This article covers the Edexcel A-Level Politics topic “Judiciary and Civil Rights”. It explains the role, independence and neutrality of the UK judiciary, the protection of civil rights under the Human Rights Act 1998 and the Equality Act 2010, and the ways in which judges can check the power of the executive and Parliament through judicial review.

1. The UK Judiciary | 英国司法机构

The judiciary refers to the body of judges who interpret and apply the law in courts and tribunals. In the UK, the judiciary is separate from the executive and the legislature, although the separation of powers is not as strict as in the United States. Judges range from magistrates and tribunal judges to senior judges in the High Court, Court of Appeal and the Supreme Court.

司法机构指在法院和裁判所中解释和适用法律的法官群体。在英国,司法机构与行政机关和立法机关相分离,但权力分立不像美国那样严格。法官包括治安法官、裁判所法官,以及高等法院、上诉法院和最高法院的高级法官。

The Constitutional Reform Act 2005 created the Supreme Court, replacing the Appellate Committee of the House of Lords. It also reformed the role of the Lord Chancellor to increase judicial independence.

  • Magistrates deal with minor criminal cases and some civil matters.

2. Judicial Independence | 司法独立

Judicial independence means judges are free to make decisions without pressure from the government, Parliament, the media or public opinion. It is protected by security of tenure, guaranteed salaries and the sub judice rule.

司法独立指法官可以在不受政府、议会、媒体或舆论压力的情况下作出裁决。这一独立性受到任期保障、薪酬保障和“案件审理中禁止评论”规则的保护。

Since the Constitutional Reform Act 2005, judges are appointed by an independent Judicial Appointments Commission, reducing political influence. Security of tenure means senior judges can only be removed with the consent of both Houses of Parliament, not simply by a government minister.

自2005年宪法改革法以来,法官由独立的司法任命委员会任命,减少了政治影响。任期保障意味着高级法官只有在议会两院同意的情况下才能被免职,而不能仅由政府大臣免职。

Judicial independence is important because it upholds the rule of law and ensures that the government itself is subject to legal limits. Without independence, judges could be forced to support the government of the day, undermining fair trials and the protection of individual rights.

3. Judicial Neutrality | 司法中立

Judicial neutrality means judges do not favour any political party, group or individual, and they decide cases solely on the basis of law and evidence. Neutrality is safeguarded by professional training, legal reasoning, the requirement to give reasons for decisions, and the principle that judges do not campaign for political causes.

司法中立指法官不偏袒任何政党、团体或个人,仅依据法律和证据裁决案件。中立性通过专业培训、法律推理、要求说明裁决理由以及法官不得为政治事业助选等原则得到保障。

However, critics point out that the judiciary is still unrepresentative: most senior judges are white, male, privately educated and from narrow social backgrounds, which may affect their understanding of ordinary citizens. Efforts have been made to widen diversity through the Judicial Appointments Commission, but progress is slow.

4. The Supreme Court | 最高法院

The Supreme Court is the final court of appeal in the UK for civil cases and for criminal cases in England, Wales and Northern Ireland. It hears cases of major public importance and is the highest domestic court in the UK legal system.

最高法院是英国民事案件以及英格兰、威尔士和北爱尔兰刑事案件的最终上诉法院。它审理具有重大公共意义的案件,是英国法律体系中的最高国内法院。

The Court has 12 justices. It does not have the power to strike down primary legislation as unconstitutional, unlike the US Supreme Court, because the UK Parliament is sovereign. The Supreme Court can, however, declare that a public authority has acted unlawfully or that legislation is incompatible with the Human Rights Act 1998.

最高法院有12名大法官。与美国最高法院不同,它无权以违宪为由推翻议会通过的基本立法,因为英国议会拥有主权。但最高法院可以宣布公共机构行为违法,或宣布立法与1998年《人权法案》不相符。

Key cases include R (Miller) v Secretary of State for Exiting the European Union (2017), which ruled that the government needed parliamentary approval to trigger Article 50, and Miller 2 (2019), which found that Boris Johnson’s advice to prorogue Parliament was unlawful.

5. Rule of Law | 法治

The rule of law is the principle that all individuals and institutions, including the government, are subject to and accountable to the law. It requires laws to be clear, public, stable and applied equally.

法治是指包括政府在内的所有个人和机构都受法律约束并向法律负责的原则。它要求法律明确、公开、稳定并平等适用。

A V Dicey identified three elements: no punishment without trial, equality before the law, and the protection of rights through ordinary courts rather than a separate bill of rights. These ideas remain central to the UK uncodified constitution.

The judiciary upholds the rule of law by reviewing the lawfulness of government actions and protecting individual rights against arbitrary power. This means ministers, police officers and local authorities must act within their legal powers.

6. Civil Liberties and Human Rights | 公民自由与人权

Civil liberties are freedoms that protect individuals from state interference, such as freedom of speech, assembly, religion and the right to privacy. Human rights are broader universal rights recognised in international law.

公民自由是保护个人免受国家干涉的自由,例如言论自由、集会自由、宗教自由和隐私权。人权是国际法承认的更广泛的普遍权利。

In the UK, civil liberties have traditionally been residual: individuals are free to do anything that is not prohibited by law. This differs from countries with a codified constitution that lists positive rights. The Human Rights Act 1998 incorporated the European Convention on Human Rights (ECHR) into UK law, giving individuals a domestic remedy if their rights are breached.

7. Human Rights Act 1998 | 1998年人权法案

The Human Rights Act 1998 requires all public authorities, including the government, police and courts, to act in a way that is compatible with ECHR rights. This includes rights such as the right to life, prohibition of torture, right to a fair trial, freedom of expression, and respect for private and family life.

1998年《人权法案》要求所有公共机构,包括政府、警察和法院,以符合《欧洲人权公约》权利的方式行事。这些权利包括生命权、禁止酷刑、公正审判权、言论自由,以及尊重私人和家庭生活。

Under section 3, courts must interpret legislation so far as possible in a way compatible with Convention rights. Under section 4, if this is impossible, a court can issue a declaration of incompatibility, which does not automatically strike down the law.

Declarations of incompatibility put political pressure on Parliament to change the law, but Parliament is not legally obliged to do so. This preserves parliamentary sovereignty. Ministers must also make a statement of compatibility when introducing bills, ensuring that human rights are considered early in the legislative process.

8. Judicial Review | 司法审查

Judicial review is a procedure by which a court examines the lawfulness of decisions made by public bodies, such as ministers, local authorities and tribunals. It is not an appeal on the merits of the decision; the court only considers whether the decision was made within legal powers and followed fair procedures.

司法审查是法院审查公共机构(如大臣、地方政府和裁判所)所作决定是否合法的程序。它不是对决定本身优劣的上诉;法院只考虑决定是否在法律权限内作出,以及是否遵循公平程序。

A decision can be challenged if the public body acted ultra vires (beyond its legal powers), breached natural justice, used powers for an improper purpose, or acted unreasonably. Judicial review allows ordinary citizens to hold the government to account. Remedies include quashing orders, mandatory orders and prohibiting orders.

如果公共机构越权行为、违反自然正义、为不当目的使用权力或行为不合理,其决定就可能受到挑战。司法审查使普通公民能够问责政府。救济方式包括撤销令、强制令和禁止令。

The government has proposed reforms to restrict judicial review in some areas, arguing that it can delay policy, but critics say this weakens the rule of law and reduces accountability.

9. Judiciary vs Parliament and Executive | 司法与议会和行政机关的关系

The judiciary has the power to interpret Acts of Parliament, but it cannot overturn primary legislation because of parliamentary sovereignty. Judges must give effect to the latest Act of Parliament, even if they disagree with it personally.

Tensions arise when judges rule against the government, as seen in the Miller cases and the 2019 prorogation case, where the Supreme Court ruled that Boris Johnson’s advice to prorogue Parliament was unlawful. Politicians sometimes accuse judges of “judicial activism”, while judges argue that they are simply upholding the law. The relationship is governed by the principle of comity and mutual respect.
