First, tackle Alex’s liability for assault. Reference R v Miller: ‘actual bodily harm’ includes any hurt or injury calculated to interfere with the health or comfort of the victim.

Negligence requires duty of care, breach, causation and damage. Start with the supermarket’s duty to Erin. Under the Occupiers’ Liability Act 1957, visitors are owed a common duty of care. Also a common law duty exists via the neighbour principle (Donoghue v Stevenson). The supermarket clearly owes Erin a duty as a lawful visitor. The duty has been delegated to Dev, whose failure to use a warning sign is a breach.

As for causation, the ‘but for’ test (Barnett v Chelsea Hospital) shows that but for the wet floor and missing sign, Erin would not have fallen. However, the defendant may raise contributory negligence because Erin was looking at her phone. Under the Law Reform (Contributory Negligence) Act 1945, damages can be reduced if the claimant failed to take reasonable care for her own safety. A court might deduct 20‑30%.

Note the policy limits set by White v Chief Constable of South Yorkshire: the law is reluctant to extend liability to pure psychiatric damage in the absence of physical injury to the claimant.

Here, the advert is likely a unilateral offer: ‘£200 to the first person who texts me before 5pm.’ Harry’s first text at 4.55pm was not an acceptance because it introduced a new term (‘for £180’); it was a counter-offer, which destroys the original offer (Hyde v Wrench). Gemma did not accept the counter-offer, so no contract with Harry arises from that exchange.
