1. Welcome to AQA Law: What the Course Involves | 欢迎学习 AQA 法律:课程内容概览
The AQA A-level Law course is designed to give you a thorough understanding of how law is made, applied and reformed. In Year 12, you will study the nature of law and the English legal system, alongside two substantive areas of law: criminal law and tort law. This combination allows you to explore both the framework of the legal system and the rules that govern personal and public conduct.
The course is assessed through written examinations that require you to explain legal principles, apply them to scenario questions and evaluate the effectiveness of the law. You will need to develop skills in critical thinking, precise writing and logical reasoning. Much of the vocabulary will be new, but regular reading of legal news and structured notes will help you master it.
Do not worry if the law feels unfamiliar at first. This summer is the perfect time to build a foundation, so that when you walk into your first lesson you already understand the difference between civil and criminal law, and you know what a ‘precedent’ means.
2. The English Legal System: Courts and Sources of Law |
The English legal system is built on a hierarchy of courts and a distinctive blend of sources. At the top sits the Supreme Court, which replaced the House of Lords in 2009. Below it are the Court of Appeal, the High Court and the lower courts such as the Crown Court and Magistrates’ Court. Civil and criminal cases are heard in different courts, and understanding this structure is essential for any law student.
There are two main sources of law in England and Wales: Parliament-made law (statute law) and judge-made law (common law). Statute law, also called legislation, is created through Acts of Parliament and takes precedence over common law. However, judges still play a vital role by interpreting statutes and by developing the common law through the doctrine of judicial precedent.
When a higher court decides a legal point, that decision becomes binding on all lower courts in future similar cases. This is called binding precedent, and it ensures consistency and predictability in the law. Where a court is not strictly bound, the decision may be persuasive precedent. Being able to distinguish between these concepts will be fundamental for your essays.
3. Law Making: Parliament and Judicial Precedent |
Parliament is the supreme law-making body in the UK. An Act of Parliament begins as a Bill, which must pass through several stages in both the House of Commons and the House of Lords before receiving Royal Assent. The stages – First Reading, Second Reading, Committee Stage, Report Stage and Third Reading – allow detailed scrutiny and debate. Once enacted, the statute becomes part of the law that judges must apply.
Judicial precedent, on the other hand, is law created by judges when they decide cases. The principle of stare decisis (stand by what has been decided) forms the backbone of this system. A court will follow the ratio decidendi (the reason for the decision) of a higher court. Any comments made by the way, or obiter dicta, are not binding but may influence later courts. You will spend a lot of time learning how to identify the ratio in a case.
Both ways of making law interact constantly. Parliament can pass a statute to overturn an unpopular precedent, and judges must interpret the words of that statute when disputes arise. This dynamic balance is what makes the English legal system both stable and flexible, and it is a recurring theme in AQA Law papers.
4. Statutory Interpretation and Delegated Legislation |
Statutory interpretation refers to the methods judges use to understand and apply the words of an Act of Parliament. Even carefully drafted words can be ambiguous or lead to absurd outcomes, so judges have developed several approaches. The literal rule gives words their plain, ordinary meaning, whereas the golden rule allows courts to avoid an absurd result. The mischief rule looks at the problem Parliament intended to fix, and the purposive approach seeks the overall purpose of the legislation.
Delegated legislation is law made by bodies other than Parliament, to which Parliament has granted authority through a parent Act. There are three main types: Orders in Council made by the Privy Council, statutory instruments made by government ministers, and by-laws created by local authorities or public bodies. Delegated legislation is essential because it saves parliamentary time and allows experts to fill in technical details, but it also raises questions about democratic accountability.
Both statutory interpretation and delegated legislation are frequently tested. You may be asked to discuss the advantages and disadvantages of each approach, or to apply the rules of interpretation to a short scenario. Building a clear table of definitions and examples over the summer will give you a valuable revision resource later.
5. Legal Personnel: Judges, Solicitors and Barristers |
The English legal profession is divided into barristers and solicitors, with judges usually appointed from the ranks of experienced barristers or, increasingly, solicitors. Barristers specialise in advocacy and provide expert legal opinions, while solicitors have direct contact with clients and handle most legal paperwork. The training routes are different: barristers complete the Bar Training Course, and solicitors must pass the Solicitors Qualifying Examination.
Judges play multiple roles: they preside over trials, sum up evidence, pass sentences and, in civil cases, determine the outcome. In the appellate courts, judges develop the law through their judgments. The independence of the judiciary is a cornerstone of the rule of law, and it is protected by security of tenure and immunity from legal action for judicial acts. Understanding how judges are appointed and how they are kept independent will feature in your study of the legal system.
For summer preparation, try to read a profile of a senior judge or watch a short video about a ‘day in the life’ of a barrister. This will help you visualise the people behind the rules and make textbook descriptions more memorable.
6. Introduction to Criminal Law: Actus Reus and Mens Rea |
Criminal law deals with behaviour that the state considers harmful and punishes accordingly. In AQA Law, you will study general principles first, then specific offences. The foundation of criminal liability is built on two Latin maxims: actus reus (the guilty act) and mens rea (the guilty mind). For most crimes, the prosecution must prove both elements beyond reasonable doubt.
Actus reus can be an act, an omission (in limited circumstances) or a state of affairs. It must be voluntary. Manslaughter by omission will be explored later, but even now you can remind yourself that there is generally no liability for failing to act unless a duty of care is established. Mens rea refers to the mental element, such as intention, recklessness or negligence. Direct intent means the defendant desired the consequence; oblique intent occurs where the consequence was a virtual certainty and the defendant appreciated that.
Causation is also part of actus reus: the prosecution must show that the defendant’s act was both the factual cause (the ‘but for’ test) and the legal cause (the operating and substantial cause) of the harm. Start collecting simple examples, such as stabbing followed by poor medical treatment, to see how the chain of causation can be broken.
7. Non-Fatal Offences Against the Person |
Among the first substantive topics you will meet in criminal law are the non-fatal offences against the person, which are set out in the Offences Against the Person Act 1861 and the common law. The main offences are assault, battery, assault occasioning actual bodily harm (ABH), malicious wounding or inflicting grievous bodily harm (GBH under section 20), and wounding or causing GBH with intent (section 18).
Assault and battery are common law offences. Assault is causing the victim to apprehend immediate unlawful personal violence; no touching is needed. Battery is the actual infliction of unlawful force. Moving to statutory offences, ABH is defined as any hurt or injury calculated to interfere with the health or comfort of the victim. For section 20 GBH, the mens rea is ‘malice’, which means intention or recklessness to cause some harm. For section 18, the mens rea is specific intent to cause GBH, making it far more serious.
These offences build a ladder of severity, and you will need to be able to explain the actus reus and mens rea of each, and to apply them to problem scenarios. Why not create a one-page summary table over the summer, showing the offence, its definition, actus reus, mens rea and maximum sentence? This will be an excellent study aid when lessons begin.
8. Introduction to Tort Law: Duty of Care and Negligence |
Tort law is concerned with civil wrongs, where one party sues another for a remedy, often damages. The largest area within tort is negligence. To succeed in a negligence claim, a claimant must prove three elements: that the defendant owed them a duty of care, that the defendant breached that duty, and that the breach caused the damage which was not too remote.
The modern duty of care test was established in Caparo Industries plc v Dickman (1990). It asks three questions: was damage reasonably foreseeable? Was there a relationship of sufficient proximity between the parties? Is it fair, just and reasonable to impose a duty? The law has since developed, and in many established situations, such as road users or doctor-patient relationships, a duty is automatically recognised.
Breach of duty is judged by the standard of the reasonable person. If the defendant is a professional, the standard is that of a reasonably competent person in that profession. The court will consider various factors, such as the likelihood of harm, the seriousness of potential injury, the cost of taking precautions and any social utility of the defendant’s conduct. All of these ideas will be explored through landmark cases like Bolton v Stone and Paris v Stepney Borough Council.
9. Remedies and Damages in Tort |
If a claimant successfully proves negligence, the court will award a remedy. The primary remedy in tort is damages: a sum of money intended to put the claimant back in the position they would have been in had the tort not occurred, as far as money can achieve. Damages are divided into special damages (quantifiable losses such as lost earnings and medical expenses) and general damages (unquantifiable losses such as pain and suffering).
There are other remedies too, such as injunctions, which are court orders requiring a party to do or refrain from doing something. Injunctions are discretionary and are often used in nuisance cases. Understanding the difference between legal and equitable remedies will help you structure evaluative answers. You should also be aware of the concept of mitigation of loss: claimants must take reasonable steps to minimise their losses.
You will not need to memorise every detail of remedies over the summer, but grasping the basic distinction between special and general damages will give you confidence. Try to follow a short news story about a personal injury claim and identify what losses the claimant might be seeking.
10. Building Legal Study Skills and Your Summer Plan |
Studying law is not just about memorising rules; it is about learning to think like a lawyer. This means being able to separate material facts from background detail, apply legal tests in a logical sequence, and evaluate the fairness or effectiveness of a legal principle. Over the summer, you can begin to practise this with simple activities that will make a huge difference when term starts.
First, create a digital or paper glossary for legal vocabulary. Each time you encounter a term like ratio decidendi, mens rea or duty of care, write down a definition in your own words. Second, start a ‘case bank’: for each case you read about, record the court, the material facts, the legal issue and the principle. Third, practise issue spotting with newspaper articles. Ask yourself: if this were a legal scenario, what kind of law is involved and what would the court need to decide?
A realistic summer plan might include two hours per week: one hour for reading an introductory textbook or a reliable website chapter, and one hour for making notes and adding to your glossary and case bank. Do not try to cover everything; depth on a few key topics is far better than superficial coverage of the whole syllabus. This way you enter Year 12 with a solid foundation and the habit of active learning.
By taking these steps, you will be in an excellent position to enjoy the intellectual challenge of AQA Law and to achieve a high grade. The law touches every aspect of life, and your journey into it begins now.
