Case Analysis Practical Drill |

📚 Case Analysis Practical Drill |

Mastering case analysis is the backbone of success in CAIE AS Level Law. This practical drill equips you with the skills to break down judicial decisions, extract ratio decidendi, and apply precedent to novel scenarios with precision. Whether you are tackling a source-based question or an essay on judicial reasoning, the techniques here will sharpen your analytical edge.

1. Understanding the Role of Case Law |

Case law, also known as common law, is the body of law developed by judges through decisions in individual cases. In the English legal system, which forms the basis of CAIE Law, judicial precedent is a primary source of law. The doctrine of stare decisis (stand by things decided) obliges courts to follow previous rulings when the material facts are similar. This creates certainty, consistency, and predictability in the law.

Every law student must appreciate that not everything said in a judgment binds future courts. The binding part is the ratio decidendi (the legal reasoning essential to the decision), while obiter dicta (remarks made ‘by the way’) may later be persuasive but are not binding. Case analysis therefore begins with distinguishing these two elements.

2. Decoding a Case Citation |

A standard case citation, such as Donoghue v Stevenson [1932] AC 562, conveys essential information instantly. The names represent the parties (appellant and respondent). The year in square brackets shows the year of the report, often also the year of judgment when there is no volume number. ‘AC’ denotes the Appeal Cases law report series, and ‘562’ is the first page of the report. In the CAIE examination, you are not expected to memorise citations, but recognising them helps you navigate source materials and demonstrate deeper contextual awareness.

You may also encounter neutral citations like [2005] UKHL 56, introduced for online access. These are not bound to a particular law report. For case analysis, always note the court hierarchy level, because the binding force of a precedent depends heavily on whether it was decided by the Supreme Court (formerly House of Lords), the Court of Appeal, or a lower court.

3. Identifying Ratio Decidendi and Obiter Dicta |

The ratio decidendi is the legal principle upon which the decision is based. It is the indispensable reasoning that answers the legal question posed by the material facts. Finding the ratio is a skill: you must ask, ‘What was the rule of law that the judge treated as necessary to reach this outcome?’ If the same outcome would have been reached without that statement, it is likely obiter dictum.

For instance, in Central London Property Trust v High Trees House [1947] KB 130, Denning J established promissory estoppel as a defence. The ratio was that a party cannot enforce strict legal rights if they have led the other party to believe those rights would not be enforced, and that party has acted on that belief. Denning’s broader comments about the fusion of common law and equity were strictly obiter, yet have proven highly persuasive in later cases.

4. Reading a Case: Facts and Legal Issues |

Effective case analysis always starts with the facts. Translate the story into a concise timeline of material events. Then identify the legal issue—the precise question the court is being asked to resolve. In an exam, you might receive an extract of a judgment. Begin by underlining the parties, the dispute, and the specific claim. Ask: what area of law does this concern (tort, contract, criminal)? What remedy is sought?

Distinguish between questions of fact and questions of law. Questions of fact relate to what actually happened; questions of law concern the legal consequences or the applicable standard. An appellate court typically deals with questions of law, and it is this legal analysis that creates binding precedent. When you read a case, isolate the appeal ground, as that often encapsulates the legal question.

5. The Hierarchy of Courts and Binding Precedent |

Binding precedent only works vertically within the court hierarchy. The Supreme Court (formerly House of Lords) binds all courts below it, including the Court of Appeal. The Court of Appeal is bound by the Supreme Court and, since Young v Bristol Aeroplane Co Ltd [1944] KB 718, is generally bound by its own previous decisions with three exceptions: conflicting decisions, a decision made per incuriam (in ignorance of a relevant statute or binding precedent), and a decision overruled by the Supreme Court. The High Court binds lower courts but is itself bound by the Court of Appeal and the Supreme Court.

A handy table for revision:

Court Bound by Binds
Supreme Court Not bound by own decisions (1966 Practice Statement) All lower courts
Court of Appeal (Civil) Supreme Court, own decisions (with exceptions in Young) High Court, County Court, etc.
High Court Supreme Court, Court of Appeal Inferior courts and tribunals

6. Distinguishing and Overruling Precedent |

When a court is confronted with a binding precedent that would lead to an unjust result, it may avoid it by distinguishing. This means finding a material difference in the facts of the current case compared to the precedent case, so that the rule established in the earlier case does not apply. Distinguishing is a legitimate technique that does not challenge the authority of the precedent; it simply declares it irrelevant to the present facts.

Overruling occurs when a higher court decides that a precedent set by a lower court (or, in limited circumstances, by itself) was wrongly decided. The later court declares the earlier legal rule to be incorrect and substitutes a new rule. Overruling is retrospective in effect, meaning the new rule applies to the facts of the current case and, in principle, to all future cases. A famous example is Pepper v Hart [1993] AC 593, where the House of Lords overruled its previous ban on using parliamentary debates (Hansard) to interpret statutes.

7. Practical Drill: Analysing Donoghue v Stevenson | 实战练习:分析 Donoghue v Stevenson 案

Let us apply the analysis framework to a landmark case. Donoghue v Stevenson [1932] AC 562 is essential for the tort of negligence. Material facts: Mrs Donoghue consumed ginger beer from an opaque bottle in a cafe. The bottle contained a decomposed snail. She suffered shock and gastroenteritis. She sued the manufacturer, Stevenson, although there was no contract between them.

The legal issue: does a manufacturer owe a duty of care to the ultimate consumer, absent any contract? The House of Lords held that such a duty exists. The ratio, famously stated by Lord Atkin, is the ‘neighbour principle’: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. A neighbour is anyone who is closely and directly affected by your act. This formed the foundation of modern negligence and the duty of care. Obiter dicta in the case include discussions on liability for defective products in general, which later influenced the law of product liability.

8. Practical Drill: Rylands v Fletcher and Strict Liability | 实战练习:Rylands v Fletcher 与严格责任

Another case requiring precise analysis is Rylands v Fletcher (1868) LR 3 HL 330. The defendant mill owners employed independent contractors to build a reservoir on their land. The contractors failed to seal disused mine shafts, and water flooded into the claimant’s coal mine. The House of Lords established a rule of strict liability: a person who, for his own purposes, brings onto his land and collects and keeps there anything likely to do mischief if it escapes, must keep it at his peril; if it escapes, he is prima facie answerable for all the damage which is the natural consequence of its escape.

When analysing this case, note that the rule has been refined over time. The requirement of ‘non-natural use of land’ was later added, and defences such as act of a stranger or consent of the claimant have developed. In a CAIE answer, demonstrating knowledge of how Rylands v Fletcher has been distinguished or modified in later decisions, such as Cambridge Water Co v Eastern Counties Leather [1994] 2 AC 264 (foreseeability of damage now required), shows depth of understanding.

9. Applying Precedent to a Novel Scenario |

Exam questions often present a hypothetical scenario and ask whether a particular case applies. Begin by comparing the material facts of the precedent case with the new facts. Are the parties in a similar relationship? Is the type of harm analogous? If the facts are materially identical, the precedent is binding and should be followed. If there are significant differences, you may argue for distinguishing. Construct a coherent argument: state the principle from the precedent, then explain how it governs—or is avoided in—the new scenario.

For example, suppose a chemist sells a sealed bottle of hair dye containing a harmful chemical that burns a customer. The manufacturer is unknown. You could apply Donoghue v Stevenson by analogy: a manufactured product in a sealed container reaches the consumer in the same condition; the consumer is a neighbour; the harm is personal injury. A clever answer might also note that the retailer might be liable under consumer protection legislation, but the principles of negligence serve as a solid foundation.

10. Exam Technique: Structuring Your Case Analysis Answer |

A model answer for a ‘with reference to case law’ or source-based question should follow a clear structure: (1) Identify the legal area and the specific issue. (2) State the relevant precedent case, its facts, and its ratio decidendi. (3) Apply the ratio to the scenario, comparing facts systematically. (4) Discuss any possible distinguishing features or alternative lines of argument. (5) Conclude with the likely outcome, based on your application.

Use precise terminology: ‘bind’, ‘distinguish’, ‘overrule’, ‘ratio’, ‘obiter’. Avoid narrating the entire case history; the examiner already knows the case. Instead, extract the legal principle and demonstrate how it operates. A balanced answer often acknowledges that while the precedent appears binding, a court might find a way to distinguish if the outcome would be unjust. This shows sophistication and critical thinking.

11. Common Mistakes and How to Avoid Them | 常见错误及如何避免

A frequent error is confusing the ratio with the outcome of the case. The ratio is not ‘the claimant won’; it is the legal reason why the claimant won. Another mistake is treating dissenting judgments as binding. A dissenting judgment is obiter at best, though it can be cited in later cases as persuasive authority. Many students also fail to mention the court hierarchy when discussing whether a decision is binding; always specify which court decided the precedent and which court is hearing the current case.

Additionally, avoid the trap of simply listing case names without analysis. A string of citations like ‘Caparo v Dickman, Anns v Merton, Murphy v Brentwood‘ impresses no one unless you explain how they refined the test for duty of care. Finally, do not ignore the facts of your scenario problem; apply, apply, apply. The examiner wants to see you use the law to solve a concrete problem, not regurgitate doctrines.

12. Consolidation and Further Resources |

To become proficient in case analysis, build a personal case bank. For each major case, create a card summarising: case name and citation, material facts, legal issue, ratio, significant obiter, and whether it was later distinguished or overruled. Practise with past paper source questions under timed conditions, and then compare your answer with the mark scheme to refine your technique. Remember that the CAIE assessment objectives reward the ability to apply legal principles to given scenarios, not rote learning.

The syllabus (2024-2026) emphasises the English legal system and sources of law, including the doctrine of precedent. Use your textbook, the official CAIE scheme of work, and trusted online platforms to supplement your practice. By approaching case analysis as a structured drill, you will not only excel in examinations but also develop the foundational skill of thinking like a lawyer.
