1. Understanding the IRAC Method | 理解IRAC方法

IRAC stands for Issue, Rule, Application and Conclusion. It is the most widely taught legal reasoning framework because it mirrors the way judges and lawyers structure their arguments. In a CCEA problem question, you should first pinpoint the legal issue embedded in the facts. Next, state the relevant rule — including statute sections and leading case principles — accurately. Then apply that rule to the specific facts in a detailed, point-by-point manner. Finally, deliver a clear conclusion that answers the question posed. Some variations like IRAC+C add a separate ‘conclusion’ at the end, but the core remains the same: a disciplined, logical flow that prevents you from jumping to unsupported answers.

2. Spotting the Legal Issues |

The first and most critical step is issue spotting. Read the scenario carefully, underlining all facts that trigger potential legal arguments. Ask yourself: what area of law is involved? In negligence, for example, you would look for a duty of care, a breach, causation and damage. In criminal law, identify the actus reus and mens rea elements. A single scenario often hides more than one issue — perhaps a claimant may have contributed to their own injury, raising the defence of contributory negligence. List every issue before you start writing; this ensures nothing is overlooked. Use the ‘who, what, when, where’ approach: who is suing whom? What harm occurred? When and where did the relevant events take place?

3. Stating the Relevant Legal Rules |

After identifying the issues, you must articulate the legal principles that govern them. For CCEA Law, precision matters: mention the case name (e.g. Donoghue v Stevenson for duty of care), the year if relevant, and the key ratio decidendi. If a statute applies, provide the section number — for instance, section 2(1) of the Occupiers’ Liability Act (Northern Ireland) 1957. Do not simply paraphrase; use the exact legal terminology from your syllabus. This shows the examiner you have substantive knowledge. When multiple rules intersect, separate them clearly. A good technique is to write a short rule statement for each issue, like: ‘Under the ‘neighbour principle’ established in Donoghue, a manufacturer owes a duty of care to the ultimate consumer.’

4. Applying the Law to the Facts |

Application is where most marks are won or lost. Merely repeating the rule without linking it to the given facts yields a generic answer. Instead, use ‘bridge phrases’ such as ‘Here, the facts show that…’ or ‘Applying this to the present scenario, we see that…’. Take each element of the rule and compare it with a concrete detail from the scenario. For instance, if the rule requires a ‘reasonably foreseeable risk’, point to the wet floor sign that was missing, the spilled liquid that had been there for hours, or the previous complaints. This demonstrates analytical thinking. If the facts are ambiguous, acknowledge it: ‘It is arguable that…’ and then explore both outcomes, but ultimately favour the stronger interpretation.

5. Reaching a Reasoned Conclusion |

A conclusion should be more than ‘liable’ or ‘not liable’. It must flow naturally from your application and address the precise question asked. If the exam asks ‘Advise X on her legal position’, your conclusion should summarise that position — for example, ‘Therefore, X is likely to succeed in a claim for negligence, but her damages may be reduced by 25% for contributory negligence.’ Where appropriate, mention remedies: compensation, injunction, or specific performance. Avoid introducing new arguments in the conclusion. If your analysis leads to an uncertain outcome, be honest: ‘The outcome would ultimately depend on how the court weighs the evidence of breach.’ That shows maturity of reasoning and still nets marks.

6. Tackling Multi-Issue Scenarios |

CCEA problem questions frequently bundle several claims or defendants into one story. A structured approach is vital: tackle each party’s potential liability separately, using subheadings or clear paragraph breaks. Begin with the primary claim — say, the injured customer suing a supermarket — and complete a full IRAC cycle. Then move to a secondary claim, such as the supermarket seeking contribution from a cleaning contractor. Finally, address any defences. This prevents confusion and ensures each issue receives adequate depth. Always check whether the same facts influence multiple issues; cross-referencing is acceptable but do not duplicate analysis unnecessarily. A brief roadmap in your introduction, such as ‘This response will first consider A’s claim against B, then B’s potential defence, and finally any third-party liability,’ signals strong organisation.

7. Common Pitfalls and How to Avoid Them | 常见陷阱及避免方法

Even well-prepared students can fall into predictable traps during case analysis. Recognising these pitfalls in advance is half the battle. The table below lists frequent mistakes and practical strategies to overcome them.

Pitfall 陷阱 How to Avoid 避免方法
Skipping the application stage and just restating rules. Force yourself to write at least three sentences linking a fact to a legal element for every rule.
Identifying too many issues without depth. Prioritise the core legal dispute; mention minor issues briefly as potential counter-arguments.
Hiding conclusions — never actually stating who wins. End each IRAC cycle with a clear sentence beginning ‘Thus, …’ or ‘Consequently, …’.
Forgetting to cite authority for rules. Create a checklist of key cases per topic and mentally tick them as you write.
Ignoring time management and over-writing one part. Allocate minutes proportionally to marks; practise with a clock.

8. Step-by-Step Worked Example: Negligence |

Let us walk through a complete negligence scenario using the IRAC approach. Read the facts below, then follow the four-stage analysis.

Scenario: ‘Claire, a customer at a busy coffee shop, steps on a patch of spilled hot chocolate that had been on the floor for 25 minutes. The staff were chatting behind the counter and had not placed any warning sign. Claire slips, breaks her wrist, and incurs significant medical expenses. The manager claims they conduct floor checks every 30 minutes.’

9. IRAC Application: Claire v Coffee Shop | IRAC

Issue: The principal issue is whether the coffee shop owed a duty of care to Claire as a lawful visitor, whether it breached that duty, and if the breach caused her injury. A sub-issue is whether the shop’s inspection system might provide a defence.

Rule: Under the Occupiers’ Liability Act (Northern Ireland) 1957, an occupier owes a ‘common duty of care’ to all lawful visitors to see that they are reasonably safe in using the premises (s.2(2)). The standard is that of a reasonable occupier, considering all the circumstances. Case law such as Ward v Tesco Stores (1976) establishes that an occupier must take reasonable steps to keep the premises free from hazards that could cause injury. The breach must be proved on the balance of probabilities, and causation requires both factual causation (‘but for’ test) and legal causation (remoteness of damage, as in The Wagon Mound). The defence of contributory negligence under s.1 of the Law Reform (Miscellaneous Provisions) Act (Northern Ireland) 1948 can reduce damages if the visitor failed to take reasonable care for their own safety.

Application: Applying the law here, Claire is clearly a lawful visitor. The coffee shop is therefore under a duty to keep the floor reasonably safe. A spilled hot chocolate left for 25 minutes constitutes a hazard that a reasonable occupier should have identified and removed, especially in a busy environment. The fact that staff were chatting and no warning sign was displayed strongly suggests a breach of the common duty of care. Under Ward, the shop should have had a system for promptly spotting and dealing with spillages. The manager’s claim of a 30-minute inspection cycle may be unreasonable in light of the busy nature of the premises; a court is likely to find that the interval was too long and that the staff failed to act. Causation is satisfied on a ‘but for’ basis: but for the spill and lack of warning, Claire would not have slipped. Her wrist fracture is a reasonably foreseeable type of injury resulting from a slip. As for contributory negligence, the question is whether Claire should have seen the spill. There is no indication she was distracted by a phone or was running; thus, it is unlikely the court would find her contributorily negligent. If any blame were placed, it would be minimal.

Conclusion: The coffee shop is very likely to be held fully liable for Claire’s injury. She can expect to recover damages covering her medical expenses and any loss of earnings, with no reduction for contributory negligence. The shop’s inspection policy is likely to be deemed inadequate.

10. Further Practice Drills |

Try applying the same IRAC structure to the following short scenarios. For each, identify the issues, note the applicable rules, and sketch a brief application.

Drill A: ‘Tom, a 16-year-old, sneaks into an abandoned factory through a broken fence with a ‘Danger – Keep Out’ sign. He falls through a rotting floor and breaks his leg.’ (Consider the Occupiers’ Liability Act 1957 and the duty owed to trespassers under the Occupiers’ Liability Act (Northern Ireland) 1984.)

Drill B: ‘Aisha buys a reusable water bottle that leaks boiling water when the lid pops open. The manufacturer had tested the lid 500 times but did not account for repeated daily use over a year.’ (Examine liability under the Consumer Protection Act 1987 and negligence.)

For each drill, produce a full IRAC response, then compare with a study partner or mark scheme. Focus on precise rule statements and tight linkage in the application.

11. Exam Techniques Specific to CCEA Law | CCEA

CCEA examiners expect answers that are legible, well-structured, and tightly reasoned. Begin each problem response with a short introductory sentence identifying the parties and the area of law. Use paragraphs liberally; a new paragraph for each issue or each shift in argument makes your reasoning easier to follow. Wherever possible, cite authority — a case name in brackets is sufficient if you are short on time. Avoid long quotations; paraphrase the ratio. Time management: allocate roughly 1.5 minutes per mark. For a 25-mark question, spend about 5 minutes planning, 30 minutes writing, and 2-3 minutes proofreading for legal accuracy and clarity. Finally, remember that CCEA questions often contain Northern Ireland-specific legislation; using the correct Act title and section demonstrates regional awareness and can distinguish your answer.

12. Building Confidence Through Repetition |

Case analysis is a skill refined through consistent practice. Set aside 30 minutes twice a week to attempt a full past-paper problem question under timed conditions. After writing, critically evaluate your own work using a highlighter: mark every rule statement in one colour, every application sentence in another. You will quickly see if your balance between rule and application is off. Discuss your answers with peers; explaining your reasoning aloud helps solidify the IRAC rhythm. Over time, what once felt like a mechanical exercise will become an intuitive process, allowing you to tackle even the most daunting CCEA scenario with composure and precision.
