A retailer can also owe a duty if it is the supplier putting the product into circulation.

The ‘but for’ test (Barnett v Chelsea and Kensington Hospital) demonstrates causation: but for the metal fragment in the salad, Savita would not have broken her tooth.

Mia will be liable for ABH under s.47 against Ruby because the broken wrist is actual bodily harm occasioned by the battery. The fact that Jay stumbled is not a novus actus interveniens – it was a natural reaction to being struck.
