The Effectiveness of the Supreme Court in Protecting Rights |

📚 The Effectiveness of the Supreme Court in Protecting Rights |

The United States Supreme Court is often seen as the ultimate guardian of constitutional rights. Through judicial review, it can strike down laws that violate the Constitution and interpret the Bill of Rights in ways that shape individual freedoms. However, the effectiveness of the Court in protecting rights is a matter of debate: it has delivered landmark victories for civil rights and liberties, yet it also operates within significant institutional, political and enforcement constraints.

1. The power of judicial review |

The Supreme Court’s power of judicial review, established in Marbury v. Madison (1803), allows it to declare acts of Congress and the executive unconstitutional. This power is the foundation of the Court’s ability to protect rights, as it enables the judiciary to invalidate laws that infringe constitutional freedoms such as free speech, equal protection and due process.

Without this power, rights would depend entirely on the elected branches, whose majorities may be indifferent or hostile to unpopular minorities. Judicial review gives judges a counter-majoritarian role, protecting rights even when public opinion or political pressure points the other way.

2. Landmark rulings on civil rights |

The Court has sometimes been highly effective in dismantling state-sponsored discrimination. In Brown v. Board of Education (1954), the Court declared racial segregation in public schools unconstitutional, overturning the ‘separate but equal’ doctrine and advancing civil rights.

In later cases such as Loving v. Virginia (1967), which struck down bans on interracial marriage, and Obergefell v. Hodges (2015), which recognised same-sex marriage, the Court protected the rights of minorities against state laws. These rulings show that the Court can be a powerful force for expanding rights.

3. Incorporation of the Bill of Rights |

Originally, the Bill of Rights restricted only the federal government. The Supreme Court has used the Fourteenth Amendment’s due process clause to ‘incorporate’ most of these rights, making them applicable to state governments. This process has extended protections such as free speech, free exercise of religion and the right to counsel across the country.

Cases like Gideon v. Wainwright (1963), which guaranteed legal representation for criminal defendants, and Mapp v. Ohio (1961), which applied the exclusionary rule to states, illustrate how incorporation has strengthened rights protection at the state level.

4. Expanding equality and individual liberty |

The Court has also protected rights related to privacy and personal autonomy. In Griswold v. Connecticut (1965), it recognised a constitutional right to privacy, which later underpinned Roe v. Wade (1973) on abortion. Although Roe was overturned in Dobbs v. Jackson (2022), the line of cases demonstrates the Court’s capacity to expand individual liberty through constitutional interpretation.

Likewise, decisions on freedom of expression, such as Texas v. Johnson (1989) protecting flag burning as symbolic speech, show the Court defending unpopular rights against majority sentiment.

5. Limits: the Court cannot act on its own | 局限:法院无法自行行动

A major limit on the Court’s effectiveness is that it cannot initiate cases; it must wait for a genuine ‘case or controversy’ to come before it. This means that some rights violations may never reach the Supreme Court, especially if victims lack resources, legal standing or the willingness to pursue lengthy litigation.

The Court also refuses to issue advisory opinions, so it cannot pre-emptively rule on the constitutionality of a law until someone with standing challenges it. This reactive nature slows down rights protection and leaves gaps.

6. Limits: reliance on other branches for enforcement |

Even when the Court issues a decision protecting rights, it relies on the executive and legislative branches to enforce and implement its rulings. President Andrew Jackson famously said of Worcester v. Georgia (1832), ‘John Marshall has made his decision; now let him enforce it.’ This highlights the Court’s lack of enforcement power.

After Brown v. Board of Education, many southern schools resisted desegregation for years. Federal troops were needed to enforce the ruling in Little Rock in 1957. Thus, judicial protection of rights can be delayed or undermined if other branches fail to act.

7. Politicisation and judicial appointments |

Supreme Court justices are nominated by the president and confirmed by the Senate, making the appointment process deeply political. Justices often reflect the ideological views of the presidents who appoint them, which can shape how they interpret rights. This means the Court’s protection of rights is not neutral but shifts with the political balance.

The confirmation battles over justices such as Brett Kavanaugh and Amy Coney Barrett show how partisan divisions influence the Court. Critics argue that this politicisation undermines the Court’s legitimacy as an impartial protector of rights.
