1. Understanding Democracy: Direct vs. Representative |

Democracy means ‘rule by the people’. In a direct democracy, citizens make decisions themselves, for example through referendums on issues like Brexit or Scottish independence. In a representative democracy, citizens elect representatives to make decisions on their behalf, which is the system used in the UK Parliament.

A common exam mistake is to treat the UK as a purely representative democracy and ignore the use of direct democratic mechanisms. Students often miss that the 2016 EU referendum and local referendums are elements of direct democracy operating within a representative framework. Ensure you can explain advantages (e.g. direct democracy gives a clear public voice on a single issue) and disadvantages (e.g. it can lead to ‘tyranny of the majority’) of both systems.

2. The UK Constitution: Codified vs. Uncodified |

The UK constitution is uncodified, meaning it is not written in a single document. Instead, it comes from multiple sources: statute law (Acts of Parliament), common law (judge-made law), conventions (unwritten rules), works of authority (textbooks) and EU treaties (though these are now replaced by retained EU law and new trade agreements). Many students confuse ‘uncodified’ with ‘unwritten’, which is a serious error because much of the UK’s constitutional rules are indeed written down in statutes and law reports.

The key mistake is using the USA as a direct comparison without understanding the UK’s flexibility. AQA questions often ask for one advantage and one disadvantage of an uncodified constitution. Advantage: it is flexible and can adapt quickly, e.g. the introduction of the Fixed-term Parliaments Act 2011 (later repealed) was passed as a statute. Disadvantage: it can lead to uncertainty because conventions are not legally enforceable. Do not claim the UK has no constitution – it does, just not a codified one.

3. Parliament and Government: Roles and Responsibilities |

Parliament and government are not the same. Parliament comprises the House of Commons, the House of Lords and the monarch; its main functions are legislation, scrutiny, representation and debate. The government is formed by the political party (or coalition) with the most MPs in the Commons, led by the Prime Minister, and is responsible for running the country and proposing new laws.

A classic pitfall is confusing the executive with the legislature. In exams, students often write that ‘Parliament runs the country’. This is inaccurate; the government runs the country while Parliament holds it to account. When describing the role of backbench MPs, avoid implying they merely follow the whip; they can also scrutinise through select committees and raise their constituents’ concerns. Remember to link the House of Lords’ revising role to the Parliament Acts 1911 and 1949, which limit its power to delay Bills.

4. Voting Systems: First Past the Post vs. Proportional Representation |

The UK uses First Past the Post (FPTP) for general elections. In each constituency, the candidate with the most votes wins, even if they do not secure a majority. This tends to produce strong, single-party governments but can result in wasted votes and disproportionate representation. Proportional representation (PR) systems, used in Scottish Parliament and Welsh Senedd elections, aim to match the percentage of seats a party gets to its share of the vote.

A very common mistake is to assert that FPTP always creates a majority government. While it often does, 2010 and 2017 produced hung parliaments. Make sure you can explain that under FPTP, a party can win a seat with less than 50% of the vote, and use specific examples like the 2015 election where UKIP won 12.6% of the vote but only one seat. For PR, do not claim it is ‘more democratic’ without justification; explain that it reduces wasted votes but can lead to coalition governments that may be seen as unstable.

5. Rights and Responsibilities: Legal, Moral and Human Rights |

Legal rights are enforceable by law in UK courts, such as the right to a fair trial under the Human Rights Act 1998 or contract law. Moral rights are based on ethical principles and are not legally binding – for instance, a perceived ‘right’ to affordable housing, which may be a political aspiration rather than a justiciable claim. Human rights are universal and protected by international agreements like the European Convention on Human Rights.

An easy mistake is to label all rights as legal. In an exam, if you are asked to give one example of a moral right, do not say ‘the right to education’ because in the UK this is a legal right under statute. Instead, use ‘the right to die with dignity’ or ‘the right to free speech on private social media platforms’, which may be seen as moral rather than strictly legal. Always refer to the Human Rights Act 1998 when discussing how Convention rights are implemented in UK law, and remember that it is not the same as the European Union’s Charter of Fundamental Rights.

6. The Legal System: Civil vs. Criminal Law |

Criminal law deals with offences against the state, such as theft or murder. The state prosecutes the defendant, and the outcome is punishment (imprisonment, fine, community order). The standard of proof is ‘beyond reasonable doubt’. Civil law resolves disputes between individuals or organisations – for example, contract disputes, negligence – and provides remedies like damages or an injunction. The standard of proof is ‘on the balance of probabilities’.

Students frequently confuse the parties and standards. A common error is to say ‘the government prosecutes’ in a civil case. Use the language precisely: in criminal law, the case is R v Smith (Regina versus Smith); in civil law, Smith v Jones. Also, do not say ‘guilty’ in a civil trial – the correct term is ‘liable’. Courts are another muddle: Magistrates’ Courts try summary offences; Crown Court deals with indictable offences; County Court and High Court are for civil matters. Be clear that the same event can give rise to both criminal and civil proceedings (e.g. an assault is a crime and can also lead to a personal injury claim).

7. Sources of Law: Statute, Common, and European Law |

Statute law is made by Parliament. It overrides all other domestic sources because of parliamentary sovereignty. Common law, or case law, is developed by judges through decisions in court and the doctrine of precedent. Historically, European Union law had supremacy over UK law, but since Brexit, retained EU law is now just a form of UK law that can be amended by Parliament. The European Convention on Human Rights is separate from the EU and still influences UK law via the Human Rights Act.

The biggest confusion lies in treating the European Court of Justice (ECJ) and the European Court of Human Rights (ECtHR) as the same. The ECJ interprets EU law and no longer has jurisdiction in the UK except for certain Northern Ireland provisions. The ECtHR hears cases under the European Convention on Human Rights, and the UK remains a signatory. AQA questions often ask for one example of how a statute has changed common law: use the Theft Act 1968, which replaced the common law offence of larceny.

8. Citizenship Action: Active Participation and Pressure Groups |

Active citizenship involves individuals taking part in society to bring about change, whether through voting, joining a pressure group, volunteering or undertaking a campaign for a specific cause. Pressure groups are organisations that seek to influence government policy without seeking office – they can be sectional (representing a specific group, e.g. trade unions) or promotional (focused on a cause, e.g. Greenpeace). Methods range from lobbying MPs, organising demonstrations, using social media, to legal challenges.

In coursework-based or extended-answer questions, pupils often describe their own action project and overlook the evaluation of impact. You must be able to assess the success of a citizenship action by considering both the primary outcomes (e.g. changed school policy) and secondary outcomes (e.g. raised awareness among students). Another typical error is to describe a pressure group as a political party – pressure groups do not field candidates in elections. Be prepared to contrast insider tactics (direct meetings with ministers) with outsider tactics (protests), using real examples like the RSPCA (insider) and Extinction Rebellion (outsider).

9. Public Spending, Taxation and the Welfare State | 公共开支、税收与福利国家

Government raises revenue mainly through taxation – direct taxes (income tax, corporation tax) and indirect taxes (VAT, excise duties). This money is used to fund public services such as the NHS, education, defence and welfare benefits. The welfare state, established after the Beveridge Report, aims to support citizens from ‘cradle to grave’. Key principles include universal access and means-testing. In recent years, debates have centred on austerity and the sustainability of welfare spending.

A very frequent mistake is to state that all benefits are universal. In fact, many benefits, like Universal Credit, are means-tested. When explaining how taxation links to active citizenship, students often forget that paying tax is itself a legal responsibility and a way of contributing to society. In questions about the role of councils, avoid conflating central government funding with local council tax – councils also receive a centrally allocated grant. Use current figures where possible, and refer to the debate over whether higher income tax leads to economic disincentives.

10. Common Exam Technique Errors and How to Avoid Them | 常见答题技巧错误及避免方法

Short-answer questions (1–2 marks) often require a precise definition. For instance, if asked ‘What is meant by a pressure group?’, answering ‘a group that puts pressure on the government’ is circular and will not gain full marks. Instead, define it as ‘an organised group that seeks to influence government policy without standing for election’. Always use technical vocabulary where appropriate – words like ‘legitimacy’, ‘mandate’, ‘accountability’ show deeper understanding.

For longer 8-mark ‘explain’ questions, the most common failure is to list points without developing them. Use the PEEL structure: Point, Evidence/Example, Explanation, Link back to the question. In discuss/evaluate questions, you must present both sides and come to a justified conclusion. A frequent weakness is that students describe the ‘for’ and ‘against’ in separate blocks without linking them, or they forget to state an overall judgement. Always answer the exact question set – if it asks about ‘legitimacy’, do not drift into a general essay on elections.

Managing time is also critical. Many students spend too long on early questions and rush the final 12-mark essay. Practise allocating 1.5 minutes per mark. And never leave a source-based question without referring to the source – your point must be securely grounded in the provided information, not just your own knowledge.
