1. Exam Format and Mark Allocation |
The mock paper mirrors the style of OCR’s Paper 1, Section B: Criminal Law. It contains four compulsory questions totalling 60 marks, to be completed in 75 minutes. The first question is a 10-mark ‘Distinguish between’ task testing precise legal definitions. The second is a 15-mark discussion question demanding detailed knowledge of actus reus, mens rea, and key authorities. The third presents a scenario worth 20 marks where you must apply the law to facts. The fourth is a 15-mark evaluation question requiring critical analysis of reform proposals.
Time management is vital: spend roughly 1.2 minutes per mark. Allocate about 12 minutes for the 10-mark question, 18 minutes for the 15-markers, and 24 minutes for the 20-mark scenario. Always read the scenario twice and use the highlight function to identify potential offences before you begin writing. Examiners consistently report that rushed scenario answers often misidentify the key offence, which limits the available marks from the start.
Also note that AO1 (knowledge and understanding) and AO2 (application and analysis) are weighted roughly equally, while AO3 (evaluation) appears predominantly in the final question. Your answers must reflect these assessment objectives: description and authority for AO1, application to the given facts for AO2, and sustained critical commentary on proposals for AO3.
还需注意,AO1(知识与理解)和 AO2(应用与分析)的权重大致相当,而 AO3(评价)主要体现在最后一题中。
2. Question 1: Distinguishing Assault and Battery |
The phrase ‘Distinguish between assault and battery’ tests precise knowledge of the actus reus and the fact that these are two separate, summary offences under s.39 Criminal Justice Act 1988. A strong answer begins by defining assault: any act which intentionally or recklessly causes the victim to apprehend immediate unlawful personal violence, citing R v Ireland; R v Burstow [1998] and Smith v Superintendent of Woking Police Station (1983). Battery is then defined as the intentional or reckless application of unlawful force on another, with authority like Collins v Wilcock [1984] and Fagan v Metropolitan Police Commissioner [1969].
Examiners want to see clear contrasts: assault requires apprehension of immediate force, not physical contact; battery involves actual infliction of force, however slight. Words, silence, or gestures can constitute assault, while battery requires a positive act. Use a comparative structure: state the rule for assault, then immediately contrast it with battery on the same point. Avoid writing two separate blocks — interweaving demonstrates higher-level synthesis.
A common mistake is stating that assault requires physical contact or confusing the mens rea with the actus reus. Remember, both offences can be committed intentionally or recklessly under R v Venna [1976], but the subjective test applies: was the defendant aware of the risk and did they unreasonably take it? Memorising the key case names and a brief fact can turn a 6-mark answer into a 9 or 10.
3. Question 2: Discussing ABH and GBH |
This 15-mark question typically asks you to discuss the offences of assault occasioning actual bodily harm (s.47 OAPA 1861) and wounding or inflicting grievous bodily harm (s.20 and s.18 OAPA 1861). Begin by identifying each offence as triable either way (s.47, s.20) or indictable only (s.18), alongside their maximum sentences: 5 years, 5 years, and life imprisonment respectively. This contextual placement shows mature legal awareness.
For s.47 ABH, the actus reus is an assault or battery that causes actual bodily harm. Define ABH as ‘any hurt or injury calculated to interfere with the health or comfort of the victim’, based on R v Miller [1954], and note it includes psychiatric harm under R v Chan-Fook [1994] but not mere emotions. The mens rea is the same as for assault or battery — you do not need to prove intention or recklessness as to the harm itself, affirmed in R v Roberts (1971).
Move to s.20 malicious wounding or inflicting GBH. Define ‘wound’ as a break in the continuity of the whole skin (JJC (A Minor) v Eisenhower [1984]) and GBH as ‘really serious harm’ (DPP v Smith [1961]), noting that harm can be assessed in the context of the victim’s pre-existing condition (R v Bollom [2004]). The mens rea is ‘maliciously’, meaning intentionally or recklessly as to some harm, however minor (R v Mowatt [1968]). For s.18, the wounding or causing GBH must be done with intent to cause GBH or to resist arrest, carrying a life sentence. Contrasting the mens rea of s.20 and s.18 is essential to show analytical depth.
Many students lose marks by conflating ‘inflicting’ with ‘causing’ or by omitting the thin skull rule analysis in the scenario. Always explain that causation principles apply, and that the defendant takes their victim as they find them. Use a short comparison table in your answer if it helps you organise the distinctions, but ensure it is embedded within full prose.
4. Question 3: Applying the Law to a Scenario |
Scenario questions account for the largest single allocation of marks in the unit test. A typical scenario will involve a series of interactions — a heated argument, a push, a punch, a fall resulting in injury — and you must identify the potential offences against each person. Use the IDAR structure: Identify the potential offence, Define the relevant law, Apply the law to the facts, Reach a conclusion on each charge.
When applying, mirror the language of the legal test. For instance, if a defendant waves a fist and shouts, ‘You’re dead!’, discuss whether the victim apprehended immediate unlawful force — consider the physical proximity and any words negating immediacy (Tuberville v Savage [1669]). If a push leads to a fracture, trace the chain of causation and consider whether the harm amounts to ABH or GBH. Always mention the thin skull rule and confirm there is no intervening act.
A top-tier answer will also consider possible alternative offences. If a punch dislodges a tooth, you could charge either s.47 ABH or s.20 GBH depending on the severity. Discuss both options briefly, justifying your preferred charge. This demonstrates critical analysis and pushes the answer into the highest mark band. Do not forget to include a reasoned conclusion for every individual — a simple ‘liable’ without justification loses valuable AO2 marks.
Finally, deal with the scenario’s characters separately and clearly. Use subheadings such as ‘Liability for the initial altercation’ and ‘Liability for the injuries sustained in the fall’ to signpost your answer. Examiners reward clarity and structure as much as legal accuracy.
5. Question 4: Evaluating Reform Proposals |
The evaluation question invites you to critically discuss areas of the law on non-fatal offences that have been criticised and proposals for reform. Common targets include the archaic language of the Offences Against the Person Act 1861, the illogical hierarchy of offences, and the mismatch of mens rea in s.47. Reference to the Law Commission’s 1993 consultation paper and 2015 scoping report is essential here.
Start by stating the current law’s key problems: the language is obscure (‘maliciously’, ‘occasioning’), the fault element for s.47 is disproportionate because the same mens rea as minor assault leads to a much greater sentence, and s.20 and s.18 both involve GBH but the mens rea distinction is difficult for juries. Then outline the Law Commission’s draft Offences Against the Person Bill, which proposed a modern hierarchy: intentional serious injury, reckless serious injury, intentional minor injury, reckless minor injury, and a simple assault offence.
To reach the highest marks, you must present a balanced argument. Acknowledge that the 1993 proposals were never enacted, and discuss reasons for this, such as parliamentary reluctance to reform a Victorian statute that courts have interpreted workably. Also consider more recent developments like the 2020 Domestic Abuse Act’s emphasis on non-fatal strangulation and suffocation, which demonstrates that piecemeal reform may be more achievable.
Conclude with your own reasoned view. Perhaps argue that while wholesale codification is desirable, targeted amendments resolving the s.47 mens rea anomaly and simplifying definitions would be a pragmatic first step. Avoid one-sided rants; examiners reward nuance and the ability to engage with the complexity of law reform.
6. Common Mistakes That Lose Marks |
One recurring mistake is defining battery as requiring injury. Battery can be the merest touching; it is an infringement of personal autonomy. Students who write ‘battery is when you hit someone and cause a bruise’ essentially describe ABH and start from a flawed foundation. Always separate the basic assault and battery from the aggravated offences.
Another common pitfall is misapplying the thin skull rule. The rule does not make the defendant liable for harm they did not cause; it means the defendant cannot escape liability because the victim suffers more than expected due to a pre-existing condition. In scenario answers, explicitly state that the defendant takes the victim as they find them, citing R v Hayward (1908) or R v Blaue [1975] for the broader principle.
Many candidates also ignore the time allocation signal in the question wording. A ‘discuss’ question requires more than pure description — it requires explanation supported by cases. An ‘evaluate’ question demands AO3, not just a summary of the law. Under-responding to the command verb directly caps your mark. Finally, avoid using informal language: write ‘the defendant’s actions’, not ‘what the bad guy did’.
7. Model Answer Extract: S.47 ABH Application |
Below is a model paragraph for applying s.47 to a scenario in which the defendant pushes the victim, who stumbles and cuts their arm on a broken glass, requiring stitches. This extract demonstrates how to weave together authority, definition, and facts.
English model: ‘The initial push plainly constitutes a battery, being the intentional application of unlawful force (Collins v Wilcock). The resulting cut that required stitches amounts to actual bodily harm, defined as “any hurt or injury calculated to interfere with the health or comfort of the victim” (R v Miller). Although the defendant only intended the push and not the injury, the mens rea for s.47 is the same as for the battery (R v Roberts). Applying the causation principles, the push was the factual and legal cause of the cut. Applying the thin skull rule, the defendant takes the victim as they find them, and the unexpected presence of broken glass does not break the chain of causation. Therefore, the defendant is liable for assault occasioning actual bodily harm under s.47.’
Notice how the paragraph references three cases, defines ABH, addresses mens rea and causation, and concludes definitively. A full-scenario answer would repeat this precision for each potential offence. Practice replicating this style until it becomes second nature.
8. Understanding Marking Criteria and Grade Boundaries |
OCR Law mark schemes are divided into levels for each assessment objective. For a 10-mark AO1 question, Level 4 (9-10 marks) requires accurate, detailed knowledge with clear reference to relevant cases and statutes. For application questions, AO2 is graded by the extent to which the law is linked to the scenario facts. AO3 evaluation marks reward logical reasoning, the use of counter-arguments, and a clear conclusion.
Typical unit test boundaries might set an A at around 80%, but this varies. What matters is that your script demonstrates a ‘Level 4’ quality consistently, regardless of the numerical boundary. Use terminology like ‘actus reus’, ‘mens rea’, ‘thin skull rule’, and ‘subjective reckless’ to show command of the subject. Never use evaluative phrases like ‘it is unfair’ without substantive reasoning — fairness arguments only have weight when tied to specific legal principles.
Examiners also reward judicial awareness: comment on whether a trial would be in the magistrates’ or Crown Court, mention maximum sentences, and note defence availability. This wider knowledge can lift a borderline answer into the next level, so integrate it where relevant.
9. Targeted Revision Tricks for Non-Fatal Offences |
Create a single A4 summary grid with columns: offence, section, actus reus (with cases), mens rea (with cases), maximum sentence, and triable status. Condensing the information on one page forces you to prioritise key elements and aids memory retention. Use colour coding: red for s.18 due to its specific intent and life sentence, amber for s.20, green for s.47, and blue for the basic offences.
Every time you review a case, recite the ratio decidendi in one sentence and identify how it applies to a hypothetical scenario. For example, for R v Ireland you would state: ‘Silence can amount to an assault when it causes the victim to apprehend immediate unlawful violence.’ Then mentally place it in a set of facts: repeated silent phone calls to a person in a locked house at night. Active retrieval in context builds neural pathways that are easier to activate in the exam hall.
Pair study with timed writing. Set a timer for 10 minutes and attempt a distinction question under pressure. Nothing exposes gaps like a clock. After writing, self-mark using the official OCR mark scheme and highlight every instance where you used a case name or a legal term. This deliberate practice bridges the gap between knowledge and performance.
10. Final Preparation and Exam-Day Strategy |
In the final days before the unit test, focus on polishing your application technique rather than cramming every case. Re-read the scenario questions you have attempted and the model answers attached to them. Pay close attention to the phrasing of causation and the way liability is attributed to each party. If you have access to past examiner reports, read them — they reveal exactly what examiners loved and what they penalised.
On the exam day, start with the scenario question if you are confident in your application skills, or the knowledge-based question if you want a confidence boost. Do not linger on a single sub-point: if you cannot recall a case name, use a descriptive phrase like ‘the case where silent phone calls were held to be an assault’ and move on. The mark scheme often allows credit for the principle even without the case name, while time lost can never be recovered.
