This handbook sets out the key legal principles, tests and case authorities for CAIE IGCSE / GCSE Law (0984/0972) in the form of ‘formulae’ that you must master. It covers the building blocks of criminal and civil liability, alongside essential procedural and constitutional rules. Use it for quick revision before your examination.

1. General Criminal Formula | 刑事责任通用公式

The foundation of criminal liability can be expressed as:

Actus Reus (AR) + Mens Rea (MR) – Defence = Criminal Liability

Actus reus is the guilty act, which may include an act, omission (where a duty exists), or a state of affairs. It must be voluntary. The chain of causation links the defendant’s conduct to the result. Read the case of R v White (1910) for the ‘but for’ test, and R v Pagett (1983) for intervening acts.

Mens rea is the guilty mind. The main forms are intention (direct or oblique), recklessness (R v Cunningham 1957), and negligence (rare in core criminal law at GCSE). For strict liability offences, no mens rea is needed for at least one element of the actus reus.

A defence negates liability even where AR and MR are present. If a defence succeeds, the formula yields ‘not guilty’.

2. Non-Fatal Offences Against the Person Formula | 人身犯罪公式

The hierarchy of non-fatal offences can be memorised through their elements:

Assault = Apprehension of immediate unlawful force + (intention or recklessness as to causing apprehension)

Battery = Infliction of unlawful force + (intention or recklessness as to the infliction)

Assault occasioning ABH = Assault or Battery + ‘Actually some hurt or injury’ (R v Miller 1954)

Malicious wounding or inflicting GBH (s.20) = (Wound/GBH) + (intention or recklessness as to some harm)

Wounding or causing GBH with intent (s.18) = (Wound/GBH) + (intention to cause grievous bodily harm or resist arrest)

Assault requires the victim to apprehend immediate unlawful force, even if no contact occurs. Words alone can suffice (R v Ireland 1997). Battery is the actual application of unlawful force, which can be the slightest touching (Collins v Wilcock 1984).

For ABH, the harm must be more than transient, as in T v DPP (2003) where temporary loss of consciousness qualified. GBH means really serious harm (DPP v Smith 1961); psychiatric injury can be GBH (R v Burstow 1997).

3. Property Offences Formula | 财产犯罪公式

Theft, robbery and burglary can be reduced to structured checklists:

Theft requires dishonesty: s.2 provides three situations that are not dishonest (belief in legal right, belief in consent, belief the owner cannot be found). The R v Ghosh (1982) test for dishonesty now modified by Ivey v Genting Casinos (2017) asks whether the defendant’s conduct was dishonest by the standards of ordinary reasonable people.

Robbery requires force or threat of force on any person, and it must be used in order to steal. The force need not be substantial.

Burglary s.9(1)(a) does not require that the ulterior offence be committed, only intended at the time of entry. Section 9(1)(b) requires actual commission once inside.

4. Capacity and General Defences | 能力与通用抗辩

Defences operate to remove liability. The general formula is:

AR + MR – (Successfully Raised Defence) = No Guilt

Insanity: The M’Naghten Rules (1843) require that at the time of the act, the defendant was labouring under a defect of reason from disease of the mind, so as not to know the nature and quality of his act or that it was wrong. This is a full defence leading to a special verdict.

精神错乱:《M’Naghten 规则》(1843)要求被告在行为当时,因精神疾病导致理性缺陷,以致不知行为性质或不知行为是错误的。属完全抗辩,导致特殊裁决。

Automatism: Total destruction of voluntary control due to an external factor (R v Quick 1973). If caused by an internal disorder, it is insanity.

Intoxication: Voluntary intoxication is a defence only to specific intent crimes, not basic intent. Involuntary intoxication can be a defence to any crime if MR is absent. DPP v Majewski (1977) clarifies that becoming intoxicated voluntarily is a reckless course of conduct providing the MR for basic intent crimes.

Self-defence / prevention of crime: Governed by s.3 Criminal Law Act 1967 and common law. The force used must be reasonable in the circumstances as the defendant honestly believed them to be (R v Palmer 1971). The defence fails if the force was disproportionate, but a householder defending against an intruder is given greater latitude (s.76 Criminal Justice and Immigration Act 2008).

Duress: Available for all crimes except murder, attempted murder and some forms of treason. It requires a threat of death or serious injury, directed at the defendant or a person for whom he is responsible, which caused the defendant to act as he did (R v Graham 1982). The threat must be immediate and the defendant must show average steadfastness.

5. Fatal Offences and Partial Defences | 致命犯罪与部分抗辩

Murder: AR is the unlawful killing of a reasonable creature in being under the Queen’s peace. MR is intention to kill or cause GBH (R v Vickers 1957).

Voluntary manslaughter: Occurs when murder is reduced by a partial defence.

Diminished responsibility: s.2 Homicide Act 1957 as amended by s.52 Coroners and Justice Act 2009. The defendant must have an abnormality of mental functioning arising from a recognised medical condition which substantially impaired his ability to understand the nature of his conduct, form a rational judgment, or exercise self-control, and which provides an explanation for the killing.

Loss of control: s.54–55 Coroners and Justice Act 2009. The defendant must lose self-control due to a qualifying trigger (fear of serious violence, or things said/done constituting circumstances of an extremely grave character causing a justified sense of being seriously wronged). A person of the defendant’s sex and age with a normal degree of tolerance and self-restraint would have reacted in the same way.

6. Negligence Formula | 过失侵权公式

Negligence is the most important tort at GCSE. Establish liability step-by-step:

Duty of Care + Breach of Duty + Causation + Damage (Not too remote) = Liability

Duty: The neighbour principle from Donoghue v Stevenson (1932) asks whether the defendant ought to have foreseen that the claimant might be injured by his acts. Modern approach: Caparo Industries v Dickman (1990) three-stage test: (1) was damage reasonably foreseeable? (2) is there a relationship of proximity? (3) is it fair, just and reasonable to impose a duty?

Breach: The court applies the objective standard of the reasonable person. Professional standards are higher: Bolam v Friern Hospital Management Committee (1957) test asks whether the defendant acted in accordance with a responsible body of professional opinion. Factors relevant to breach include the magnitude of risk, seriousness of harm, cost of precautions and social utility (Watt v Hertfordshire CC 1954).

Causation: Factual causation uses the ‘but for’ test (Barnett v Chelsea & Kensington HMC 1969). Legal causation requires the defendant’s breach to be an effective and operating cause, and not broken by a novus actus interveniens. Type of damage must be foreseeable: The Wagon Mound (1961).

Damage: The claimant must have suffered an actual loss: personal injury, property damage, or consequential economic loss. Pure economic loss is not recoverable in negligence outside special relationships. Psychiatric harm has special rules (Alcock v Chief Constable of South Yorkshire 1992).

7. Occupiers’ Liability Formula | 占有人责任公式

Occupiers owe a duty to lawful visitors under the Occupiers’ Liability Act 1957, and to trespassers under the Occupiers’ Liability Act 1984.

OLA 1957: Occupier + Visitor + Danger due to state of premises + Breach of common duty of care = Liability

The common duty of care is to take such care as is reasonable to see that the visitor is reasonably safe in using the premises for the purposes for which he is invited or permitted. An occupier can discharge the duty by giving a warning (Roles v Nathan 1963).

The 1984 Act requires the occupier to be aware of the danger, know that a trespasser may come into its vicinity, and the risk is one against which, in all the circumstances, he may reasonably be expected to offer some protection.

8. Rylands v Fletcher and Nuisance | 赖兰兹诉弗莱彻案与妨害

Rylands v Fletcher (1868) imposes strict liability for escape of a dangerous thing. The formula:

Accumulation + Thing likely to do mischief if it escapes + Escape + Non-natural use of land + Damage = Liability

The thing must be brought onto the land and kept there. Non-natural use means some special use bringing with it increased danger to others (Rickards v Lothian 1913). Defences include act of a stranger, default of the claimant, consent, statutory authority and act of God.

Private nuisance: Unlawful interference with a person’s use or enjoyment of land. The court balances the competing interests of neighbours (Miller v Jackson 1977). Factors include locality, duration, sensitivity of claimant and malice. The interference must be unreasonable.

9. Civil Remedies Formula | 民事救济公式

The primary remedy in tort is damages. The aim is to put the claimant in the position they would have been in but for the tort.

Damages = Special Damages (quantifiable losses) + General Damages (non-quantifiable, e.g. pain and suffering)

Special damages cover loss of earnings, medical expenses and damage to property up to the date of trial. General damages cover future losses, pain, suffering and loss of amenity. In personal injury, the lump sum principle applies.

Injunctions: A discretionary equitable remedy, either prohibitory (preventing an act) or mandatory (compelling an act). The court considers whether damages would be an adequate remedy and the balance of convenience. In Miller v Jackson, an injunction was refused despite nuisance being proved.

The doctrine of judicial precedent follows this logic:

Ratio decidendi (binding reason) + Material facts similar + Court hierarchy = Binding Precedent

Obiter dicta are persuasive only. The Supreme Court (formerly House of Lords) is not bound by its own previous decisions but it follows them in the interests of certainty unless it exercises the 1966 Practice Statement. Lower courts are bound by higher courts.

Statutory interpretation tools include the literal rule, golden rule, mischief rule (Smith v Hughes 1960), and purposive approach. Intrinsic aids and extrinsic aids (Pepper v Hart 1993) assist.

11. Police Powers and Basic Rights | 警察权力与基本权利

The Police and Criminal Evidence Act 1984 (PACE) sets the framework for stop and search, arrest, detention and questioning. A lawful arrest requires:

Involvement in an offence + Reasonable grounds for suspicion + Necessity conditions (Code G) = Lawful Arrest

The Human Rights Act 1998 incorporated the European Convention on Human Rights. Article 5 (liberty), Article 6 (fair trial), Article 8 (private life) and Article 10 (expression) are particularly significant. Any interference must be ‘necessary in a democratic society’ and proportionate.
