1. English Legal System: System and Sources | 英国法律体系:体系与渊源

The English legal system is built upon a combination of Parliament-made statute law and judge-made common law. AS candidates must understand how these sources interact and how delegated legislation fills the practical gaps left by primary legislation. The hierarchy of courts ensures a clear appeals structure, from magistrates’ courts and the County Court up to the Court of Appeal and the UK Supreme Court.

Statute law is the supreme source, meaning Parliament can enact or repeal any law. However, common law, developed through judicial precedent, interprets and supplements statutes. Delegated legislation, such as Orders in Council and by-laws, allows ministers and local authorities to create detailed rules without a full Act of Parliament, subject to judicial review under the doctrine of ultra vires.

2. Judicial Precedent | 司法先例

Judicial precedent, or stare decisis, is the doctrine that courts follow previous decisions in similar cases. The part of a judgment that forms the binding precedent is the ratio decidendi – the legal reason for the decision. Any other remarks made ‘by the way’ are termed obiter dicta and are not binding, though they may be persuasive.

The operation of precedent depends on the court hierarchy. The Supreme Court binds all courts below and normally itself, although it has the power to depart from its own previous decisions using the Practice Statement 1966. The Court of Appeal is bound by the Supreme Court and generally by its own decisions, subject to limited exceptions in Young v Bristol Aeroplane Co Ltd. Lower courts are bound by all higher courts.

3. Statutory Interpretation | 成文法解释

When judges apply statutes, they interpret the words using established rules. The literal rule gives words their plain, ordinary dictionary meaning, even if the result seems harsh. The golden rule allows departure from the literal meaning when it leads to an absurdity, either by choosing a narrower meaning or by modifying the wording to avoid inconsistency.

The purposive approach is broader: it looks at the overall purpose of Parliament and interprets the Act accordingly, often relying on the context and even on debates in Hansard when permitted.

These rules are not mutually exclusive, and judges often combine elements. External aids such as dictionaries, Law Commission reports, and the Interpretation Act 1978, as well as internal aids like the long title and preamble, assist in reaching a just interpretation.

4. Criminal Law: Actus Reus and Mens Rea | 刑法:犯罪行为与犯罪意图

Most criminal offences require proof of both an actus reus – the guilty act – and mens rea – the guilty mind. The actus reus can consist of conduct, circumstances, and consequences. It must be voluntary; usually an omission does not satisfy actus reus unless there is a legal duty to act, for example a contractual duty or a duty arising from a special relationship.

Mens rea takes different forms. Recklessness is the conscious taking of an unjustified risk. Some crimes are strict liability, requiring no mens rea for at least one element of the actus reus, often found in regulatory offences.

Transferred malice applies when the defendant intends to harm one victim but actually harms another. The mens rea is transferred to the unintended victim, provided the harm is of the same type as that intended. Coincidence of actus reus and mens rea is needed, but courts may treat a series of acts as one continuing transaction.

5. Non-Fatal Offences Against the Person | 人身非致命罪行

The key offences are found in the Offences Against the Person Act 1861. Assault occurs when the defendant intentionally or recklessly causes the victim to apprehend immediate unlawful force; no touching is required. Battery is the intentional or reckless application of unlawful force, even the slightest touching.

Assault occasioning actual bodily harm, under s.47, requires proof of an assault or battery that causes harm which is more than transient or trifling. Psychiatric injury can qualify as ABH. The mens rea is the same as for assault or battery; no additional intent regarding the harm is necessary.

Malicious wounding or inflicting grievous bodily harm under s.20 requires a ‘wound’ – a break in the continuity of the skin – or really serious harm. The mens rea is ‘malice’, meaning intention or recklessness as to some harm, not necessarily serious harm. Section 18, causing GBH with intent, is the most serious, requiring specific intent to do really serious harm or to resist arrest.

6. Homicide: Murder and Voluntary Manslaughter | 杀人罪:谋杀与自愿过失杀人

Murder is defined as the unlawful killing of a reasonable person in being under the Queen’s or King’s Peace with malice aforethought. Malice aforethought means an intention to kill or an intention to cause grievous bodily harm. The victim must be a human being who has been born and is alive.

A conviction for murder carries a mandatory life sentence. However, a successful partial defence reduces liability to voluntary manslaughter. The two main partial defences are loss of control and diminished responsibility, both introduced by the Coroners and Justice Act 2009.

Loss of control requires a loss of self-control caused by a qualifying trigger, such as fear of serious violence or things said or done which constituted circumstances of an extremely grave character causing a justifiable sense of being seriously wronged. A person of the defendant’s sex and age with a normal degree of tolerance and self-restraint must have reacted similarly. Diminished responsibility requires an abnormality of mental functioning arising from a recognised medical condition which substantially impaired the defendant’s ability to understand his conduct, form a rational judgment, or exercise self-control, and which provides an explanation for the killing.

7. Tort Law: The Tort of Negligence – Duty of Care | 侵权法:过失侵权——注意义务

Negligence is the most significant tort. To establish liability, a claimant must prove that the defendant owed them a duty of care, breached that duty, and caused damage which was not too remote. The modern test for duty of care derives from Caparo Industries v Dickman: foreseeability of harm, proximity between the parties, and whether it is fair, just and reasonable to impose a duty.

过失侵权是最重要的侵权行为。要确立责任,原告必须证明被告对其负有注意义务、违反了该义务、并且造成了并非过于遥远的损害。注意义务的现代检验标准源自Caparo Industries v Dickman案:损害的可预见性、当事人之间的邻近关系、以及施加义务是否公平、公正和合理。

The neighbour principle from Donoghue v Stevenson remains foundational: one must take reasonable care to avoid acts or omissions which one can reasonably foresee would be likely to injure one’s neighbour. Special duty situations include the police, for whom public policy often restricts liability, and claims for pure economic loss or psychiatric harm, where additional control mechanisms apply.

Breach of duty is assessed by the objective standard of the reasonable person. The court considers factors such as the likelihood of harm, the seriousness of potential injury, the cost of precautions, and the social utility of the defendant’s conduct. Professional defendants are judged by the standard of the ordinary competent professional, as established in Bolam v Friern HMC.

Causation requires a two-stage test. Factual causation asks: ‘but for’ the defendant’s breach, would the damage have occurred? Legal causation examines whether the defendant’s breach was a substantial and operative cause of the damage. A novus actus interveniens – an intervening act – may break the chain of causation if it is a truly independent and unforeseeable act by a third party or the claimant.

Damage must be proved; negligence is not actionable per se. The claimant can recover for physical injury, property damage, and consequential economic loss. The test for remoteness is whether the type of damage was reasonably foreseeable (The Wagon Mound No 1), even if the extent was not.

9. Contract Law: Formation – Offer and Acceptance | 合同法:合同的成立——要约与承诺

A binding contract requires offer, acceptance, consideration, and intention to create legal relations. An offer is an expression of willingness to contract on certain terms, made with the intention that it shall become binding upon acceptance. It must be distinguished from an invitation to treat, which is merely an invitation to negotiate, such as goods displayed on a shelf (Pharmaceutical Society v Boots).

Acceptance must be unconditional and communicated to the offeror. The postal rule is an exception: acceptance takes effect when the letter is posted, not when it is received, provided the use of post was reasonable. An offer may be terminated by revocation, rejection, lapse of time, or death. Revocation must be communicated to the offeree before acceptance.

10. Contract Law: Consideration and Intention | 合同法:对价与意图

Consideration is the price for which the promise is bought. It must move from the promisee, but need not move to the promisor. Executory consideration is a promise in exchange for a promise; executed consideration is an act in exchange for a promise. Past consideration is generally not valid (Re McArdle), but a modern exception exists under Pao On v Lau Yiu Long where the act was done at the promisor’s request, parties understood payment would be made, and the payment would have been legally enforceable had it been promised in advance.

Consideration must be sufficient but need not be adequate. Performing an existing public duty or an existing contractual duty owed to a third party may not constitute valid consideration, but performance of an existing contractual duty to the same promisor can be good consideration if it confers a practical benefit (Williams v Roffey Bros).

Intention to create legal relations is presumed in commercial agreements but presumed not to exist in domestic and social agreements, although the latter presumption can be rebutted by clear evidence (Merritt v Merritt). Both parties must intend their agreement to have legal consequences.

11. Contract Terms and Remedies | 合同条款与救济

Contractual terms can be conditions, warranties, or innominate terms. A condition is a fundamental term, breach of which entitles the injured party to terminate the contract and claim damages. A warranty is a minor term, breach of which only permits damages. Innominate terms take a flexible approach: the remedy depends on the seriousness of the breach’s effect (Hong Kong Fir Shipping).

The main remedy at common law is damages, designed to put the claimant in the position they would have been in if the contract had been performed (expectation interest). Damages are subject to rules on mitigation, remoteness, and certainty. Equitable remedies such as specific performance and injunction are discretionary and may be ordered where damages are inadequate, but specific performance will not generally be granted for personal services.

普通法上的主要救济方式是损害赔偿,旨在将原告置于合同被履行时本应处于的地位(期待利益)。损害赔偿金须遵循减损规则、遥远性规则和确定性规则。衡平法救济如特定履行和禁令是自由裁量的,可在损害赔偿金不充分时颁布,但特定履行一般不会适用于个人服务合同。
