The mnemonic ‘HORF’ (Honest belief, Reasonable Force) recalls the two-stage test from Palmer. Intoxication is divided into voluntary and involuntary. Voluntary intoxication is a defence only to specific intent crimes (e.g. s.18 GBH), not basic intent crimes (e.g. s.20 GBH). Use the maxim ‘voluntarily drunk? Specific intent sunk.’ For involuntary intoxication, it may provide a defence to any crime if D lacked the required mens rea. Consent is a defence to non-fatal offences where the harm is not serious, but cannot be used for murder or s.18 GBH. The key case is Brown (sadomasochism) – not in the public interest.

Causation links the defendant’s breach to the claimant’s damage. Factual causation uses the ‘but for’ test (Barnett v Chelsea Hospital). Intervening acts (novus actus interveniens) may break causation if they are free, deliberate and informed acts of a third party or the claimant, or a truly exceptional natural event. In criminal law, causation in homicide requires that the defendant’s act was an operating and substantial cause of death (Smith; Cheshire). The ‘operating and substantial’ test helps distinguish from minimal causes.

Special rules apply to children (less careful), tradesmen (can be expected to guard against risks of their trade), and warnings. The 1984 Act extends a limited duty to trespassers if three conditions are met: occupier aware of danger, knows a trespasser might come into vicinity, and it was reasonable to offer protection. Memorise ‘1957 for visitors, 1984 for trespassers’ – the numbers remind you 57 sounds like ‘live’ (visitors are welcome), 84 like ‘force’ (trespassers may force entry).

Acceptance must mirror the offer, be communicated (except postal rule), and be in response to the offer. For the postal rule (Adams v Lindsell), acceptance is effective when posted, not when received, provided it is reasonable to use post. Use ‘mirror, post, response’ to list requirements: mirror image, postal rule exception, response to offer.

Intention to create legal relations distinguishes legally binding agreements from social or domestic arrangements. In commercial agreements, there is a strong presumption of intent, rebuttable by express wording like ‘honour clause’. For social/domestic, there is a presumption against intent (Balfour v Balfour). Link intention with ‘legal fences’ – if you build a fence (contract), you intend to be bound.
