1. The Nature and Purpose of Law |

Law is a set of rules created by the state, enforceable through the courts, and binding on everyone within a jurisdiction. Unlike moral norms or customs, legal rules carry formal sanctions such as fines, imprisonment, or injunctions. The primary purposes of law are to maintain order, protect individual rights, resolve disputes, and promote social justice. Legal rules must be clear, predictable, and consistent to uphold the rule of law, ensuring that no one is above the law.

Distinguishing between criminal and civil law is fundamental. Criminal law deals with conduct deemed harmful to society, prosecutes offenders on behalf of the state, and seeks punishment. Civil law focuses on disputes between individuals or organisations, providing remedies such as compensation or specific performance. In both spheres, law must balance competing interests – the rights of victims versus those of defendants, or individual freedom versus collective security.

2. Sources of Law |

English law derives from several key sources. The most significant is statute law – Acts of Parliament, which are the supreme form of law under the principle of parliamentary sovereignty. Common law, developed through judicial decisions, creates binding precedents that shape the law in areas not covered by statutes. Retained EU law still applies in the UK, preserving many European regulations and principles that were part of domestic law before Brexit. Additionally, the Human Rights Act 1998 incorporated the European Convention on Human Rights into UK law, allowing individuals to enforce convention rights in domestic courts.

Delegated legislation, made by ministers or public bodies under authority granted by Parliament, is another important source. This includes statutory instruments, by-laws, and orders in council. While it allows quick and flexible updates to the law, it raises concerns about democratic oversight. Custom and works of authority (such as textbooks written by legal scholars) can still influence judicial reasoning, but their role is largely historical.

3. How Statute Law Is Made | 成文法的制定过程

A bill must pass through both Houses of Parliament and receive Royal Assent to become an Act. Most public bills are introduced by the government, first reading having no debate, second reading involving debate on principles, committee stage for detailed examination, report stage for further consideration, and third reading for a final vote. The same process occurs in the other House, generally the Lords, which acts as a revising chamber. If the Lords reject a bill, the Commons can ultimately override them under the Parliament Acts 1911 and 1949.

Different types of bill exist: public bills apply to the whole country, private members’ bills are introduced by individual MPs, and private bills affect only specific organisations or localities. The process ensures scrutiny, but critics argue that government majorities can rush legislation and that the Lords, as an unelected body, lacks democratic legitimacy. Recent reforms have altered the composition of the Lords, yet the legislative process remains a blend of efficiency and democratic accountability.

4. Judicial Precedent |

Judicial precedent operates within a strict court hierarchy. The ratio decidendi – the legal reasoning essential to the decision – binds lower courts in similar future cases. The Supreme Court (formerly House of Lords) stands at the apex, and its decisions bind all courts below, although since 1966 it can depart from its own precedents when necessary. The Court of Appeal is bound by Supreme Court decisions and generally by its own earlier decisions, subject to limited exceptions. High Court decisions bind lower courts but not other High Court judges.

When a judge avoids following a binding precedent, techniques such as distinguishing (finding material differences in the facts) or overruling (a higher court declaring the earlier decision wrong) are used. The system promotes certainty, consistency, and flexibility, but it can also be criticised for being overly rigid and slow to adapt. The sheer volume of case law also makes it difficult to discern the current state of the law without expert guidance.

5. Statutory Interpretation |

Courts must interpret the words of Acts when the meaning is unclear. The literal rule applies the ordinary dictionary meaning, even if the result seems absurd (see Whiteley v Chappell). The golden rule modifies the literal meaning to avoid an absurdity that Parliament could not have intended (R v Allen). The mischief rule looks at the problem Parliament sought to remedy and interprets the statute to suppress that mischief (Smith v Hughes). Additionally, the purposive approach, influenced by EU law, asks what purpose Parliament intended to achieve and interprets the law to give effect to that purpose.

Judges use internal aids (long title, preamble, headings) and external aids (dictionaries, Hansard, Law Commission reports) to guide interpretation. There are also presumptions, such as the presumption against altering the common law and the presumption that mens rea is required for criminal offences. Interpretation rules directly affect the outcome of cases and show the creative power of the judiciary, often blurring the line between interpretation and law-making.

6. Criminal Law: General Principles |

To establish criminal liability, the prosecution must usually prove actus reus (the guilty act) and mens rea (the guilty mind) beyond reasonable doubt. Actus reus can be a positive act, an omission where there is a duty to act, or a state of affairs. Mens rea includes intention (direct or oblique), recklessness (awareness of an unjustified risk), negligence, or dishonesty. Strict liability offences require only actus reus, with no need to prove mens rea – these are often regulatory crimes designed to protect public health and safety.

Causation links the defendant’s conduct to the prohibited result. Factual causation uses the ‘but for’ test, while legal causation requires that the defendant’s act was a substantial and operating cause of the harm. An intervening act (novus actus interveniens) may break the chain of causation, but only if it is sufficiently independent and unforeseeable. These principles ensure that defendants are only held liable for consequences fairly attributable to their wrongdoing.

7. Criminal Law: Key Offences and Defences |

Non-fatal offences against the person include assault (causing the victim to apprehend immediate unlawful violence), battery (actual physical contact), actual bodily harm (ABH, any hurt or injury calculated to interfere with health or comfort), and grievous bodily harm (GBH, really serious harm) or wounding. The distinction often hinges on the degree of harm and the defendant’s intention or recklessness. Theft, defined under the Theft Act 1968, is the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it.

Defences to criminal charges may be complete or partial. Self-defence allows reasonable force to protect oneself or another. Duress (threats of death or serious injury) and duress of circumstances offer a defence for all crimes except murder. Intoxication may negate mens rea for specific intent crimes if involuntary, but voluntary intoxication only sometimes succeeds. Insanity raises complex rules under the M’Naghten Rules. The defence of loss of control and diminished responsibility can reduce murder to voluntary manslaughter.

8. Civil Law: Tort and Contract |

The law of tort deals with civil wrongs, the most common being negligence. To succeed in negligence, a claimant must prove that the defendant owed them a duty of care, breached that duty, and caused foreseeable damage. The modern duty of care test stems from Caparo v Dickman, requiring foresight of harm, proximity, and that it is fair, just and reasonable to impose a duty. Breach is judged against the standard of the reasonable person, and causation is proved using the ‘but for’ test. Defences include contributory negligence and volenti non fit injuria (consent).

Contract law requires offer, acceptance, consideration, and intention to create legal relations. An offer must be distinguished from an invitation to treat; acceptance must mirror the offer. Consideration must be sufficient but need not be adequate. Breach of contract entitles the innocent party to remedies: damages (to put the claimant in the position they would have been in but for the breach), specific performance, or rescission. Contracts are fundamental to commercial and consumer transactions, and consumer protection legislation often supplements the common law.

9. The Court System and Appeals |

The court structure distinguishes between criminal and civil jurisdictions. Criminal cases start in the Magistrates’ Court for summary offences and either-way cases; either-way cases may be tried in the Crown Court if the defendant elects jury trial. Indictable-only offences must go to the Crown Court. Appeals from Magistrates go to the Crown Court or to the High Court by way of case stated on a point of law. From the Crown Court, appeals go to the Court of Appeal (Criminal Division) and then, with permission, to the Supreme Court.

Civil cases generally begin in the County Court for lower value claims, or the High Court for complex or high-value matters. There are three divisions of the High Court: Queen’s Bench, Chancery, and Family. Appeals from the County Court or High Court go to the Court of Appeal (Civil Division) and then to the Supreme Court. The Supreme Court is the final court of appeal for all UK civil cases and, for English and Welsh criminal cases. The system aims to provide accessible justice, though costs and delays remain challenges.

10. Legal Personnel and Juries |

Solicitors provide direct legal advice to clients, prepare cases, and may represent clients in lower courts. Barristers specialise in advocacy and can represent clients in all courts, often instructed by solicitors. Judges preside over court proceedings, decide legal issues, and pass sentence, selected from experienced lawyers. Magistrates are lay volunteers who hear the vast majority of criminal cases in the Magistrates’ Court, assisted by a legal advisor. Their role is crucial for local justice and community involvement.

The jury serves in Crown Court trials and occasionally in civil cases. Twelve jurors decide questions of fact based on the evidence, and must reach a verdict: unanimous or, after judicial direction, a majority (10–2 or 11–1). Juries are seen as a safeguard against state oppression and a means of democratic participation. However, concerns exist about jury comprehension of complex evidence, media influence, and the risk of perverse verdicts. Research on jury behaviour is strictly limited by the Contempt of Court Act 1981.

11. Human Rights and Civil Liberties |

The Human Rights Act 1998 (HRA) requires all public authorities to act compatibly with the European Convention on Human Rights (ECHR). Courts must interpret legislation, so far as possible, in a way that respects Convention rights. If a declaration of incompatibility is made, Parliament is not obliged to amend the law, but a political pressure to do so arises. Key rights include Article 2 (right to life), Article 3 (prohibition of torture), Article 6 (fair trial), Article 8 (private and family life), and Article 10 (freedom of expression).

These rights are qualified or absolute. For example, Article 8 is a qualified right; interference can be justified if it is in accordance with law, pursues a legitimate aim, and is necessary in a democratic society. The courts balance individual rights against the public interest. Controversies often arise in areas such as counter-terrorism measures, surveillance, and free speech limits. The HRA has been questioned by some who wish to replace it with a British Bill of Rights, but it remains a cornerstone of UK human rights protection.

12. Law Reform and European Influence |

The Law Commission, an independent body, systematically reviews areas of law and makes recommendations for reform to Parliament. Many successful reforms have resulted, such as the Coroners and Justice Act 2009, though governments are not bound to implement its proposals. Pressure groups and media campaigns also drive change, raising public awareness of legal inadequacies. However, law reform is often slow and subject to political will, leading to piecemeal rather than holistic change.

Before Brexit, EU law had a profound influence on UK legislation and judicial reasoning. The principle of supremacy meant EU law prevailed over conflicting domestic law. Even after leaving the EU, retained EU law continues to apply until specifically amended or repealed by Parliament. This includes key areas like consumer protection, employment rights, and environmental regulations. The UK’s departure has created an opportunity to diverge, but it also raises concerns about lower standards where EU protections are lost and about legal certainty during transition.
