1. Actus Reus | 犯罪行为

Actus reus refers to the external, physical element of a crime. It includes all the conduct of the defendant that is prohibited by law, such as an act, a failure to act (omission) under a duty, or a state of affairs. The actus reus must be voluntary – if the defendant has no control over their body, like being pushed into someone, the actus reus is not satisfied. A classic mnemonic is ‘Actus = Action’. Remember that the actus reus is what the defendant actually did (or failed to do).

A helpful mnemonic is ‘Mens = Mind’, and it links to the phrase mens rea – think of your mental intention (mens) being real (rea). For recklessness, ask whether the defendant saw a risk and took it anyway.

Regulatory crimes, like selling alcohol to minors or food safety violations, are often strict liability. A mnemonic is ‘Strict = No Mind’ – the law does not care about the defendant’s state of mind. This is fair because the offences are usually of a regulatory nature and aim to protect public safety, where due diligence would still make them guilty but a defence of due diligence may sometimes be available.

The mnemonic ‘GBH = Murder’ helps remind that intent to cause really serious harm is sufficient for murder, even if death was not intended. Remember, murder carries a mandatory life sentence in English law.

For loss of control, the defendant must have lost self-control due to a qualifying trigger and a person of the defendant’s age and sex, with a normal degree of tolerance, would have reacted similarly. For diminished responsibility, the defendant must show an abnormality of mental functioning arising from a recognised medical condition, which substantially impaired their ability to understand their actions, form rational judgment, or control themselves. Mnemonic: ‘VD’ – Voluntary comes from Diminished and loss of control (Defences).

Unlawful act manslaughter requires the defendant to intentionally commit an unlawful act that is objectively dangerous and foreseeable as likely to cause some harm, and that act caused death. Gross negligence manslaughter requires a duty of care, breach of that duty, a serious and obvious risk of death, and the breach was so grossly negligent as to constitute a crime. The mnemonic ‘Involuntary = No Intention to Kill’ reminds you that the defendant did not intend death or GBH, yet is still liable.

8. Theft | 盗窃

Theft is defined in s.1 Theft Act 1968 as the dishonest appropriation of property belonging to another with the intention to permanently deprive. The actus reus is the appropriation of property (assuming any of the rights of the owner) and the property must belong to another. Mens rea has two elements: dishonesty (judged by the ordinary standards of reasonable people, now under the Ivey test) and intention to permanently deprive (even borrowing for a period equivalent to an outright taking may suffice). A classic mnemonic: ‘DISH APID’ – Dishonest, Property, Appropriation, Intention, Deprive. This covers the five key elements.

Insanity and automatism are general defences that negate the actus reus or mens rea. Insanity is based on the M’Naghten Rules: the defendant must prove that at the time of the act they were suffering from a defect of reason caused by a disease of the mind so that they did not know the nature and quality of the act, or if they did, they did not know it was wrong. Automatism involves an act done by the body without conscious control, like during a reflex action or while sleepwalking. The key distinction is internal vs external cause: if the automatism stems from an internal illness (like epilepsy), it is classified as insanity; if from an external factor (like a blow to the head), it is non-insane automatism. Mnemonic: ‘Inside = Insanity, External = Excuse’ (non-insane automatism).

The defendant must honestly believe that the use of force was necessary, and the amount of force used must be objectively reasonable in the circumstances as the defendant perceived them to be. The jury considers whether the force was proportionate. A householder case allows greater latitude. The mnemonic ‘RAN’ – Reasonable, Necessary, Proportionate – encapsulates the three tests. Remember, the defence fails if the force was excessive, but the defendant’s intoxicated mistake cannot be relied upon to claim self-defence.
