Under the test in R v Ghosh, dishonesty is assessed by whether ordinary people would consider the conduct dishonest and whether Darren realised that. Taking a laptop left briefly in a library would likely be viewed as dishonest by ordinary standards. Darren intends to keep the laptop, satisfying intention permanently to deprive. The defence of mistake is unlikely to succeed because a mistaken belief in abandonment does not negate the appropriation of another’s property under the Act. In conclusion, Darren is likely to be liable for theft.

Forgetting to do so falls below the expected standard; this is not a mere error of judgment but a failure to take a simple precaution. Third, factual causation is satisfied on the ‘but for’ test: but for the absence of the sign, the customer would not have slipped. Legal causation requires the harm to be within the risk created; slipping on a wet floor is the very type of harm that proper signage seeks to prevent. The broken arm is a personal injury that is not too remote under the Wagon Mound test. The claimant may have the defence of contributory negligence if they were not paying reasonable attention, but on the facts, a hidden wet floor without a sign makes this unlikely. Therefore, the café is likely liable in negligence, and the customer should be advised to seek damages for the injury and any consequential loss.
