For instance, the Supreme Court binds all courts below but is not bound by its own previous decisions, although it normally follows them using the 1966 Practice Statement.

Negligence arises when the claimant suffers damage caused by the defendant’s breach of a duty of care. The classic test for duty of care is the ‘neighbour principle’ from Donoghue v Stevenson. The modern approach (Caparo v Dickman) requires three elements: (a) foreseeability of damage, (b) a relationship of proximity, and (c) it must be fair, just, and reasonable to impose a duty. Breach occurs if the defendant failed to act as a reasonable person would have done, considering factors such as likelihood of harm, seriousness of risk, cost of prevention, and any special characteristics (e.g., children, learners).

Causation must be proved using the ‘but for’ test (Barnett v Chelsea Hospital) and the damage must not be too remote (the kind of damage would be foreseeable: The Wagon Mound). Defences include contributory negligence (splitting liability: Law Reform (Contributory Negligence) Act 1945) and consent (volenti non fit injuria). Occupiers’ liability to lawful visitors is governed by the Occupiers’ Liability Act 1957.

8. Criminal Law: General Principles | 刑法:一般原则

A crime generally requires an actus reus (guilty act) and mens rea (guilty mind), which must coincide in time. Actus reus can be an act, an omission (only when there is a duty to act, e.g., statutory duty, contract, relationship, assumed responsibility), or a state of affairs (e.g., Larsonneur). Mens rea takes various forms: intention (direct or oblique), recklessness (subjective: Cunningham, i.e., foreseeing a risk and taking it), or negligence (gross negligence in manslaughter). For strict liability offences, no mens rea is needed; the prosecution only needs to prove the actus reus.

Other principles include transferred malice (intended to harm X but harmed Y) and the requirement that the actus reus must be voluntary. 9. Criminal Law: Non-fatal Offences | 刑法:非致命犯罪

The main non-fatal offences against the person are assault, battery, assault occasioning actual bodily harm (ABH) under s.47 Offences Against the Person Act 1861, and the more serious grievous bodily harm (GBH) under s.20 and s.18. Assault is causing the victim to apprehend immediate unlawful force (no need for physical contact). Battery is the actual infliction of unlawful force. Both have a mens rea of intention or recklessness.

GBH under s.20 (malicious wounding/inflicting GBH) requires an unlawful act that causes a wound or really serious harm, with mens rea of intention or recklessness as to some harm. Under s.18 (wounding/causing GBH with intent), the prosecution must prove an intention to do really serious harm, carrying a maximum life sentence.

Contractual terms may be express (agreed orally or in writing) or implied (by statute, custom, or the courts). Representations are pre-contractual statements that do not form part of the contract, whereas terms are promises integral to the contract. The distinction between a condition (a major term, breach of which permits repudiation and damages) and a warranty (a minor term, breach only gives rise to damages) is crucial, though the innominate term approach (Hong Kong Fir Shipping) focuses on the effect of the breach.

Exemption clauses attempt to exclude or limit liability. They are controlled by common law rules (incorporation, construction, and the doctrine of fundamental breach) and by statutes: the Unfair Contract Terms Act 1977 and the Consumer Rights Act 2015. For consumers, terms must be fair; a clause limiting liability for death or personal injury is always void. When a breach occurs, remedies include damages (to put the claimant in the position as if the contract had been performed), specific performance, and injunction.

11. Tort: Occupiers’ Liability | 侵权法:占用人责任

The Occupiers’ Liability Act 1957 governs the duty owed by occupiers of premises to lawful visitors. An occupier is anyone who has sufficient control over the premises (Wheat v Lacon). Visitors are those with express or implied permission (including for purposes for which they were invited). A higher duty is owed to children (because they may be less careful) and to persons exercising a calling (e.g., window cleaners). The common duty of care is to take such care as is reasonable in all the circumstances to see that the visitor is reasonably safe.

The Occupiers’ Liability Act 1984 imposes a more limited duty to trespassers, requiring (a) awareness of danger, (b) knowledge that a trespasser may be in the vicinity, and (c) the risk is one against which the occupier should reasonably offer protection.

It reviews areas of law, consults widely, and issues reports with draft Bills. Parliament may then enact these proposals in whole or part. Examples include the Consumer Rights Act 2015 and the modernisation of the law on murder, though many recommendations remain unimplemented.

Reform is necessary because an outdated law can lead to injustice, inefficiency, and loss of public confidence. However, parliamentary time constraints and political sensitivities often slow the reform process.
