1. The English Legal System and Sources of Law | 英国法律体系与法律渊源

The English legal system divides into criminal law and civil law. Criminal law deals with offences against the state, such as theft and assault, and is primarily aimed at punishment. Civil law resolves disputes between individuals or organisations, for example breach of contract or negligence claims, usually providing a remedy in the form of damages.

英国法律体系分为刑法和民法。刑法处理危害国家的犯罪,如盗窃和袭击,主要目的在于惩罚。民法解决个人或组织之间的纠纷,例如违约或过失索赔,通常以损害赔偿的形式提供救济。

The court hierarchy sees Magistrates’ Courts and County Courts deal with most first-instance cases. Serious criminal offences are tried in the Crown Court, while complex civil cases are heard in the High Court. Appeals go to the Court of Appeal (Civil and Criminal Divisions) and ultimately the Supreme Court, whose decisions bind all lower courts.

The main sources of law are Acts of Parliament (statute law) and judicial precedent (case law). The doctrine of stare decisis ensures consistency: lower courts must follow the legal principles set by higher courts in earlier similar cases. Delegated legislation made by government ministers also supplements statute law.

2. Criminal Law: Actus Reus and Mens Rea | 刑法:犯罪行为与犯罪意图

For most crimes, the prosecution must prove both actus reus (the guilty act) and mens rea (the guilty mind). Actus reus can be a voluntary act, an omission where a duty exists, or a state of affairs. The conduct must be voluntary; the defendant cannot be convicted if their action was involuntary, for example due to an epileptic seizure.

Mens rea encompasses several levels: direct intent (the defendant aims to bring about a consequence), oblique intent (the consequence is a virtual certainty and the defendant appreciates this, as in R v Woollin), and recklessness (taking an unjustified risk, with subjective foresight of that risk – the Cunningham test). For some offences, negligence or gross negligence suffices.

Strict liability offences require no proof of mens rea; only the actus reus must be established. These are usually regulatory or public safety crimes, such as under the Food Safety Act 1990. The lack of a blameworthy mind is not a defence, making it easier for the prosecution to secure a conviction.

3. Homicide: Murder and Voluntary Manslaughter | 杀人罪:谋杀与自愿误杀

Murder is the unlawful killing of a reasonable person in being under the Queen’s peace with malice aforethought. Malice aforethought means an intention to kill or to cause grievous bodily harm (GBH). The victim must be a human being and the death must occur within a year and a day of the act (Law Reform (Year and a Day Rule) Act 1996).

谋杀是在君主和平下,怀着恶意预谋非法杀害理性人。恶意预谋指意图杀人或造成严重身体伤害。受害者必须是人类,死亡须在行为发生后一年零一天内发生(1996 年《法律改革(一年零一天规则)法》)。

Voluntary manslaughter arises when a defendant would be guilty of murder but has a partial defence. The two main partial defences are diminished responsibility (Homicide Act 1957, s.2, as amended) and loss of control (Coroners and Justice Act 2009). If either defence succeeds, the conviction reduces from murder to manslaughter.

自愿误杀指被告本应构成谋杀,但有部分抗辩。两个主要部分抗辩是减轻责任(1957 年《杀人法》第 2 条,经修订)和失控(2009 年《验尸官和司法法》)。如果任一抗辩成功,定罪将从谋杀减为误杀。

Diminished responsibility requires an abnormality of mental functioning arising from a recognised medical condition that substantially impaired the defendant’s ability to understand their conduct, form a rational judgment, or exercise self-control. Loss of control must be triggered by a qualifying trigger, such as a fear of serious violence, and a person of the defendant’s sex and age might have reacted similarly.

减轻责任要求存在由公认医学状况引起的心理功能异常,实质性损害被告理解其行为、形成理性判断或行使自我控制的能力。失控必须由合格触发因素引发,例如对严重暴力的恐惧,且与被告性别和年龄相同的人可能做出类似反应。


4. Involuntary Manslaughter and Non-Fatal Offences | 非自愿误杀与非致命侵害

Involuntary manslaughter covers cases where the defendant caused death without the mens rea for murder. The two main forms are unlawful act manslaughter (constructive manslaughter) and gross negligence manslaughter. Unlawful act manslaughter requires an intentional, unlawful and dangerous act that caused death. The act is dangerous if a reasonable person would foresee some harm (R v Church).

非自愿误杀涵盖被告造成死亡但无谋杀意图的案件。两种主要形式是非法行为误杀(推定误杀)和重大过失误杀。非法行为误杀要求存在故意、非法且危险的行为,该行为导致死亡。如果合理人可预见某种伤害,该行为即为危险(R v Church 案)。

Gross negligence manslaughter requires the existence of a duty of care, a breach of that duty, and gross negligence so serious that it amounts to a crime. The jury must decide whether the conduct was so bad as to deserve criminal punishment (R v Adomako).

Non-fatal offences against the person include assault, battery, assault occasioning actual bodily harm (ABH, s.47 OAPA 1861), malicious wounding or inflicting GBH (s.20), and wounding or causing GBH with intent (s.18). ABH requires harm that is more than transient, while s.18 demands specific intent to cause serious harm.
