When courts apply legislation, they must interpret the words used by Parliament. Four main approaches have developed. The literal rule gives words their plain, ordinary dictionary meaning, even if the outcome seems harsh. The golden rule allows a court to modify the literal meaning where the absurdity threshold is met – either by a narrow approach (choosing between ambiguous meanings) or a broad approach (substituting a reasonable meaning).

The English court structure is divided into criminal and civil jurisdictions. Criminal cases start in the Magistrates’ Court for summary offences and either-way offences if the defendant chooses summary trial, or in the Crown Court for indictable offences and either-way cases heard before a judge and jury. Appeals from the Magistrates’ Court go to the Crown Court or by way of case stated to the High Court. Appeals from the Crown Court go to the Court of Appeal (Criminal Division) and then to the Supreme Court.
