consumer contract is involved.

10. Remedies: Damages and Equitable Remedies |

Once liability is established, the question of remedies invites candidates to demonstrate precise knowledge. The primary common law remedy is damages, designed to place the claimant in the position they would have been in had the contract been performed or had the tort not occurred. Students often overlook the difference between expectation interest (contract) and reliance interest, or the rule against double recovery.

In tort, the principle of restitutio in integrum aims to restore the claimant as nearly as possible to their pre-tort position. Special damages (quantifiable losses) and general damages (non-quantifiable, e.g., pain and suffering) must be clearly distinguished. In contract, equitable remedies such as specific performance and injunctions are available only where damages are inadequate. A typical CCEA mistake is to recommend specific performance for personal service contracts — such orders are refused on grounds of public policy.

Finally, always address the duty to mitigate loss. A claimant cannot recover for losses they could have reasonably avoided. Forgetting to mention mitigation in an essay about remedies is a simple but costly omission.
