Where an offence requires a consequence, the prosecution must prove that the defendant’s act caused that consequence. There are two types of causation: factual causation and legal causation. 4. Murder and Voluntary Manslaughter | 谋杀与自愿过失杀人

Murder is the unlawful killing of a reasonable creature in being under the Queen’s Peace with malice aforethought. Malice aforethought means an intention to kill or cause grievous bodily harm. A conviction for murder carries a mandatory life sentence. However, a defendant may plead a special defence to reduce the conviction to voluntary manslaughter.

Intoxication can be voluntary or involuntary; voluntary intoxication is a defence only to crimes of specific intent. Insanity (M’Naghten rules) requires a defect of reason from disease of the mind, so the defendant did not know the nature and quality of the act or that it was wrong.

In tort law, negligence is a civil wrong. The test for a duty of care comes from Caparo v Dickman (1990): foreseeability of harm, proximity between the parties, and whether it is fair, just, and reasonable to impose a duty.

Once a duty is established, the court examines whether the defendant breached that duty. The standard is that of the reasonable person: did the defendant fail to act as a reasonable person would? Factors such as the probability of harm, the seriousness of potential injury, the cost of taking precautions, and any social utility of the defendant’s conduct are weighed. The breach must cause damage that is both factually and legally caused, and not too remote (The Wagon Mound test: foreseeable type of damage).

Acceptance must be a mirror image of the offer and communicated to the offeror, unless the postal rule applies.

Consideration is something of value in the eyes of the law that is exchanged between the parties. It can be a benefit to the promisor or a detriment to the promisee. Consideration need not be adequate but must be sufficient (e.g., economic value). The intention to create legal relations is presumed in commercial agreements but not in domestic/social arrangements, unless evidence rebuts the presumption.

These rights are qualified, meaning that they can be restricted if necessary in a democratic society, for example to protect national security or the rights of others. Courts balance these competing rights using the proportionality test.

The rules help resolve ambiguity and apply Parliament’s intention.

The hierarchy of courts determines which decisions are binding: the Supreme Court binds all lower courts; the Court of Appeal binds itself and lower courts (with limited exceptions). A higher court can overrule a lower court’s decision, and judges may distinguish a precedent if the material facts are different.
