1. Sources of Law | 法律渊源

English law is based on two main sources: statutory law made by Parliament (Acts of Parliament) and common law developed by judges through case precedents. Equity operates alongside the common law to provide fair remedies where the common law is inadequate.

Parliamentary sovereignty means that Acts of Parliament are the highest form of law and can override common law. Judges cannot strike down an Act of Parliament, but they can interpret it.

Precedent, also known as stare decisis, requires lower courts to follow the decisions of higher courts in similar cases. The ratio decidendi (the legal reason for the decision) is binding, while obiter dicta (remarks in passing) are persuasive but not binding.

2. Separation of Powers and Rule of Law | 权力分立与法治

The separation of powers divides the state into three branches: legislature (Parliament, which makes law), executive (government, which administers law), and judiciary (courts, which interpret and apply law). Each branch should be independent to prevent abuses of power, though in the UK there is some overlap.

3. Criminal vs Civil Law | 刑法与民法之比较

Criminal law involves actions that the state considers harmful to society. The case is brought by the state (prosecution) against a defendant. The standard of proof is ‘beyond reasonable doubt’. If found guilty, the defendant may face a fine, community order, or imprisonment.

4. Court Hierarchy and Appeals | 法院层级与上诉途径

The main criminal courts are the Magistrates’ Court (tries summary offences and some either-way offences, deals with first hearings) and the Crown Court (tries indictable offences and either-way offences sent from magistrates, judge and jury).

5. Actus Reus and Mens Rea | 犯罪行为与犯罪意图

To establish criminal liability, the prosecution must prove both actus reus (guilty act) and mens rea (guilty mind). Both must exist at the same time, though the contemporaneity rule has some exceptions.

要确立刑事责任,控方必须同时证明犯罪行为(actus reus)和犯罪意图(mens rea)。两者必须同时存在,尽管同时性原则存在一些例外。

Actus reus can be a positive act, a failure to act where there is a duty to act (an omission), or a state of affairs. Duties to act arise from a contract, a relationship, an assumption of responsibility, or the creation of a dangerous situation.

Mens rea varies by offence. Common forms include intention (direct or oblique), recklessness (Cunningham recklessness: foreseeing a risk and going ahead unreasonably), negligence, and knowledge. In strict liability offences, no mens rea is required for at least one element.

6. Non-Fatal Offences Against the Person | 针对人身的非致命犯罪

Assault is causing the victim to apprehend immediate unlawful personal violence. It can be committed by words or gestures. No physical contact is needed, only the fear of immediate force.

Battery is the actual infliction of unlawful personal violence. The slightest touching can be battery if it is hostile, though everyday jostling is excluded. Battery can be committed through an indirect act, such as setting a trap.

Assault occasioning actual bodily harm (ABH) under s.47 OAPA 1861 requires assault or battery causing ‘actual bodily harm’, meaning any hurt or injury calculated to interfere with health or comfort. Mens rea is that for assault or battery only.

Unlawful wounding or inflicting grievous bodily harm (GBH) under s.20 requires that the defendant unlawfully and maliciously wounds or inflicts any GBH. ‘Maliciously’ means intending or being reckless as to some harm, even if not serious. Under s.18, wounding or causing GBH with intent is more serious, requiring intention to cause serious harm.

7. Property Offences: Theft, Robbery and Burglary | 财产犯罪:盗窃、抢劫和入室盗窃

Theft, defined in s.1 Theft Act 1968, is the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. All five elements – appropriation, property, belonging to another, dishonesty, and intention to permanently deprive – must be proved.

Robbery (s.8) is theft plus the use or threat of force on any person immediately before or at the time of stealing, in order to carry out the theft. The force must be directed at a person, not property.

Burglary under s.9(1)(a) involves entering a building or part of a building as a trespasser with intent to steal, inflict GBH, or cause unlawful damage. Under s.9(1)(b), it is entering as a trespasser and then actually stealing or inflicting GBH or attempting to do so. The entry must be ‘effective’ and the defendant must know or be reckless as to being a trespasser.

8. Defences in Criminal Law | 刑法中的抗辩理由

Self-defence allows reasonable force to protect oneself, another person, or property, or to prevent crime. The force must be necessary and proportionate to the threat faced. The defendant is judged on the circumstances as they honestly believed them to be.

自卫允许使用合理的武力来保护自己、他人或财产,或防止犯罪。武力必须必要且与所面临的威胁成比例。要根据被告人诚实相信的情况来评判。

Duress is a defence where the defendant was forced to commit an offence by a threat of death or serious injury from another person. It is unavailable for murder or attempted murder. The threat must be imminent, and a reasonable person sharing the defendant’s characteristics would have responded in the same way.

Intoxication can be voluntary or involuntary. Involuntary intoxication is a defence if it negates the mens rea. Voluntary intoxication is only a defence to specific intent crimes if the defendant lacked the intent. It is not a defence to crimes of basic intent, as getting drunk is reckless behaviour.

9. Introduction to Tort Law: The Tort of Negligence | 侵权法入门:过失侵权

A tort is a civil wrong for which the law provides a remedy, usually damages. The main remedy is to put the claimant back in the position they would have been in if the tort had not occurred, so far as money can do so.

侵权是一种民事过错,法律为此提供救济,通常是损害赔偿。主要救济措施是尽可能用金钱将原告恢复到侵权未发生时的状态。

Negligence is the most common tort. To succeed in a claim, the claimant must prove three elements: that the defendant owed them a duty of care, that the defendant breached that duty, and that the breach caused damage that was not too remote.

过失是最常见的侵权。要在索赔中胜诉,原告必须证明三个要素:被告对其负有注意义务、被告违反了该义务,以及该违反造成了并非过分遥远的损害。


10. Elements of Negligence: Duty, Breach and Damage | 过失侵权要素:义务、违反与损害

Duty of care is established using the neighbour principle from Donoghue v Stevenson: you must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour. The current approach is the Caparo three-stage test: foreseeability of harm, proximity between the parties, and whether it is fair, just and reasonable to impose a duty.

Breach of duty occurs when the defendant does something a reasonable person would not do, or fails to do something a reasonable person would do. The standard is objective, but factors such as the likelihood of harm, seriousness of potential harm, cost of precautions, and social utility of the defendant’s conduct are considered.

The breach must cause damage. Causation requires factual causation (‘but for’ test) and legal causation (the damage must not be too remote; it must be of a type that was reasonably foreseeable). The thin-skull rule means the defendant must take the victim as they find them.

11. Contract Law: Offer and Acceptance | 合同法:要约与承诺

A contract is a legally binding agreement. The formation requires offer, acceptance, consideration, intention to create legal relations, and capacity. An offer is an expression of willingness to contract on certain terms, made with the intention that it will become binding upon acceptance.

合同是具有法律约束力的协议。合同成立需要要约、承诺、对价、建立法律关系的意图和行为能力。要约是以特定条件订立合同意愿的表示,旨在一旦被承诺即具有约束力。

An invitation to treat is not an offer but an invitation for others to make offers. Examples include goods displayed in a shop window or on shelves (Pharmaceutical Society of GB v Boots), advertisements, and auctions.

要约邀请不是要约,而是邀请他人提出要约。例如商店橱窗或货架上陈列的商品(Pharmaceutical Society of GB v Boots案)、广告和拍卖。

Acceptance must be an unconditional agreement to all the terms of the offer. The general rule is that acceptance must be communicated to the offeror, though the postal rule holds that acceptance by letter takes effect when the letter is posted, provided it is reasonable to use post. Silence cannot amount to acceptance.

承诺必须是对要约所有条款的无条件同意。一般规则是承诺必须传达给要约人,但邮政规则规定,通过信件承诺在投递时即生效,前提是使用邮寄方式是合理的。沉默不能构成承诺。


12. Consideration and Intention to Create Legal Relations | 对价与建立法律关系的意图

Consideration is something of value exchanged between the parties. Each party must give something of benefit to the other or suffer a detriment. Consideration must be sufficient but need not be adequate – the courts do not weigh the economic fairness of the bargain.

对价是双方之间交换的有价值之物。每一方都必须向对方提供某种利益或承受某种损害。对价必须充分但无需相当——法院不权衡交易的经济公平性。

Past consideration is not good consideration, meaning a promise made after an act has already been performed cannot be enforced unless it was made at the request of the promisor. Consideration must move from the promisee.

过去的对价不是有效的对价,这意味着在一项行为已经完成后作出的承诺不可强制执行,除非该行为是应承诺人的要求作出的。对价必须由承诺人提供。

For an agreement to be a contract, the parties must intend it to be legally binding. In social and domestic arrangements, there is a presumption that no such intention exists, which can be rebutted by evidence. In commercial agreements, the presumption is that legal relations are intended, which is difficult to rebut.
