Law is a set of rules created by the state to regulate behaviour, maintain order, and deliver justice. Unlike moral rules, legal rules are enforceable through the courts and carry sanctions such as fines or imprisonment.

2. Sources of Law | 法律渊源

The two principal sources of law in England and Wales are legislation (statute law) and judicial precedent (case law). Legislation is made by Parliament and includes Acts of Parliament and delegated legislation such as statutory instruments.

Judicial precedent operates through the doctrine of stare decisis, meaning ‘let the decision stand’. Decisions of higher courts bind lower courts, creating consistency and predictability in the legal system. The Supreme Court is the highest authority, and its rulings bind all courts below.

4. Criminal Law: Actus Reus and Mens Rea | 犯罪行为与犯罪意图

To secure a conviction, the prosecution must usually prove two elements: the actus reus (guilty act) and the mens rea (guilty mind). Actus reus can consist of an act, an omission where there is a duty to act, or a state of affairs.

为作出定罪,控方通常必须证明两个要件:犯罪行为和犯罪意图。犯罪行为可由作为、负有作为义务的不作为或特定状态构成。

Mens rea refers to the mental state required for the offence. The main forms are intention (direct or oblique), recklessness (awareness of an unjustifiable risk), and negligence. For some offences, such as strict liability offences, mens rea is not required; only the actus reus must be proved.

5. Homicide: Murder and Manslaughter | 杀人罪:谋杀与非预谋杀人

Murder is the unlawful killing of a reasonable person under the Queen’s peace with malice aforethought, which includes intention to kill or to cause grievous bodily harm (GBH). It carries a mandatory life sentence.

Voluntary manslaughter occurs when a partial defence reduces murder to manslaughter. These defences include loss of control, diminished responsibility, and suicide pact. Common assault and battery are the least serious non-fatal offences. Assault is causing someone to apprehend immediate unlawful force, while battery is the actual application of unlawful force. Both are summary offences.

Actual bodily harm (ABH) under s.47 of the Offences Against the Person Act 1861 is an assault or battery causing bodily harm that is more than transient. Grievous bodily harm (GBH) under s.18 and s.20 requires ‘really serious harm’ and can be committed with intent or recklessness. s.18 GBH with intent carries a maximum life sentence.

Theft is defined in s.1 of the Theft Act 1968 as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. All five elements must be present simultaneously.

Robbery, under s.8, is theft that is aggravated by the use or threat of force immediately before or at the time of the theft. Burglary under s.9 involves entering a building as a trespasser with intent to commit theft, GBH, or criminal damage, or actually committing such an offence once inside.

8. General Defences in Criminal Law | 刑事一般抗辩

Self-defence allows the use of reasonable force to protect oneself, another, or property. The force must be necessary and proportionate to the threat as the defendant honestly believed it to be. Intoxication can be a defence for specific intent crimes if the defendant was involuntarily intoxicated, but voluntary intoxication negates only specific intent, leaving basic intent crimes unaffected.

自我防卫允许使用合理的武力保护自己、他人或财产。武力必须基于被告所确信的威胁而言是必要且相称的。醉酒若是非自愿所致,可作为特定故意犯罪的抗辩;但自愿醉酒仅能否定特定故意,基本故意犯罪不受影响。

Duress arises when the defendant committed the crime under a threat of death or serious injury. It is not available for murder or attempted murder. Consent may be a defence to assault or battery if the act is within the accepted limits of everyday contact or sports, but cannot be used for serious harm as established in R v Brown.

胁迫抗辩适用于被告因面临死亡或严重伤害的威胁而实施犯罪的情形,但不可用于谋杀或谋杀未遂。同意可作为袭击或殴击的抗辩,若该行为属于日常接触或体育运动的可接受范围,但依据布朗案,同意不能用于严重伤害。


9. Tort Law: Negligence | 侵权法:过失侵权

Negligence is the breach of a legal duty of care owed by the defendant to the claimant, causing damage. To succeed, the claimant must prove duty, breach, causation, and damage. The neighbour principle from Donoghue v Stevenson established that one must foresee that one’s actions could cause harm to persons closely and directly affected.

过失侵权是指被告违反了对原告应尽的注意义务,并造成损害。原告须证明义务、违反、因果关系和损害。多诺霍诉史蒂文森案创立的邻人原则规定,人们应当合理预见自己的行为可能会对密切、直接受影响的人造成伤害。

The standard of care is that of the reasonable person. Breach is assessed by balancing the magnitude of risk, the seriousness of harm, and the cost of precautions. The damage must be caused by the breach (causation in fact) and must not be too remote (causation in law).

注意标准以合理人的标准来衡量。判断是否违反义务需权衡风险大小、损害的严重性及预防措施的成本。损害必须由违反义务引起(事实因果关系),且不能过于间接(法律因果关系)。


10. Contract Law: Formation and Terms | 合同成立与条款

A valid contract requires an offer, acceptance, consideration, and an intention to create legal relations. An offer is a definite promise to be bound on specific terms, while acceptance is an unqualified agreement to all those terms. Consideration is the exchange of value, which can be a benefit to the promisor or a detriment to the promisee.

有效合同需要要约、承诺、对价和设立法律关系的意图。要约是在特定条款下受约束的明确允诺,承诺是对所有条款的无条件同意。对价是价值交换,可以是给予要约人的利益或受要约人遭受的不利益。

Contractual terms may be express (stated by the parties) or implied (by statute, custom, or the courts). The Consumer Rights Act 2015 implies terms about satisfactory quality and fitness for purpose into consumer contracts. Breach of a condition allows repudiation, while breach of a warranty only permits damages.

11. Consumer Law and Human Rights | 消费者法与人权

The Consumer Rights Act 2015 simplifies and consolidates consumer protection. Goods must be of satisfactory quality, fit for a particular purpose, and match their description. Services must be performed with reasonable care and skill. If goods do not conform, consumers have a short-term right to reject within 30 days.

2015年《消费者权利法》简化和整合了消费者保护规定。商品须品质满意、适合特定用途并符合描述;服务须以合理谨慎和技能提供。若商品不符,消费者在30天内享有短期拒收权。

The Human Rights Act 1998 incorporates the European Convention on Human Rights into UK law. Key rights include the right to life (Article 2), prohibition of torture (Article 3), right to liberty and security (Article 5), right to a fair trial (Article 6), respect for private and family life (Article 8), and freedom of expression (Article 10). Courts must interpret legislation compatibly with these rights where possible.
