Murder is the unlawful killing of a reasonable creature in being under the Queen’s Peace with malice aforethought, express or implied. The actus reus can be broken into three elements: (1) an act or omission (where a duty exists), (2) causing death, (3) of a human being (a ‘reasonable creature in being’ – a person who has been fully expelled from the womb and has an independent existence, R v Poulton; AG’s Ref (No 3 of 1994)).

10. Loss of Control – The Three‑Stage Test | 失控抗辩——三阶段测试
Loss of control is the other major partial defence to murder, codified in ss.54-55 Coroners and Justice Act 2009. It replaces the old provocation defence. Its three components act as a sequential filter:

Stage 3: A person of the defendant’s sex and age, with a normal degree of tolerance and self‑restraint, in the same circumstances, might have reacted in the same or similar way. This is a normative, objective test.

Robbery is simply theft aggravated by the use or threat of force. The statutory formula under s.8 has two essential elements: (1) the defendant must commit theft (the full s.1 definition must be satisfied); and (2) immediately before or at the time of the theft, the defendant must use force on any person, or put or seek to put any person in fear of being then and there subjected to force.

A conviction for theft is a precondition for robbery; if theft fails, robbery fails, but the defendant may still be guilty of assault offences.
