1. Actus Reus: The Physical Element of a Crime | 犯罪行为:犯罪的客观要素

In criminal law, actus reus comprises all the external elements of an offence. The ‘formula’ is: Actus Reus = Conduct + Circumstances + Consequences (where relevant). The conduct must be voluntary (Hill v Baxter). An omission will only satisfy actus reus if there is a legal duty to act (e.g. a special relationship, contractual duty, or creation of a dangerous situation as in R v Miller). For result crimes, the prosecution must also establish factual causation (‘but for’ test: R v White) and legal causation (the defendant’s act must be a substantial and operating cause of the result: R v Smith; R v Cheshire). The chain of causation can be broken by an intervening act (novus actus interveniens) that is free, deliberate and informed (R v Pagett) or by an unforeseeable natural event.

Mens rea is the mental state required for a specific crime. The two main forms are intention and recklessness. Direct intent = defendant’s aim, purpose or desire to bring about a result (R v Moloney). Oblique/indirect intent applies where the result was a virtual certainty of the defendant’s actions and the defendant foresaw it as a virtual certainty (R v Woollin). Recklessness is the conscious taking of an unjustified risk; the defendant must foresee the risk and go on to take it, and in the circumstances it must be unreasonable to do so (R v Cunningham subjective test; for criminal damage, R v G and R confirms Cunningham recklessness). Some statutory offences use a different test (e.g. the former objective Caldwell recklessness has been overruled). Note that negligence, which is an objective failure to meet a standard, is not generally sufficient for mens rea unless the statute specifically requires it.

3. Murder: The Classic ‘Formula’ | 谋杀:经典的“公式”

Murder is a common law offence with a fixed definition. The formula: Murder = (Actus Reus) unlawful killing of a reasonable person in being under the King’s Peace + (Mens Rea) malice aforethought, which means intention to kill or intention to cause grievous bodily harm (GBH) (R v Vickers; R v Cunningham). The actus reus includes establishing causation (both factual and legal, as above). A ‘reasonable person in being’ excludes a foetus (Attorney-General’s Reference (No. 3 of 1994)), and killing must not be authorised by law (e.g. self-defence). Malice aforethought does not require premeditation; intention to cause really serious harm is sufficient. The sentence is a mandatory life sentence (Murder (Abolition of Death Penalty) Act 1965).

4. Theft: The s. 1 Theft Act 1968 Equation | 盗窃罪:《1968年盗窃法》第1条的等式

Theft is defined in s.1 of the Theft Act 1968: ‘A person is guilty of theft if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it.’ This breaks down into five elements applying the ‘formula’: Actus Reus: (1) Appropriation (s.3: any assumption of a right of an owner; can occur even with consent if there is later assumption: R v Morris; R v Gomez); (2) Property (s.4: includes money, real property, personal property, things in action, other intangible property, but not information: Oxford v Moss); (3) Belonging to another (s.5: possession or control, or any proprietary interest; includes trust property and property received under an obligation: R v Turner (No.2); R v Wain). Mens Rea: (4) Dishonesty (s.2 gives three instances of not dishonest; the general test is now the two-stage test from Ivey v Genting Casinos (UK) Ltd t/a Crockfords: (a) what was the defendant’s actual state of knowledge or belief as to the facts? (b) was the defendant’s conduct dishonest by the standards of ordinary decent people?); (5) Intention to permanently deprive (s.6: treat the property as one’s own regardless of the other’s rights, or borrow for a period equivalent to outright taking: R v Lloyd).

5. Occupiers’ Liability Act 1957: Lawful Visitor Danger Formula | 《1957年占有人责任法》:合法访客危险公式

The Occupiers’ Liability Act 1957 governs the duty owed by occupiers to lawful visitors. The structural ‘formula’ is: Occupier (person with control of premises: Wheat v E Lacon & Co Ltd) + Premises (includes fixed and moveable structures: s.1(3)) + Visitor (person with express/implied permission) → Duty of Care (‘common duty of care’ under s.2(2): to take such care as is reasonable in all the circumstances to see that the visitor is reasonably safe in using the premises for the purposes for which he is invited or permitted to be there). Special considerations: children (s.2(3)(a): an occupier must be prepared for children to be less careful); persons exercising a calling (s.2(3)(b): an expert expected to guard against risks incidental to his trade); warnings (s.2(4)(a): a warning may discharge the duty if it is enough to enable the visitor to be reasonably safe). The defence of volenti non fit injuria (consent) is available under s.2(5). The Act also permits exclusion of liability in some circumstances (s.2(1) and Unfair Contract Terms Act 1977).

6. Occupiers’ Liability Act 1984: Trespasser Equation | 《1984年占有人责任法》:侵入者等式

The 1984 Act imposes a duty on occupiers towards persons other than visitors (mainly trespassers). The duty arises only if three conditions under s.1(3) are fulfilled: (a) the occupier is aware of the danger or has reasonable grounds to believe it exists; (b) the occupier knows or has reasonable grounds to believe that a non-visitor is in the vicinity of the danger, or may come into the vicinity; and (c) the risk is one against which, in all the circumstances, the occupier may reasonably be expected to offer the non-visitor some protection. If all three are satisfied, the duty is to take such care as is reasonable in all the circumstances to see that the non-visitor does not suffer injury on the premises by reason of the danger concerned (s.1(4)). The duty may be discharged by a warning or by discouragement from taking the risk (s.1(5)). No duty is owed in respect of risks willingly accepted (volenti: s.1(6)). The 1984 Act covers only injury to the person, not property damage (s.1(8)). Key case: Ratcliff v McConnell, where the court considered the foreseeability of a trespasser and the need for warnings.

Negligence analysis follows a three-part formula: Duty of Care + Breach of Duty + Damage (causation and remoteness). Duty: The modern test for novel situations is the Caparo three-stage test from Caparo Industries plc v Dickman: (1) Harm must be reasonably foreseeable (foreseeability of this claimant); (2) There must be proximity between the parties; (3) It must be fair, just and reasonable to impose a duty. For established categories (e.g. road users, doctor-patient), existing precedent applies (Robinson v Chief Constable of West Yorkshire Police). Breach: The defendant’s conduct falls below the standard of the reasonable person (Blyth v Birmingham Waterworks Co). Factors: likelihood of harm (Bolton v Stone), seriousness of the risk (Paris v Stepney Borough Council), cost and practicality of precautions (Latimer v AEC Ltd), and social utility. Special standards apply to professionals (Bolam test: acting in accordance with a practice accepted as proper by a responsible body of professional opinion, modified by Bolitho to require logical basis). Damage: Claimant must prove factual causation (balance of probabilities: ‘but for’ test, Barnett v Chelsea and Kensington Hospital; material contribution: Bonnington Castings v Wardlaw) and legal causation (no new intervening act, and harm not too remote – Wagon Mound No.1: damage must be of a type that was reasonably foreseeable).

8. Contract Formation: Offer, Acceptance, Consideration + Intention | 合同订立:要约、承诺、对价 + 意向

A binding contract requires the classic ‘formula’: Offer + Acceptance + Consideration + Intention to Create Legal Relations. Offer: An expression of willingness to contract on certain terms, made with the intention that it shall become binding upon acceptance (Storer v Manchester City Council). It must be distinguished from an invitation to treat (Gibson v Manchester City Council; Fisher v Bell; Partridge v Crittenden). An offer can be terminated by revocation (must be communicated: Byrne v Van Tienhoven), rejection, lapse of time, death, or counter-offer (Hyde v Wrench). Acceptance: An unconditional and final expression of assent to all the terms of the offer, communicated to the offeror (the ‘mirror image’ rule). The postal rule (Adams v Lindsell) states that acceptance by post takes effect when the letter is properly posted, even if it is delayed or lost, but the rule can be ousted by the express terms of the offer. Consideration: Something of value in the eye of the law that is exchanged between the parties (Currie v Misa: ‘some right, interest, profit or benefit accruing to one party, or some forbearance, detriment, loss or responsibility given, suffered or undertaken by the other’). Past consideration is not valid (Re McArdle). Consideration must be sufficient but need not be adequate (Chappell & Co Ltd v Nestle Co Ltd). Performance of an existing public duty (Collins v Godefroy) or existing contractual duty (Stilk v Myrick) is generally not good consideration, but practical benefit can be consideration (Williams v Roffey Bros). Intention to Create Legal Relations: In social/domestic agreements, there is a presumption of no intention (Balfour v Balfour), rebuttable by evidence. In commercial agreements, there is a strong presumption of intention, which is difficult to rebut (Esso Petroleum Ltd v Commissioners of Customs and Excise).

9. Voluntary Manslaughter: Diminished Responsibility – A Medical Formula | 非自愿误杀:减轻责任——一种医学公式

Diminished responsibility is a partial defence to murder that reduces the conviction to voluntary manslaughter. It is governed by s.2 of the Homicide Act 1957, as amended by the Coroners and Justice Act 2009. The statutory formula requires four elements: (1) Abnormality of mental functioning; (2) Which arose from a recognised medical condition; (3) Which substantially impaired the defendant’s ability to (a) understand the nature of their conduct, (b) form a rational judgment, and/or (c) exercise self-control; and (4) Which provides an explanation for the defendant’s acts or omissions in doing or being a party to the killing. The abnormality of mental functioning need not be the sole cause, but must be a significant factor (R v Golds). A recognised medical condition includes conditions such as schizophrenia, severe depression, and certain personality disorders, but intoxication by itself is not sufficient unless it leads to a condition like alcoholism (R v Dowds). Expert psychiatric evidence is usually crucial. The burden of proof is on the defendant on a balance of probabilities. If successful, the judge has discretion in sentencing, and may order a hospital order or a determinate sentence.
