In strict liability offences, such as many regulatory crimes, the prosecution need not prove any mens rea as to at least one element of the actus reus. Students must be able to distinguish these offences and apply them to scenarios involving broken bones, psychiatric harm, or minor cuts.

Robbery, under s.8 Theft Act 1968, requires theft plus the use or threat of force immediately before or at the time of the theft, with the force intended to steal. If the force is used merely to escape, it may not constitute robbery (R v Hale (1978)). Burglary under s.9 has two forms: entering a building (or part of a building) as a trespasser with intent to steal, commit GBH, or cause unlawful damage; or, having so entered, stealing or inflicting GBH. The entry must be ‘effective’ and as a trespasser – a point explored in R v Jones and Smith [1976]. These offences require students to build logical chains of reasoning linking actus reus and mens rea.

A valid contract in English law requires a binding agreement supported by consideration, an intention to create legal relations, and certainty of terms. A unilateral offer can be made to the world at large, as in Carlill v Carbolic Smoke Ball Co [1893], where a company’s advertisement promising a reward was held to be an offer capable of acceptance by performance.

Acceptance must be unconditional and communicated to the offeror, though the postal rule may apply where acceptance is effective upon posting (Adams v Lindsell (1818)). Consideration requires that each party give something of value in the eyes of the law; whilst it must be sufficient but need not be adequate, past consideration is generally not valid (Re McArdle [1951]). The intention to create legal relations is presumed in commercial contexts but rebutted with evidence of honourable pledge clauses. Capacity, form, and legality are further requirements that may vitiate an agreement.
