Rule: Theft is defined in s.1 Theft Act 1968 as the dishonest appropriation of property belonging to another with intention to permanently deprive. Dishonesty is not defined in the Act; the courts apply the Ghosh test or, more recently, the Ivey test, which asks whether the conduct would be considered dishonest by the standards of ordinary decent people.

Application: Here, Tom appropriated the wallet by taking it. The wallet clearly belonged to another – a stranger. The question is whether the appropriation is a continuing act. Under s.3(1) of the Act, a later assumption of a right to the property can amount to appropriation. Therefore, when he decided to keep the money, he appropriated the wallet dishonestly. Applying the Ivey test, ordinary people would certainly consider keeping a stranger’s money dishonest.

Rule: To establish negligence, the claimant must prove three elements: (1) the defendant owed a duty of care; (2) the defendant breached that duty; and (3) the breach caused the damage, and the damage was not too remote. The duty of care is established using the Caparo test: foreseeability of damage, proximity between the parties, and fair, just and reasonable to impose a duty. Breach occurs when the defendant falls below the standard of a reasonable person. The standard for a council worker is that of a reasonable competent worker. Causation requires both factual causation (but for test) and legal causation (no break in the chain).

Application: The council worker owed a duty to road users, including cyclists, as injury was foreseeable if a manhole is left uncovered and unprotected. The proximity existed because the claimant was a road user. It is fair, just and reasonable to impose a duty on a council maintaining roads. The worker breached the duty by leaving the hole without warning signs; a reasonable worker would have put up barriers or signs. However, the cyclist’s own behaviour must be considered. Riding at night without lights and looking at a phone could amount to contributory negligence under the Law Reform (Contributory Negligence) Act 1945, reducing damages. It could also be argued that the cyclist’s act was a novus actus interveniens breaking the chain of causation, but the original breach remained an effective cause. The court would likely apportion responsibility.

Rule: A contract requires a valid offer, acceptance, and consideration. An offer can be revoked before acceptance is communicated, provided the revocation is communicated. However, a purported acceptance that introduces new terms is not an acceptance but a counter-offer, which destroys the original offer – Hyde v Wrench. A counter-offer must then be accepted to form a contract. Offer can also lapse after a specified deadline or reasonable time.

Therefore, from that moment, there was no longer an offer capable of acceptance. Ayesha was free to sell to Chloe. The postal rule does not rescue Ben because his letter was not a mirror-image acceptance. Even if we ignore the counter-offer point, the letter only arrived on Saturday, after the Friday deadline and after Ayesha had revoked by selling to another, though revocation might need to be communicated. But the counter-offer argument is decisive.

Also, avoid using informal language like ‘the bad guy’; use ‘defendant’ or ‘claimant’.
