📚 GCSE CIE Law: Case Analysis Practical Drills | GCSE CIE

Welcome to this focused guide on tackling case analysis questions in the CIE IGCSE Law examination. Case analysis is a core skill that bridges legal theory and practical problem-solving. Examiners expect you to identify legal issues, state relevant rules, apply them to given facts, and reach a reasoned conclusion. This article will equip you with a reliable method and provide hands-on drills to build your confidence.

1. The IRAC Method: Your Analytical Backbone | IRAC

Many law students use the IRAC framework (Issue, Rule, Application, Conclusion) to structure their answers. For CIE IGCSE Law, adapting IRAC helps ensure you cover every marking point. Begin by identifying the key question, then state the precise legal principle, apply it step by step to the scenario, and finally state the likely outcome.

Think of IRAC as a checklist: Issue – What legal problem needs solving? Rule – Which statute or case provides the answer? Application – How do the facts fit the rule? Conclusion – Who wins and on what basis?

You will not lose marks for using subheadings; in fact, clear signposting is encouraged in CIE mark schemes. Always write in full sentences, even under the Issue heading.

2. Issue Spotting: Read the Scenario Like a Detective |

The first step is to pinpoint the legal issue within the question. A scenario might involve a broken promise, an injury caused by carelessness, or a punch thrown in anger. Your task is to translate everyday facts into legal concepts: for example, ‘Tom hit Mia’ becomes an issue of battery in criminal law and potentially trespass to the person in tort.

Common issue triggers in CIE IGCSE Law include: offer and acceptance, breach of duty of care, theft, assault, battery, causation, and defences such as consent or self-defence. Always ask yourself: ‘What area of law does this belong to, and what specific rule is in doubt?’

CIE IGCSE

Highlight or underline key phrases in the exam paper. If you see ‘tripped over a loose carpet in a shop’, the issue is likely occupiers’ liability or negligence. If you read ‘pointed a knife and demanded money’, the issue is robbery.

3. Stating the Rule: Authority Is Everything |

For every issue, you must cite a source of law. CIE expects knowledge of both statutory provisions and decided cases. For example, when discussing negligence, you need to mention Donoghue v Stevenson [1932] for the neighbour principle and the modern three-part test: duty, breach, damage. Use precise case names or statute titles; do not simply say ‘the law says’.

Keep a revision bank of key cases for each topic. For criminal law: R v Cunningham for reckless mens rea, R v Smith for causation, R v Ghosh for dishonesty. For contract: Carlill v Carbolic Smoke Ball Co for unilateral offers, Partridge v Crittenden for invitations to treat. Express the ratio decidendi (the binding reason for the decision) in one or two sentences.

Do not overload your rule statement with irrelevant details. The examiner wants the principle, not the full history of the case. For instance: ‘In Caparo v Dickman, a duty of care arises where harm is foreseeable, there is proximity, and it is fair, just and reasonable to impose a duty.’

4. Applying Law to Facts: The Art of Weaving |

This is the most heavily weighted segment. Do not simply repeat the facts or the rule; link them explicitly. Use phrases like ‘Applying Donoghue to our scenario, the manufacturer owed a duty to the ultimate consumer because…’ or ‘Unlike the defendant in that case, here the injury was directly caused by the defendant’s failure to…’. Compare and contrast with precedent cases.

For example, if the scenario describes a shopkeeper who failed to clean a spillage, apply the Occupiers’ Liability Act 1957: ‘As an occupier, the shopkeeper owed a common duty of care to all lawful visitors. The spillage created an unusual danger that the shopkeeper knew or ought to have known about. By failing to display a warning sign or clean the floor within a reasonable time, he likely breached that duty.’

Always address causation. Ask: ‘But for the defendant’s breach, would the claimant have suffered the loss?’ In criminal law, consider both factual and legal causation, and check for any novus actus interveniens (intervening act).

5. Drawing a Reasoned Conclusion |

Your conclusion should flow logically from the application. It need not be absolutely certain; use modal language such as ‘it is likely that…’ or ‘a court would probably find…’. State clearly who is liable or guilty, and mention any remedy or sentence if the question asks. For civil cases, indicate whether damages or an injunction might be granted.

Example: ‘In conclusion, Dan will likely be found liable for battery because his intentional act of pushing Eve caused immediate unlawful force, and there is no evidence of a valid defence. Eve may claim compensatory damages for her medical expenses.’
