In reality, law and morality are distinct systems of social control. Law is a set of enforceable rules created by parliament or the courts, backed by sanctions. Conversely, many regulatory offences carry no moral stigma. The marital rape case R v R (1991) shows the law evolving to reflect modern moral standards, but the two are never fully aligned.

Mens rea refers to the mental element defined for the specific crime, usually intention or recklessness. Ignorance of the law is generally no defence, so a defendant need not know an act is illegal to be liable; the mental state required is not about legal knowledge but foresight of consequences.

Strict liability means no mens rea is required for at least one element of the actus reus, but it is not absolute. In Sweet v Parsley (1970), the House of Lords held that a presumption of mens rea exists unless a statute clearly indicates otherwise. Even where strict liability applies, it simply shifts the burden of proving absence of fault, not abolishing all defences.

Causation in criminal and tort law involves two layers. First, factual causation uses the ‘but for’ test (R v White 1910). While an intervening act of a third party or a freak event can break the chain, the thin skull rule (R v Blaue 1975) holds that the defendant takes the victim as found. Hence, an unforeseeable physical vulnerability does not break the chain, but a new independent act may.

In English law, most contracts can be formed orally, in writing, by conduct, or by a combination of these, so long as there is offer, acceptance, consideration, and an intention to create legal relations. Only a small number of contracts, such as those for the sale of land (Law of Property (Miscellaneous Provisions) Act 1989), must be made in writing. A handshake, an email, or even conduct at a checkout can create a perfectly enforceable contract. The key is evidence of agreement, not formality per se.

In the tort of negligence, a duty of care is not automatic. Since Caparo Industries plc v Dickman (1990), courts apply a three-part test: (i) was the harm reasonably foreseeable? (ii) is there a relationship of proximity between the parties? (iii) is it fair, just and reasonable to impose a duty? Previous expansive approaches (Donoghue v Stevenson’s neighbour principle) are now considered within this framework. Policy considerations can restrict the scope of duty, meaning that some foreseeable losses may be left uncompensated to avoid floodgates.

Causation establishes a link between breach and damage; remoteness caps liability for policy reasons. The current test for remoteness in negligence comes from The Wagon Mound (No 1) (1961): damage is not too remote if the type of damage was reasonably foreseeable, even if the precise extent was not. The thin skull rule allows recovery for the full extent of personal injury once the type is foreseeable. However, where the damage is of an unforeseeable type (e.g., fire damage when only fouling was foreseeable), the claim fails despite a proven causal link.

In the Crown Court, the jury’s role is to decide the facts and to return a verdict of guilty or not guilty based on those facts and the law as explained by the judge. The jury must apply the law as directed; they do not create, amend, or ignore it. Although juries can technically return a perverse verdict, this is not a recognised legal power and is discouraged.

In practice, many words in statutes are ambiguous, broad, or outdated. Courts must interpret them using recognised rules: the literal rule (give words their plain meaning), the golden rule (modify the literal sense to avoid an absurdity), the mischief rule (look at the gap in the previous law), and the purposive approach (interpret to give effect to parliament’s purpose). Internal and external aids, such as the Interpretation Act 1978 or Hansard, assist. Cases like Whitely v Chappell (1868) show how a literal reading can produce the absurd result that a dead person cannot vote, thus defeating the purpose of the statute.
