The defence will fail if the killing is motivated by revenge, so always scrutinise the facts for evidence of considered revenge.

Candidates often confuse ‘substantial impairment’ with complete lack of control; ‘substantial’ means more than trivial but less than total. Use the medical evidence provided in the scenario to decide whether the impairment was a significant cause of the killing.

The risk of some harm suffices.

Common exam favourites include battery, assault, and criminal damage, so identify the base offence precisely and state its mens rea requirement.

Mixing up the mens rea word ‘maliciously’ in s.20 (meaning recklessness) with the specific intent required for s.18 is another classic error that costs marks.

If yes, it is an offer; if the statement leaves room for further bargaining, it is an invitation to treat.

Past consideration occurs when an act is performed before a promise of reward, and is generally not valid consideration (Re McArdle).

Clearly state whether the request element exists.

Candidates sometimes confuse duress with simple commercial bargaining pressure. Analyse whether threats were made, whether the party protested, and whether they had any real choice. These facts help you decide whether the contract can be set aside.

The modern three-stage test for duty of care from Caparo v Dickman asks: (1) was the damage reasonably foreseeable? (2) was there sufficient proximity between claimant and defendant? (3) is it fair, just and reasonable to impose a duty?

For example, if a driver injures a pedestrian, foreseeability is clear, proximity is physical closeness, and policy reasons support imposing a duty. In novel situations, such as liability of public bodies, the third limb ‘fair, just and reasonable’ often determines the case. Look for policy arguments in the facts, like floodgates concerns or public resource allocation.

Note that established duty situations, such as driver–passenger or doctor–patient, do not require the full Caparo analysis. The error here is wasting time reinventing the duty when you can simply state the settled duty category. Use the established duty rule to save time and show exam technique.

A child defendant is compared to a reasonable child of the same age (Mullin v Richards). Professionals must meet the standard of a reasonably competent professional in that field (Bolam test), not the general reasonable person.

Candidates often forget to mention that persuasive precedents from other jurisdictions (e.g. Commonwealth cases) can be influential. In exams, always note the court that decided the precedent and explain its status.
