📚 Year 12 AQA Law: Essential Terminology Quick-Memorisation Guide | Year 12 AQA

Mastering legal vocabulary is the foundation of success in AQA A-level Law. Without a firm grasp of key terms, you will struggle to apply the law to scenarios and to write precise essays. This guide breaks down the most important terminology from the English legal system, criminal law, and tort law, pairing each concept with clear explanations in both English and Chinese. Use the tables, memory hacks, and paired paragraphs to speed up your revision and ensure you can recall each term accurately under exam pressure.

1. The Building Blocks: Law and Legal System |

Before diving into specific areas, you must be comfortable with the foundational vocabulary that describes the nature of law and the structure of the English legal system.

Rule of law – the principle that all people and institutions are subject to and accountable to law that is fairly applied and enforced.
Separation of powers – the division of government responsibilities into distinct branches (legislature, executive, judiciary) to limit any one branch from exercising the core functions of another.
Parliamentary sovereignty – the doctrine that Parliament is the supreme legal authority, which can create or end any law.
Common law – law developed by judges through decisions of courts and similar tribunals, as opposed to statutes adopted through the legislative process.
Civil law (in the context of the English system) – the system of law concerned with private relations between members of a community, as distinct from criminal proceedings.

2. Sources of Law: Parliament and the Courts |

The two main sources of law you need to know are Acts of Parliament (statute law) and judicial precedent (case law). Each generates its own set of terms.

Primary legislation – Acts of Parliament that have been passed by the House of Commons and the House of Lords and received Royal Assent.
Secondary (delegated) legislation – law made by a person or body to whom Parliament has delegated law-making power, such as a Minister through a statutory instrument.
Judicial precedent – the process by which judges follow the decisions of previous courts in cases with similar facts; also known as stare decisis (‘stand by what has been decided’).
Ratio decidendi – the legal principle or reason for the decision that is binding on lower courts.
Obiter dicta – statements made by a judge that are not essential to the decision and are not binding, but may be persuasive.
Statutory interpretation – the process by which judges interpret legislation. The main rules are the literal rule, the golden rule, the mischief rule, and the purposive approach.

3. The Court Hierarchy and Legal Personnel |

Understanding the court structure is essential because it determines which decisions are binding. You also need to distinguish between the different legal professionals involved in a case.

The court hierarchy for criminal cases begins with the Magistrates’ Court and the Crown Court, and appeals go to the Court of Appeal (Criminal Division) and finally the Supreme Court. For civil cases, the County Court and the High Court feed into the Court of Appeal (Civil Division) and the Supreme Court. Barristers have rights of audience in all courts and often specialise in advocacy, while solicitors provide legal advice and prepare cases. Judges make decisions on points of law, and juries decide questions of fact in Crown Court trials.

4. Criminal Law: Actus Reus and Causation |

Every criminal offence, unless it is one of strict liability, requires both the guilty act (actus reus) and the guilty mind (mens rea). Start by memorising the actus reus terms.

Actus reus – the physical element of a crime. It can be an act, an omission (in certain circumstances), or a ‘state of affairs’.
Omissions – failure to act when there is a legal duty to do so. Duties arise from statute, contract, a special relationship, the voluntary assumption of responsibility, or the creation of a dangerous situation.
Causation – the link between the defendant’s conduct and the result. It has two parts: factual causation (‘but for’ test) and legal causation (the defendant’s act must be a more than minimal cause, and there must be no intervening act that breaks the chain of causation).
Chain of causation – the direct link from the defendant’s act to the consequence. It can be broken by a novus actus interveniens (new intervening act) such as an unforeseeable act of a third party or a victim’s own free will.

5. Criminal Law: Mens Rea and Strict Liability |

Mens rea is the mental element of a crime. The level required varies by offence, from intention to negligence. Strict liability offences are an exception, where no mens rea is needed.

Direct intention – the defendant’s purpose or aim to bring about a prohibited consequence.
Oblique (indirect) intention – the defendant did not necessarily desire the consequence, but it was a virtually certain result of their actions and they appreciated this (as per R v Woollin).
Recklessness – the defendant foresees a risk of the prohibited consequence and unreasonably takes that risk (subjective test following R v G).
Negligence – the defendant’s conduct falls below the standard of a reasonable person, without necessarily foresight of the risk. Used in gross negligence manslaughter.
Strict liability – offences where liability is imposed regardless of mens rea. Only the actus reus needs to be proved. They are usually regulatory in nature (e.g., food safety, pollution).

6. Criminal Defences: A Quick Reference |

Defences can negate the actus reus, negate the mens rea, or provide a justification or excuse. Knowing the exact terminology helps you apply them accurately.

Insanity – the defendant must prove that, due to a disease of the mind, they did not know the nature and quality of the act or that what they were doing was wrong (M’Naghten Rules).
Automatism – the defendant acted involuntarily due to an external factor (e.g., a blow to the head, medication). If caused by an internal factor, it is insanity.
Intoxication – voluntary intoxication can be a defence to crimes of specific intent if it prevents the defendant forming the required mens rea, but not to crimes of basic intent. Involuntary intoxication is a full defence if mens rea is absent.
Self-defence / prevention of crime – the defendant may use reasonable force to protect themselves, another person, or property, or to prevent a crime. The force must be necessary and proportionate.
Duress – the defendant was forced to commit a crime by threats of death or serious bodily injury. Not available for murder or some treason offences.

7. Tort Law: Negligence and Duty of Care |

Negligence is the largest tort topic at Year 12. To establish negligence, the claimant must prove: duty of care, breach of that duty, and damage caused by the breach.

Duty of care – the legal obligation to take reasonable care not to harm others. Established by the Caparo three-part test: foreseeability of damage, proximity between the parties, and whether it is fair, just and reasonable to impose a duty.
Breach of duty – the defendant fell below the standard of the ‘reasonable person’. The court considers factors such as likelihood of harm, seriousness of the risk, practicality of precautions, and any social utility of the defendant’s conduct.
Standard of care – the level of care a reasonable person would exercise in the circumstances. Professionals are judged by the standard of a reasonably competent member of that profession (Bolam test). Learners are judged by the standard of a reasonably competent driver.

8. Tort Law: Damage, Causation and Defences |

After establishing duty and breach, the claimant must prove causation and damage. Tort law also offers several specific defences.

Factual causation – the ‘but for’ test: but for the defendant’s breach, would the claimant have suffered the loss? If the loss would have occurred anyway, the breach is not the cause.
Remoteness of damage – the damage must not be too remote. Under The Wagon Mound, the defendant is liable only for damage that was reasonably foreseeable.
Thin skull rule – the defendant must take the victim as they find them. Even if the claimant suffers unusually severe injury due to a pre-existing condition, the defendant is liable for all the damage.
Contributory negligence – a partial defence where the claimant’s own carelessness contributed to their injuries. Damages are reduced by a percentage to reflect the claimant’s share of the blame.
Volenti non fit injuria – (consent) the full defence that the claimant voluntarily accepted the risk of harm, with full knowledge of the nature and extent of the risk.

9. Memory Hacks: Acronyms and Sound-alikes for Law Terms |

Many legal concepts can be grouped into memorable acronyms. Using these as quick triggers will help you recall entire frameworks in an exam.

For actus reus and omissions duties, remember ‘SCARF’: Statutory duty, Contractual duty, Assumed responsibility, Relationship duty, and Failure to correct a danger you created. For the Caparo three-part test, use ‘FPR’: Foreseeability, Proximity, and Reasonable to impose. For the rules of statutory interpretation, think ‘GLMP’: Golden rule, Literal rule, Mischief rule, Purposive approach. To distinguish the two types of intention, link ‘Oblique’ with ‘O’ for ‘Outcome virtually certain’.
