In Tomlinson v Congleton BC [2004], the House of Lords held that an occupier does not have to protect against risks willingly accepted by a trespasser.

In Huang v Secretary of State for the Home Department [2007], the House of Lords emphasised that domestic courts must make their own value judgement on proportionality rather than automatically deferring to the public authority.

Insanity (M’Naghten Rules) and non-insane automatism negate the voluntariness of the act or mens rea, leading to a special verdict or a full acquittal respectively. In the exam, always ask: could this defence subtract liability even if the formula seems satisfied?
