2. Question 1: Distinction between Law and Morality |

Question: Explain the distinction between law and morality and discuss whether the law should enforce moral values. (9 marks)

Analysis: Law consists of rules made by the state and backed by sanctions; morality refers to society’s shared values and beliefs about right and wrong. They overlap in areas such as murder, but diverge on issues like euthanasia. The Wolfenden Report (1957) argued that the law should not intervene in private moral conduct, while Lord Devlin’s ‘enforcement of morality’ view held that a shared morality is essential to social cohesion. A balanced answer acknowledges both the Harm Principle and the difficulty of drawing a clear boundary.

Examiners look for references to Hart-Devlin debate and specific examples such as the Sexual Offences Act 1967, which partially decriminalised homosexual acts. Strong answers will evaluate whether legal moralism is justifiable in a pluralist society.

3. Question 2: Statutory Interpretation – The Golden Rule |

Question: Describe the golden rule of statutory interpretation and illustrate how it has been applied in a decided case. (5 marks)

Analysis: The golden rule is an extension of the literal rule, used when the literal meaning would produce an absurd result. There are two versions. The narrow approach applies where a word has more than one meaning; the court selects the meaning that avoids absurdity. In R v Allen (1872), ‘marry’ could mean both ‘to undergo a ceremony’ and ‘to become legally wed’. The defendant, already married, argued he could not ‘marry’ again in the legal sense. Applying the literal meaning would have created an absurdity – the offence of bigamy would be unworkable – so the court chose the ceremony meaning. The wide approach, used when words are clear but lead to an absurd outcome, was seen in Re Sigsworth (1935): a son who murdered his mother was prevented from inheriting her estate despite the clear words of the intestacy statute.

When using the golden rule, always state which approach was used and why the literal result was absurd. A well-selected case ensures high marks even in a short-answer question.

4. Question 3: Role of Juries in Criminal Trials |

Question: Explain the role of juries in the Crown Court and evaluate the arguments for and against their use. (12 marks)

Analysis: The jury’s primary function is to decide matters of fact and return a verdict based on the evidence. The judge directs them on the law. Jurors are randomly selected from the electoral register under the Juries Act 1974. Arguments in favour include democratic participation, protection against oppressive prosecution (‘jury equity’), and the application of community standards. Arguments against centre on complexity of fraud trials, risk of media influence, lack of comprehension of legal directions, and inconsistency of verdicts. The Criminal Justice Act 2003 allowed judge-alone trials in complex fraud cases, reflecting concern over juror competence.

Evaluation requires both breadth and depth. Cite research such as the Roskill Report, which recommended specialist tribunals for fraud, and contrast it with the public confidence argument – juries are seen as a bastion against state power. A balanced conclusion is expected.

5. Question 4: Criminal Law – Transferred Malice |

Question: Define transferred malice and apply it to a scenario where D intends to hit V1 but misses and hits V2, causing actual bodily harm. (5 marks)

Analysis: Transferred malice is a doctrine where D’s intent to commit an offence against one victim is transferred to the unintended victim who suffers the harm. The leading case is R v Latimer (1886): D aimed a belt at A but struck B, cutting her face. The court held that D’s mens rea for the assault on A could be transferred to the battery on B. The principle applies only where the actus reus and mens rea coincide in the same offence type. If D throws a stone intending to hit a person but breaks a window, transferred malice will not create criminal damage liability because the mens rea does not match the actus reus (R v Pembliton 1874). In the scenario, D intends to cause assault/battery to V1; missing and hitting V2 applies transferred malice straightforwardly, making D liable for ABH against V2.

When answering, always confirm that the mens rea and actus reus are of the same kind. Use Latimer to explain the transfer and Pembliton to outline the limitation.

6. Question 5: Non-fatal Offences – Assault and Battery |

Question: Distinguish between assault and battery, and discuss whether they require physical contact. (5 marks)

Analysis: Assault is defined as intentionally or recklessly causing the victim to apprehend immediate unlawful personal violence. It requires no physical contact; words or gestures that create fear of imminent harm suffice, as in R v Ireland (1997) where silent phone calls constituted an assault. Battery, on the other hand, is the intentional or reckless application of unlawful physical force. Contact is essential, but it need not be hostile in the everyday sense – any touching without consent can be a battery, as shown in Collins v Wilcock (1984) where a police officer grabbing a woman’s arm without lawful authority committed battery. Both offences are common law and are charged under s.39 Criminal Justice Act 1988.

A clear answer will contrast the two: assault is about apprehension of force, battery about actual infliction of force. Highlight that words can negate an assault (Tuberville v Savage 1669) and that everyday jostling is not battery if it is part of ordinary life.

7. Question 6: Defence of Consent |

Question: Explain the defence of consent in non-fatal offences and discuss the limitations of the defence in cases involving serious harm. (8 marks)

Analysis: Consent can operate as a full defence to assault and battery if the victim freely and genuinely agreed to the contact. However, the defence is limited by public policy. In R v Brown (1994), the House of Lords held that consent is not a defence to actual bodily harm or more serious injury inflicted during sado-masochistic activities, because it is not in the public interest to allow persons to consent to serious harm. Exceptions exist for socially acceptable activities such as surgery, contact sports, and tattooing. In R v Wilson (1996), branding a wife’s buttocks with her consent was deemed analogous to tattooing and thus lawful. The key distinction in Brown was the lack of social utility and the serious nature of the injuries.

When evaluating, discuss the balance between autonomy and paternalism. The Law Commission has proposed reform to clarify the limits of consent; an effective answer could mention this.

8. Question 7: Tort Law – Duty of Care in Negligence |

Question: Explain how the courts establish a duty of care using the Caparo test. Apply the test to a scenario involving pure economic loss. (10 marks)

Analysis: The Caparo test, derived from Caparo Industries v Dickman (1990), requires three elements: (1) the damage was reasonably foreseeable; (2) there was a relationship of proximity between the parties; and (3) it is fair, just and reasonable to impose a duty. Foreseeability is assessed objectively – would a reasonable person in D’s position have foreseen harm? Proximity can be physical, relational or causal. The third limb allows policy considerations. In cases of pure economic loss, the courts have been restrictive. In Spartan Steel & Alloys Ltd v Martin & Co (1973), loss of profit caused by a power cut was held not recoverable in negligence because it was pure economic loss absent physical damage to the claimant’s own property. Applying the Caparo test, a court would weigh the foreseeability of financial harm against the policy fear of ‘liability in an indeterminate amount for an indeterminate time to an indeterminate class’.

In scenario answers, walk through each Caparo stage explicitly. Mention incrementalism – courts prefer to develop duties in small steps rather than giant leaps.

9. Question 8: Occupiers’ Liability |

Question: Outline the key provisions of the Occupiers’ Liability Act 1957 regarding lawful visitors, and discuss the duty owed to children. (8 marks)

Analysis: The Occupiers’ Liability Act 1957 imposes a common duty of care on occupiers towards all lawful visitors. Under s.2(2), the duty is to take such care as is reasonable in all the circumstances to see that the visitor is reasonably safe in using the premises for the purposes for which they are permitted to be there. The Act specifically acknowledges that an occupier must be prepared for children to be less careful than adults (s.2(3)(a)). In Glasgow Corporation v Taylor (1922), a child ate poisonous berries from a bush in a public park; the corporation was liable because the berries were an ‘allurement’ and the child could not appreciate the risk. However, where the danger is obvious, an occupier may argue that a child of sufficient age and understanding should have appreciated it. The duty can be discharged through warnings, but not to very young children (Phipps v Rochester Corporation 1955).
