It is vital to treat the facts as they are given. Do not make up extra information, but do draw reasonable inferences where the examiners expect them. Even when an element seems obvious, explain it briefly. For instance, if a defendant pushed a victim, explicitly link the push to ‘direct application of unlawful force’ in a battery claim instead of assuming the marker will fill the gap.

The first issue is whether David’s punch caused Eric’s death. In criminal law, causation has two limbs: factual causation (the ‘but for’ test) and legal causation (the act must be an operating and substantial cause of the harm). Factually, but for David’s punch, Eric would not have fallen and injured his head. The punch is therefore a factual cause. Legally, the original wound was an operating cause of death. Even though Eric’s refusal to seek treatment and the infection contributed, the thin skull rule – also known as the ‘egg shell skull’ rule – dictates that a defendant must take his victim as he finds him. In R v Blaue, a victim’s refusal of a blood transfusion on religious grounds did not break the chain of causation. By analogy, Eric’s fear of hospitals is a pre‑existing characteristic, so the chain remains unbroken.

The next issue is mens rea. For murder, the prosecution must prove an intention to kill or cause grievous bodily harm. A single punch to the face, without a weapon, typically suggests only an intention to cause some harm, not really serious injury. Unless there is evidence of an intent to cause GBH, David is more likely to be liable for manslaughter—specifically, unlawful act manslaughter. The unlawful act was the battery, it was objectively dangerous (a punch can cause a reasonable person to foresee some harm) and it caused death. The conclusion is that a conviction for murder is unlikely, but involuntary manslaughter is strongly arguable.

Automatism is a complete defence where the defendant’s actions are involuntary due to an external factor or, in some classifications, an internal condition that is not a ‘disease of the mind’. The distinction between insane and non‑insane automatism matters: insane automatism leads to a special verdict of ‘not guilty by reason of insanity’, whereas non‑insane automatism results in full acquittal. Hyperglycaemia caused by diabetes may be classified as a disease of the mind (see R v Hennessy), but hypoglycaemia caused by an external factor such as insulin intake or lack of food is generally treated as external, giving rise to non‑insane automatism (R v Quick). Here, Lisa’s loss of control was triggered by lack of food after insulin, an external factor. Therefore, she can argue non‑insane automatism.

However, the defence will fail if Lisa was aware of the risk and drove anyway. Evidence that she felt warning signs and ignored them would destroy the claim that the automatism was total and unexpected. If successful, the defence results in complete acquittal; if not, she may be convicted of dangerous driving. Conclusion: the defence is available in principle, but its success depends heavily on the absence of prior awareness.

To establish a duty of care in novel situations, the courts apply the three‑stage Caparo test: foreseeability of harm, proximity and whether it is fair, just and reasonable to impose a duty. As for Sam, the council’s decision to place him with a specific family without checks directly created a risk of harm. The harm was clearly foreseeable, the relationship between the child protection agency and the child is sufficiently proximate, and public policy supports imposing a duty. Indeed, in JD v East Berkshire Community Health NHS Trust, a duty was recognised in an analogous context. Conclusion: the council probably owes Sam a duty of care.

The grandmother’s claim is for secondary victim psychiatric harm. She must satisfy the criteria in Alcock v Chief Constable of South Yorkshire: a close tie of love and affection with the primary victim, proximity in time and space to the event or its immediate aftermath, perception through her own unaided senses, and a recognised psychiatric illness. A grandmother‑grandchild relationship usually gives rise to a presumption of close ties. If her illness was caused by seeing Sam’s neglected state (the ‘immediate aftermath’), she may succeed. However, the harm must be shock‑induced, not a gradual accumulation of distress. Conclusion: her claim is weaker, but arguable.

In Miller v Jackson, cricket had been played on a ground for many years before houses were built nearby, yet the claimants still succeeded because the interference was unreasonable to the ordinary use of their property. One key question is whether the factory’s activity amounts to an unreasonable interference with Anisa’s enjoyment of her land. Reasonableness is assessed by factors such as duration, intensity, locality and sensitivity of the claimant. Operating a noisy fan for ten hours on weekdays in a mixed or residential area may well cross the line from normal to unreasonable, especially if the noise levels exceed what a reasonable person should tolerate.

The manager refuses, saying the price was a mistake and the real price is £699. Advise Kamal.

The central issue is whether the advertisement was an offer or an invitation to treat. As a general rule, advertisements in newspapers or magazines are invitations to treat, not offers (Partridge v Crittenden). This rule protects the advertiser from being bound to sell to everyone who accepts, especially when stock is limited. The wording ‘First come, first served’ might make the advert look like a unilateral offer, similar to the smoke ball case (Carlill v Carbolic Smoke Ball Co), but the court will look at the objective intention of the parties. In Carlill, the company deposited money in a bank to show sincerity; here, there is no such indication. The advert simply encourages customers to visit the shop and make an offer to buy.

The fact that the price was an error may also allow the store to argue mistake, but here the store can simply refuse to accept Kamal’s offer. Conclusion: Kamal cannot force the sale. He may complain to advertising standards authorities about misleading advertising, but in contract law he has no remedy.

Traditionally, part payment of a debt is not good consideration for a promise to forgo the balance. The rule in Pinnel’s Case states that payment of a lesser sum on the due day in satisfaction of a larger sum cannot discharge the whole debt; there must be some extra element such as payment at an earlier date or a different place. Here, Flora paid early (before 1 July), which can constitute good consideration. However, the amount was only part of the debt, paid at the creditor’s request. The early payment might in itself be a practical benefit, but the strict rule from Foakes v Beer says that part payment of a debt, even at an earlier date, does not satisfy the whole debt unless there is consideration beyond the part payment.

Nevertheless, the equitable doctrine of promissory estoppel may protect Flora. Under the High Trees principle, where one party makes a clear and unambiguous promise intended to affect legal relations and the other party relies on it to their detriment, the promisor may be estopped from going back on the promise. George’s words were clear. Flora relied by paying immediately. Injustice would result if George could resile. Promissory estoppel can suspend the obligation, and in some cases extinguish it. Conclusion: George is likely estopped from claiming the balance, so Flora need not pay.

The critical test is necessity, which involves proportionality: is the blanket ban proportionate to the threat? A total prohibition on all assemblies over five people near any government building, without any allowance for peaceful protest unconnected to cyber‑attacks, is likely disproportionate. In similar cases, the European Court of Human Rights has ruled that states must not impose blanket bans and must balance the individual right against the public interest.

Tort analysis: Ben’s injury falls under the tort of negligence and possibly the Occupiers’ Liability Act 1957 (or similar principles under common law). As an occupier, Tom owes a common duty of care to lawful visitors. The footpath users, including Ben, are likely visitors, not trespassers, as the path is public. The danger was the rotten fence, which Tom knew about. A reasonable occupier would have repaired or cordoned off the fence. The harm was clearly foreseeable. Tom breached his duty, and that breach caused Ben’s physical injury. Ben also has a claim in negligence based on the neighbour principle. Conclusion: Tom is liable for Ben’s injuries.

Ben’s mother may claim as a rescuer. Historically, rescuers are owed a duty because danger invites rescue.
