This mock paper is designed to mirror the WJEC IGCSE Law unit test format. The total mark is 60, and you should spend about 50 minutes on Sections A and B combined, leaving 25 minutes for Section C.

A typical question asks: “Which of the following is a primary source of law in England and Wales?” The correct answer is a statute, such as an Act of Parliament. Textbooks, law review articles, and newspaper reports are secondary sources because they describe or comment on the law rather than create it.

A second question may test judicial precedent. Precedent operates through the doctrine of stare decisis, which means “stand by what has been decided”. When a higher court makes a decision, its ratio decidendi binds lower courts in later cases with similar facts.

A short-answer question might state: “Define actus reus and mens rea and give one example of each.” The actus reus is the guilty act, such as taking property without consent in theft, while mens rea is the guilty mind, such as dishonesty or intention to permanently deprive.

For example, if Dan decides to harm Pat after accidentally knocking him over, the required mens rea may be absent at the moment of the actus reus unless a continuing act applies.

4. Question 3: Non-Fatal Offences Against the Person | 第 3 题:非致命侵害罪

A common question requires you to distinguish assault from battery. Assault is committed when the defendant intentionally or recklessly causes the victim to apprehend immediate unlawful force. No physical contact is needed. Battery is the actual application of unlawful force, such as pushing or hitting.

Higher-level questions may ask about actual bodily harm under section 47 of the Offences Against the Person Act 1861. A typical negligence question asks about the neighbour principle from Donoghue v Stevenson. Lord Atkin said you must take reasonable care to avoid acts or omissions that you can reasonably foresee would injure your neighbour. In law, your neighbour is anyone closely and directly affected by your actions.
