1. The Basic Criminal Liability Equation | 刑事责任基本方程式

The fundamental formula for establishing criminal guilt is: Actus Reus (guilty act) + Mens Rea (guilty mind) + Absence of a valid defence = Liability. The prosecution bears the burden of proving each element beyond reasonable doubt, as affirmed in Woolmington v DPP (1935).

Causation measures the link between the defendant’s act and the consequence. The test has two limbs: factual causation, requiring that ‘but for’ the defendant’s conduct the result would not have occurred (R v White 1910), and legal causation, asking whether the defendant’s act was the ‘operating and substantial’ cause of the harm (R v Smith 1959).

The thin skull rule ensures defendants take victims as they find them, even for hidden conditions (R v Blaue 1975).

3. The Caparo Tripartite Test for Duty of Care | 注意义务的Caparo三步检验

In negligence, a duty of care is a prerequisite. The leading Caparo Industries plc v Dickman (1990) test requires three ingredients: (1) the damage must have been reasonably foreseeable; (2) there must be a sufficiently proximate relationship between the parties; and (3) it must be fair, just, and reasonable to impose a duty.

The ‘fair, just, and reasonable’ limb is a policy gateway used to restrict claims, for instance to prevent crushing liability or to protect public bodies (Hill v Chief Constable of West Yorkshire 1989).

4. Negligence: The Full Tort Formula | 疏忽侵权完整公式

Once a duty is established, the tort of negligence requires three further elements to crystallise: breach of that duty, causation of damage, and remoteness of damage. The overall equation is Duty + Breach + Causation + Damage = Negligence Liability.

5. Contract Formation Formula | 合同订立公式

A valid contract is formed when four essential elements coincide: Offer + Acceptance + Consideration + Intention to Create Legal Relations = Contract. Each component is strictly tested at Common Law, with additional requirements for certain types of contract, such as formality for deeds.

Consideration must be sufficient but need not be adequate, and must move from the promisee (Currie v Misa 1875). Intention is presumed in commercial agreements and rebutted in social or domestic ones (Balfour v Balfour 1919).

6. Murder and Voluntary Manslaughter Formula | 谋杀与自愿非预谋杀人公式

Murder is committed when a person unlawfully kills a reasonable creature under the Queen’s Peace with malice aforethought, expressed as intention to kill or cause grievous bodily harm (GBH). The equation Murder = Unlawful Killing + Intention to Kill or Cause GBH. When a partial defence succeeds, the conviction is reduced to voluntary manslaughter.

The two principal partial defences are loss of control and diminished responsibility. Loss of control (Coroners and Justice Act 2009) requires a qualifying trigger, such as a fear of serious violence or things said/done of an extremely grave character, and a person of D’s sex and age with normal tolerance might have reacted similarly. Diminished responsibility (Homicide Act 1957, amended) applies where D suffered an abnormality of mental functioning arising from a recognised medical condition which substantially impaired ability to understand conduct, form rational judgment, or exercise self-control, and it provides an explanation for the killing.

7. Involuntary Manslaughter Formulae | 非自愿非预谋杀人公式

Involuntary manslaughter applies where a defendant causes death without the mens rea for murder. The two main types are unlawful act manslaughter (UAM) and gross negligence manslaughter (GNM). UAM = Unlawful Act + Dangerous Act + Causes Death. GNM = Duty of Care + Breach of Duty + Gross Negligence + Causes Death.

For UAM, the unlawful act must be a crime (not tort), and ‘dangerous’ means a sober and reasonable person would recognise the risk of some harm, albeit not serious harm (R v Church 1966). The act must also cause the death. In GNM, a duty of care is established under ordinary negligence principles, and the breach must be so egregious as to deserve criminal sanction, judged by the ‘jury test’ of whether the conduct was truly exceptionally bad (R v Adomako 1994; R v Bateman 1925).

8. Theft Act 1968: Definitional Formula | 1968年《盗窃法》定义公式

Under s.1 Theft Act 1968, theft is defined as the dishonest appropriation of property belonging to another with the intention of permanently depriving the other of it. The statutory formula is: Theft = Appropriation (s.3) + Property (s.4) + Belonging to another (s.5) + Dishonesty (s.2) + Intention to permanently deprive (s.6).

Appropriation is widely interpreted to include any assumption of the rights of an owner, and even a lawful acquisition can become theft if a later assumption occurs (R v Gomez 1993; R v Hinks 2001). Dishonesty is now tested against the two-stage test in Ivey v Genting Casinos (2017): what was D’s actual state of knowledge or belief as to the facts, and was the conduct dishonest by the standards of ordinary decent people? The intent to permanently deprive includes treating the property as one’s own regardless of return (s.6).

9. Self-Defence and Duress: Defence Equations | 正当防卫与胁迫:抗辩方程式

Self-defence is available where the defendant honestly believed the use of force was necessary and the degree of force used was reasonable in the circumstances. The defence equation is: Honest Belief (subjective) + Reasonable Force (objective). Both limbs are governed by s.76 Criminal Justice and Immigration Act 2008, which preserves the common law.

There is no duty to retreat, but the opportunity to retreat may be evidence of whether the force was reasonable (R v Bird 1985). A mistaken belief may be relied upon unless it stems from voluntary intoxication. For duress by threats, the legal test requires a threat of death or serious injury, directed towards D or a person for whom D reasonably regards himself as responsible, and that a sober person of reasonable firmness sharing D’s characteristics would have acted as D did (R v Graham 1982; R v Howe 1987 limits duress as a defence to murder).

10. Rylands v Fletcher Rule | Rylands v Fletcher 规则

The rule in Rylands v Fletcher (1868) imposes strict liability for damage caused by the escape of a thing likely to do mischief from land used for a ‘non-natural’ purpose. The formula is: Accumulation + Non-Natural Use + Thing Likely to Do Mischief if it Escapes + Escape + Damage = Liability.

The defendant must bring onto his land and keep there something that is likely to do mischief if it escapes. ‘Non-natural use’ was classically described in Rickards v Lothian (1913) as some special use bringing with it increased danger to others, and not merely an ordinary use of land or such a use as is proper for the general benefit of the community. Defences include act of a stranger, consent of the claimant, and statutory authority.

11. Vicarious Liability Test | 替代责任检验

Vicarious liability makes an employer jointly liable for torts committed by an employee in the course of employment. The test has been broadened by recent case law: it requires the tort to be committed by an employee (or someone in a relationship ‘akin to employment’), and the wrongful conduct must be so closely connected with the employment that it is just and fair to hold the employer liable.

替代责任使得雇主对于雇员在雇佣过程中实施的侵权承担连带责任。近期判例法扩展了检验标准:要求侵权行为由雇员(或处于“类似于雇佣关系”中的人)实施,且错误行为必须与雇佣关系如此紧密相连,以至于让雇主承担责任是公正且合理的。

The ‘course of employment’ can include unauthorised modes of doing an authorised task, and even intentional wrongdoing if it is sufficiently connected to the job (Lister v Hesley Hall Ltd 2001; Mohamud v WM Morrison Supermarkets plc 2016). Independent contractors generally do not trigger vicarious liability, although the concept of ‘akin to employment’ has expanded liability in situations like prisoners working in prisons (Cox v Ministry of Justice 2016). The policy justification lies in the employer’s deeper pockets, creation of risk, and ability to control and spread losses.
