The WJEC IGCSE/GCSE Law specification introduces students to the essential structures, concepts and rules that shape the legal system of England and Wales. Understanding these core knowledge points is crucial for building analytical skills and achieving high marks in examinations.

1. Nature of Law | 法律的性质

Law is a set of rules made by the state that is binding on all members of society. Legal rules are backed by sanctions, such as fines or imprisonment, which distinguishes them from moral rules or social customs.

法律是由国家制定的一套规则,对社会所有成员具有约束力。法律规则以罚款或监禁等制裁为后盾,这使其区别于道德规则或社会习俗。

Legal rules must be general, widely published and applied equally, but the law also aims to achieve justice, fairness and social control. Without enforceable legal rules, society would face disorder and uncertainty.

2. Classification of Law | 法律的分类

A fundamental distinction is between criminal law and civil law. Criminal law deals with conduct harmful to society, where the state prosecutes the defendant; civil law resolves disputes between individuals or organisations over rights and obligations.

一个基本区别是刑法和民法之间的区别。刑法处理对社会有害的行为,由国家起诉被告;民法解决个人或组织之间关于权利和义务的争议。

Criminal cases require proof beyond reasonable doubt and can lead to punishment, while civil cases are proved on the balance of probabilities and usually result in compensation or an order to stop a wrong.

3. Sources of Law | 法律渊源

The main sources of English and Welsh law are legislation (statutes made by Parliament) and case law (judicial precedent). Other historical sources include custom, but legislation is the highest source because Parliament is sovereign.

Delegated legislation, such as statutory instruments and by-laws made by local authorities or ministers, is also a significant source of law. Courts must interpret and apply all these sources in real disputes.

4. Law-Making Process | 立法程序

A proposed new law is called a bill. Public bills are introduced in either the House of Commons or the House of Lords, then pass through first reading, second reading, committee stage, report stage and third reading in both Houses.

Once both Houses agree on the text, the bill receives royal assent and becomes an Act of Parliament. The monarch’s approval is now a formality, and the Act may come into force immediately or on a later date appointed by a commencement order.

5. Statutory Interpretation | 法律解释

Judges often need to interpret words in an Act because language can be ambiguous or unclear. The literal rule gives words their plain, ordinary meaning even if the result is harsh or absurd.

The golden rule allows the court to avoid an absurd result by choosing a secondary meaning, while the mischief rule looks at the gap or ‘mischief’ Parliament intended to remedy. The purposive approach is wider and seeks the overall purpose of the statute.

6. Judicial Precedent | 司法判例

Precedent operates through stare decisis, meaning ‘to stand by things decided’. Courts are bound by decisions of higher courts in the hierarchy. The ratio decidendi is the legal reason for the decision and is binding; obiter dicta are other remarks and are only persuasive.

先例通过遵循先例原则运作,意思是“遵照已决事项”。法院受制于更高层级法院的判决。判决理由是判决的法律依据,具有约束力;附带意见是其他论述,仅具有说服力。

The Supreme Court is the highest court and its decisions bind all lower courts, while the Court of Appeal binds itself and lower courts. The Magistrates’ Court and Crown Court are lower criminal courts and do not create binding precedents.

7. Criminal Law: Actus Reus and Mens Rea | 刑法:犯罪行为与犯罪心理

Most criminal offences require two elements: actus reus (the guilty act or omission) and mens rea (the guilty mind, such as intention or recklessness). The prosecution must prove both beyond reasonable doubt.

Some offences are of strict liability, where mens rea is not required for at least part of the actus reus. Strict liability is common in regulatory offences such as selling alcohol to minors or food hygiene breaches.

8. Criminal Courts and Sentencing | 刑事法院与量刑

Criminal cases are classified as summary, triable either way, or indictable. Summary offences, like most driving offences, are tried in the Magistrates’ Court. Indictable offences, such as murder, are tried in the Crown Court before a judge and jury.

刑事案件分为简易罪、可诉择法院审判罪和可诉罪。大多数驾驶罪等简易罪在治安法院审理。谋杀等可诉罪在刑事法院由法官和陪审团审理。

Sentencing aims include punishment, deterrence, rehabilitation, protection of the public and reparation. Sentences range from discharge and fines, to community orders and imprisonment. The court must follow sentencing guidelines and consider aggravating and mitigating factors.

9. Civil Law: Tort and Contract | 民法:侵权与合同

Tort law provides remedies for civil wrongs, the most common being negligence. To succeed in negligence, the claimant must prove duty of care, breach of that duty, causation and damage. The standard of care is that of the reasonable person.

侵权法为民事过错提供救济,最常见的是过失侵权。要在过失侵权中胜诉,原告必须证明注意义务、违反该义务、因果关系和损害。注意义务的标准是合理人的标准。

Contract law governs binding agreements. A valid contract requires offer, acceptance, consideration, capacity and intention to create legal relations. Breach of contract entitles the innocent party to damages or other remedies.

10. Civil Courts and Remedies | 民事法院与救济

Civil disputes may be heard in the County Court for lower-value claims, or in the High Court for higher-value or more complex claims. Appeals go to the Court of Appeal (Civil Division) and ultimately to the Supreme Court.

民事争议可在郡法院审理较低金额的索赔,或在高等法院审理较高金额或更复杂的索赔。上诉可上诉至上诉法院(民事庭),最终上诉至最高法院。

Remedies in civil law include damages (monetary compensation), injunctions (orders to do or stop doing something), and specific performance (ordering a party to carry out a contract). The court’s aim is to put the claimant in the position they would have been in had the wrong not occurred.

11. Legal Personnel | 法律职业人员

Solicitors provide legal advice and prepare cases, while barristers specialise in advocacy and give opinions. Judges preside over courts and make rulings on law, while magistrates are unpaid lay volunteers who hear less serious criminal cases.

事务律师提供法律咨询并准备案件,而出庭律师专门从事法庭辩护并出具法律意见。法官主持法庭并裁决法律问题,而治安法官是无薪的非专业志愿者,审理较轻微的刑事案件。

Juries are used in the Crown Court to decide guilt in more serious criminal cases. They consist of 12 randomly selected citizens who listen to evidence and reach a verdict, usually after directed by the judge on the law.

12. Access to Justice | 司法公正与法律援助

Access to justice means that people should be able to obtain legal advice and representation regardless of their financial means. Legal aid is government funding that helps eligible individuals pay for legal advice and court representation.

司法公正意味着人们无论经济能力如何,都应能够获得法律咨询和代理。法律援助是政府资助,帮助符合条件的人支付法律咨询和法庭代理费用。

Other routes to justice include advice agencies, pro bono work by lawyers, and alternative dispute resolution (ADR) such as mediation, negotiation and arbitration. ADR is often cheaper and faster than going to court.
