1. The Counter-Majoritarian Difficulty | 反多数难题

Alexander Bickel called the ‘counter-majoritarian difficulty’ the core problem of judicial review: when the Supreme Court declares a statute unconstitutional, it frustrates the will of the elected legislature, yet the Court itself is not directly accountable to voters.

Defenders argue that civil rights require exactly this counter-majoritarian check. If a majority passes a law discriminating against a racial or religious minority, ordinary democratic remedies may not protect the injured group, so judges must enforce the Constitution against the majority.
