Common Misconceptions in GCSE AQA Law and How to Correct Them | GCSE AQA

📚 Common Misconceptions in GCSE AQA Law and How to Correct Them | GCSE AQA

Many GCSE AQA Law students struggle with recurring misconceptions that cost them marks in exams. Understanding these pitfalls and learning how to correct them can dramatically improve performance. This article identifies ten common misunderstandings in the AQA specification and provides clear corrections.

1. Confusing Actus Reus and Mens Rea |

Many students believe that every crime must have both a physical act (actus reus) and a guilty mind (mens rea) that occur simultaneously. They assume the actus reus is always a positive action and the mens rea is always an intention.

In reality, the actus reus can be a state of affairs or an omission where a duty to act exists, such as parental neglect. Moreover, mens rea can take forms like recklessness or negligence, not only intention. Critically, strict liability offences do not require proof of mens rea for at least one element of the actus reus.

2. Misunderstanding Strict Liability |

Students often think that if a crime is strict liability, the defendant must be guilty regardless of any excuse, and that no form of fault is required at all.

While strict liability means the prosecution need not prove mens rea (such as for selling alcohol to underage customers), it does not remove all defences. Defendants may still raise defences like due diligence (where recognised by statute) or statutory defences. However, at GCSE level, the key point is that strict liability eases the prosecution’s burden of proof but does not make a conviction automatic if a defence applies.

3. Thinking All Unlawful Killings Are Murder |

A common exam error is to label any unlawful killing as murder, overlooking the essential mens rea for murder: an intention to kill or cause grievous bodily harm.

If a defendant kills without that intent, the offence is manslaughter. Voluntary manslaughter arises when murder is reduced due to partial defences like diminished responsibility or loss of control. Involuntary manslaughter occurs where death results from an unlawful and dangerous act (constructive manslaughter) or gross negligence. Recognising the distinction is crucial for accurate problem-solving.

4. Assuming a Duty of Care Exists in Every Injury Case |

Students frequently assume that whenever someone is injured, the person who caused the injury automatically owes a duty of care in negligence.

In tort law, a duty of care must be established using the Caparo test: foreseeability of harm, proximity between parties, and whether it is fair, just and reasonable to impose a duty. Not all losses are recoverable; for example, pure economic loss is generally not covered unless there is a special relationship. The neighbour principle from Donoghue v Stevenson sets the starting point, but subsequent cases have limited its scope.

5. Confusing Civil and Criminal Court Structures |

Learners often mix up which courts handle criminal cases and which deal with civil disputes, or think that the same court can try all matters.

Criminal cases start in the Magistrates’ Court (minor offences) or are sent to the Crown Court for serious offences. Civil claims are heard in the County Court or High Court depending on value and complexity. The burden of proof also differs: ‘beyond reasonable doubt’ in criminal, and ‘on a balance of probabilities’ in civil. Appeals follow distinct routes: from Magistrates’ to Crown Court or High Court (by way of case stated), and from Crown Court to Court of Appeal.

6. Believing All Courts Can Create Binding Precedent |

A persistent myth is that any court decision becomes a binding precedent for lower courts, and that judges can simply choose to ignore precedents they dislike.

Only decisions from certain courts are binding. The Supreme Court binds all courts below it. The Court of Appeal binds itself and lower courts, subject to Young’s case exceptions. Decisions of the High Court bind lower civil and criminal courts but not the High Court itself. Magistrates’ and Crown Courts do not create binding precedents. Judges follow the doctrine of stare decisis, and only depart from precedents using the Practice Statement 1966 in the Supreme Court (or appropriate exceptions).

7. Overstating Parliamentary Sovereignty as Absolute |

Many answers treat parliamentary sovereignty as an unfettered power, ignoring constraints like EU law (before Brexit) and human rights legislation.

While Parliament can pass any law and cannot bind its successors, sovereignty has been limited by external factors. Under the European Communities Act 1972, EU law took precedence over UK law. Although the UK left the EU, the concept highlights that sovereignty can be voluntarily limited. The Human Rights Act 1998 requires courts to read legislation compatibly with the European Convention on Human Rights, and if not possible, issue a declaration of incompatibility – which does not invalidate the law but puts pressure on Parliament. Additionally, devolution has transferred some powers to Scotland, Wales and Northern Ireland.

8. Misapplying the Principle of Transferred Malice |

Students incorrectly transfer malice when the actual crime is different in type from the intended crime, believing the intent automatically ‘follows’ the harm.

Transferred malice operates when the defendant has the mens rea for a crime against one victim, but the actus reus is committed against another victim — and the offence is the same criminal type. For example, if D intends to punch A but strikes B, the intent to assault A transfers to B. However, if D intends to throw a brick at a person but misses and breaks a window, the intent to injure cannot transfer to a property offence; malice does not transfer across different categories of crime.

9. Confusing ABH and GBH Under the Offences Against the Person Act 1861 | 混淆1861年人身侵害法中的ABH与GBH

Learners often struggle to differentiate actual bodily harm (ABH) from grievous bodily harm (GBH), guessing based on the weapon used or the severity of the victim’s injury without applying legal definitions.

ABH under s.47 requires assault or battery occasioning actual bodily harm, which is any hurt or injury calculated to interfere with the health or comfort of the victim. It can include psychiatric harm but not mere fear or emotion. GBH under s.20 is a malicious infliction of grievous bodily harm, meaning ‘really serious harm’, or wounding. GBH under s.18 requires intent to cause GBH or resist arrest. The key is to apply legal thresholds rather than personal impressions; ABH can include minor abrasions, whereas GBH requires serious long-term damage.

10. Believing Police Always Need an Arrest Warrant |

A widespread misconception among students is that the police cannot
