The English legal system is a common law system, meaning that law develops through decisions made by judges in courts as well as through Acts of Parliament. Legal personnel include barristers, who have rights of audience in all courts and specialise in advocacy, and solicitors, who usually have direct client contact and may also obtain advocacy qualifications. Judges are appointed from experienced barristers or solicitors. The judiciary is independent and impartial, a cornerstone of the rule of law.

Later, the course builds upon these base offences with assault occasioning actual bodily harm (ABH) under s47 Offences Against the Person Act 1861, malicious wounding or inflicting grievous bodily harm (GBH) under s20, and wounding or causing GBH with intent under s18.

The modern test for duty of care was laid down in Caparo Industries plc v Dickman: foreseeability of damage, proximity between the parties, and whether it is fair, just and reasonable to impose a duty.
