1. Understanding Assessment Objectives |
Cambridge IGCSE Law essays are marked against three Assessment Objectives. AO1 tests your knowledge and understanding of legal rules, principles, and cases. You must state the law accurately and select relevant legal material. AO2 examines your ability to apply that law to a given scenario – identifying the legal issues and explaining how the rules operate in the facts provided. AO3 focuses on analysis and evaluation, requiring you to consider different viewpoints, recognise strengths and weaknesses in arguments, and reach a reasoned conclusion. A strong essay balances all three, but many students neglect AO3 by simply describing the law without critical comment.
Before planning your essay, carefully read the question to identify which objectives are being targeted. For example, a question that begins with ‘Explain’ is heavily weighted towards AO1 and AO2, while ‘Discuss’ or ‘Evaluate’ signals that AO3 must be prominent. If the question includes a scenario, you must apply the law to those facts, not just recite the legal test. Mark schemes reward candidates who address all elements of the question and use the facts to demonstrate how the law works in practice.
2. Types of Essay Questions in IGCSE Law | IGCSE
IGCSE Law papers feature two main types of essay question: discursive essays and problem scenarios. A discursive essay asks you to explain and evaluate an area of law, such as ‘Discuss the extent to which the law of negligence provides fair compensation for personal injury.’ Here you must describe the relevant rules, cite supporting authorities, and then assess the law’s effectiveness. A problem scenario gives you a set of facts and asks you to advise a party on their legal position. You must spot the legal issues, state the applicable law, apply it methodically to the facts, and reach a conclusion about the likely outcome.
Some questions blend the two styles, for instance, by providing a short scenario and then asking you to ‘Evaluate the protection given to the claimant under the law of negligence.’ Such hybrid questions demand that you both apply the law and step back to critique it. Recognising the question type early will save time because you can structure your answer accordingly. For problem questions, use the IRAC structure (Issue, Rule, Application, Conclusion). For discursive essays, use a themed approach, grouping related arguments under clear headings.
3. The PEEL Method for Paragraph Structure | 段落结构的 PEEL 法
The PEEL method is a highly effective way to structure each paragraph in a law essay. PEEL stands for Point, Evidence, Explanation, and Link. Begin with a clear Point that directly responds to the question. Next, supply Evidence – this can be the legal rule itself, a case name with a brief ratio decidendi, or a statutory section. Then, Explain how the evidence supports your point and apply it to the given facts if dealing with a problem. Finally, Link the paragraph back to the overall argument or forward to the next point, maintaining a logical flow.
PEEL 代表 Point(观点)、Evidence(证据)、Explanation(解释)和 Link(衔接)。
Consider a paragraph on the duty of care in negligence. Point: ‘The first element of negligence is the existence of a duty of care owed by the defendant to the claimant.’ Evidence: ‘This was established by the neighbour principle in Donoghue v Stevenson [1932] and later refined in Caparo Industries v Dickman [1990].’ Explanation: ‘Under Caparo, a duty arises if harm was reasonably foreseeable, there was sufficient proximity between the parties, and it is fair, just and reasonable to impose a duty. In the given problem, the driver’s conduct clearly created a foreseeable risk of injury to the pedestrian, satisfying the first two limbs.’ Link: ‘Once a duty is established, the court must then consider breach.’ This structure keeps your answer tight and prevents rambling.
4. How to Write an Introduction |
Your introduction should be brief but purposeful. For a discursive essay, start by defining the key concept or stating the current legal position, then outline the main areas you will explore. Avoid simply repeating the question. Instead, show that you understand the debate. For example, in an essay on the postal rule, you might write: ‘The general rule in contract law is that acceptance must be communicated to the offeror, yet the postal rule creates a significant exception. This essay will examine the rationale behind the rule, its application in case law, and the criticisms that have been levelled against it in modern commercial practice.’ This immediately signals to the examiner that you have a structured plan.
For problem questions, your introduction should identify the parties and the main legal area, then state that you will consider each claim in turn. Example: ‘This answer will advise Sally on whether she can bring a successful claim in negligence against the supermarket for her injuries. The key elements of duty of care, breach, causation, and remoteness will be analysed in the context of the facts provided.’ Keep introductions to three or four sentences; the bulk of your marks come from the main body and analysis.
5. How to Develop Arguments and Apply Law |
Strong arguments do not just state the law; they explain why the law takes a particular form and how it operates on the facts. When applying a legal test, break it down into its elements and deal with each one sequentially. For instance, in the tort of negligence, first establish that a duty of care was owed, then discuss breach by applying the reasonable person test, next examine factual and legal causation, and finally address remoteness of damage. Use the facts actively: highlight which details support or undermine a legal element. Avoid the trap of long factual narratives detached from legal analysis.
Equally important is the ability to discuss alternative interpretations. Where the facts are ambiguous, acknowledge that the outcome could differ depending on which precedent the court chooses to follow. This demonstrates AO3 evaluation. For example, on the issue of whether a statement is an offer or an invitation to treat, you could argue: ‘Although the advertisement appeared to be an offer, following Partridge v Crittenden, it is more likely to be classified as an invitation to treat. Nevertheless, if the wording contained a clear promise, the courts might apply the exception established in Carlill v Carbolic Smoke Ball Co.’, etc.
6. Using Cases and Statutes Effectively |
Case names are not decorative; they are tools of legal reasoning. When you cite a case, briefly state the material facts and the legal principle for which it stands. For example: ‘In Donoghue v Stevenson, the manufacturer was held to owe a duty of care to the ultimate consumer of ginger beer, establishing the neighbour principle.’ Avoid lengthy case summaries; the examiner only needs enough detail to see that you understand the relevance of the authority. If a case is directly on point, explain how it applies to the current facts. If you cannot recall a case name, you may describe the principle and use phrases like ‘as established in a leading case’.
Statutory references are equally important, especially in topics such as contract law (Sale of Goods Act, Unfair Contract Terms Act) or human rights (Human Rights Act 1998). You do not need to memorise every section number, but knowing the key sections of major statutes (e.g., s.14 Sale of Goods Act – satisfactory quality) will impress examiners. When using a statute, briefly paraphrase its effect and link it to the legal point you are making.
7. How to Write a Balanced Conclusion |
A conclusion should summarise your main arguments and give a direct answer to the question. In a discursive essay, this means weighing up the competing factors and reaching an overall judgment. For instance, if the question is whether the postal rule should be abolished, you might conclude: ‘While the postal rule brings certainty in mail-order transactions, it is increasingly out of step with instantaneous communication. Its abolition would align contract law with commercial reality, though transitional protection for consumers would be needed.’ Avoid introducing new information in the conclusion.
For a problem scenario, your conclusion must advise the claimant or defendant on the most probable outcome. Be clear but cautious: the law often allows more than one possible result. Statements like ‘It is likely that the court would find the defendant liable, but there is a risk that the claim might fail on causation’ show realistic evaluation. If the question asks you to advise a client, indicate what remedy might be available, such as damages or an injunction, if it can be inferred from the facts. A crisp, confident ending leaves a positive impression.
8. Time Management and Essay Planning |
In the IGCSE Law examination, time is limited. For a typical Paper 1 scenario-based essay, you might allocate around 5-7 minutes to read and deconstruct the question, identify issues, and jot down a brief plan, followed by about 25 minutes for writing. A plan does not need to be formal; a simple spider diagram or bullet list of key points under headings like ‘Duty’, ‘Breach’, ‘Causation’, ‘Defences’, and ‘Remedies’ will keep you on track. Skipping the planning stage often leads to disorganised answers that miss key issues.
Use the first two minutes of writing time to write a short introduction that mirrors your plan. For each main body paragraph, keep an eye on the clock – you should aim to cover all major issues rather than perfecting one at the expense of others. If you find yourself running out of time, switch to note form for the remaining points; this still allows you to collect marks for knowledge and application, though you lose some credit for structure and evaluation. Practice under timed conditions so that the process becomes automatic.
9. Common Mistakes to Avoid |
One of the most frequent errors is describing the law without applying it. A candidate might write a perfect summary of the Caparo test but then fail to explain how proximity exists in the given scenario. Examiners call this ‘information dumping’ and it barely meets AO2. Always tie the law back to the facts. Another pitfall is one-sided arguments. Even if you believe a particular outcome is correct, briefly acknowledging the opposite view demonstrates maturity of analysis and lifts your marks in the AO3 band.
Poor case referencing also costs marks. Stating ‘Donoghue v Stevenson’ without spelling or punctuation errors is good, but saying ‘Donoghue v Stevenson established duty of care in negligence’ without more is not enough for top bands. You need to briefly explain the significance. Similarly, do not use the first person ‘I think’ or ‘in my opinion’. Instead, use ‘it is submitted that’ or ‘the courts are likely to find’. This keeps the essay objective and professional. Finally, proofread for legal accuracy; mixing up offer and invitation to treat or misstating the standard of proof can undermine credibility.
同样,不要使用第一人称 ‘I think’ 或 ‘in my opinion’,而应使用 ‘it is submitted that’ 或 ‘the courts are likely to find’。
10. Model Answer: Negligence in Tort Law |
Question: ‘Ahmed was cycling to work when he was struck by a car driven by Ben, who was looking at his mobile phone. Ahmed suffered a broken leg and was unable to work for three months. Consider the principles of negligence and advise Ahmed on whether he can successfully claim against Ben.’
The first step is to establish that Ben owed Ahmed a duty of care. Under the neighbour principle from Donoghue v Stevenson, a person must take reasonable care to avoid acts or omissions which can reasonably be foreseen as likely to injure their neighbour – anyone so closely and directly affected by the act. A driver clearly owes a duty to other road users, including cyclists. This is well established in case law such as Nettleship v Weston. In this scenario, Ben’s act of driving placed him in proximity to Ahmed, and the risk of injury was foreseeable. All three limbs of the Caparo test are satisfied.
Next, Ben’s behaviour must amount to a breach of that duty. The standard is that of the reasonable driver: the defendant is expected to act as a reasonably competent driver would in the circumstances. Looking at a mobile phone while driving falls far below that standard, as it distracts attention from the road and is itself a serious traffic offence in many jurisdictions. Thus, Ben has clearly breached his duty of care.
Causation must then be proven. Factually, applying the ‘but for’ test from Barnett v Chelsea Hospital, but for Ben’s negligent driving, Ahmed would not have suffered the broken leg. On legal causation, Ben’s action was the operating and substantial cause of the harm; no new intervening act broke the chain of causation. The damage is also not too remote, as personal injury of this kind is a direct and foreseeable consequence of a road accident. Therefore, all elements of negligence are likely to be established, and Ahmed should succeed in his claim for damages, including loss of earnings.
11. Model Answer: Offer and Acceptance in Contract Law |
Question: ‘Tim placed an advertisement on a website: “For sale: vintage guitar, GBP 800 to first person who pays in cash on Saturday.” Fay emailed Tim saying, “I will pay GBP 700.” Tim did not reply. Later, Gina arrived on Saturday with GBP 800 cash, but Tim had already sold the guitar to someone else. Advise Gina of her contractual rights.’
The first issue is whether Tim’s advertisement was an offer or merely an invitation to treat. The general rule is that advertisements are invitations to treat, as established in Partridge v Crittenden. However, where an advertisement shows a clear intention to be bound and limits acceptance to a specific act, it can amount to a unilateral offer. In Carlill v Carbolic Smoke Ball Co., the advert promising GBP 100 to any user who contracted influenza after using the ball was held to be a unilateral offer. Tim’s wording “to first person who pays in cash on Saturday” closely mirrors this: it prescribes a specific mode of acceptance and does not require further negotiation. Therefore, it is likely to be treated as a unilateral offer.
Fay’s email stating ‘I will pay GBP 700’ is not acceptance but a counter-offer. In Hyde v Wrench, a counter-offer destroys the original offer. Since Tim did not accept the counter-offer, no contract arose with Fay. Gina, on the other hand, performed the required act – arriving on Saturday with the cash – provided she was the first person to do so. Under the rules of unilateral contracts, acceptance occurs through full performance of the act, and communication of acceptance is not necessary prior to completion. Thus, Gina accepted the offer and a binding contract was formed the moment she arrived and tendered the cash.
Tim’s sale to a third party constituted a breach of contract. Gina can claim damages for breach, with the measure likely being the difference between the contract price and the market value of a similar vintage guitar, if higher. She could also, in theory, seek an order for specific performance, though with personal property, damages are the usual remedy. In conclusion, Gina has strong contractual rights against Tim.
12. Final Tips for Exam Success |
In the weeks leading up to your exam, practise writing full essays under timed conditions using past paper questions. This will accustom you to the pace required and help you internalise the PEEL structure. When revising, create concise case cards that list the name, key facts, and the legal principle. Do not try to memorise whole paragraphs; focus on understanding how the principles interlink. Pay particular attention to topics that are frequently examined, such as the elements of negligence, the formation of contract, and defences in criminal law, but do not ignore smaller topics entirely.
